RE: APPROVAL OF RECORDED EXEMPTION NO. 710 - DAVID AND JOYCE
SARCHET
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels,
as shown on the plat known as Recorded Exemption No. 710 , does
not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS , the request for Recorded Exemption No . 710 was sub-
mitted by David and Joyce Sarchet for property which is located
in the SEa , Section 28 , Township 3 North, Range 66 West of the
6th P.M. , Weld County, Colorado, being more particularly described
in the plat which shall be provided by the applicant and known
as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into par-
cels of 154 acres and 5. 9 acres, more or less .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land be, and hereby is, exempt from the defi-
nition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that that this approval
is subject to the following conditions : 1) the applicant shall
submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder.
The plat shall be drawn in accordance with the requirements of
Section 9-2C. (4) of the Weld County Subdivision Regulations . The
plat shall be submitted within ninety days from the date of appro-
val by the Board of County Commissioners and; 2) a note shall be
placed on the plat. The note shall read, "No additional well
permits will be available in the SEa SEa, Section 28 , Township
3 North, Range 66 West of the 6th P .M. , Weld County, Colorado. "

Dear Commissioners:
The attached application, plat and related items are in reference to a
request from David and Joyce Sarchet for a recorded exemption. The parcel
of land on which this request is being made is described as SEA, Section 28,
T3N, R66W of the 6th P.M. , Weld County, Colorado.
The property is located 3 miles southeast of Platteville on Weld County Road
28. The property contains approximately 160 acres of Class Ile (prime) IIIe
Ills IVe irrigated and Ive VIe nonirrigated soils. The parcel of land under
consideration is the total contiguous land holdings of the applicant.
The request is to divide the property into parcels of 154 acres and 5.9
acres, more or less. The applicants propose to sell the smaller lot which
has the improvements to their son and daughter-in-law. The larger parcel
will continue to be used for agricultural production.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The request complies with Section 9-2C of the Weld County
Subdivision Regulations submission requirements; and
2. The request complies with Section 9-2E of the Subdivision
Regulation as follows:
The 160 acres, more or less, under consideration will be
compatible with the existing surrounding land uses and with future
development of the surrounding area as permitted by the existing
Agricultural zone. The proposal is also consistent with the
intent of the Agricultural Zone District in which it is located.

2. A note shall be placed on the plat. The note shall read,
"No additional well permits will be available in the SE4 SEa,
Section 28 , T3N, R66W of the 6th P.M. , Weld County, Colorado. "

- The proposal is in compliance with Section 1-3 of the Weld County
Subdivision Regulations and the proposed land division complies
with the Weld County Comprehensive Plan. Therefore, the proposed
use is consistent with efficient and orderly development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for land
division.
- The proposed lots are not part of a recorded exemption within the
last five (5) years.
- The two lots proposed will have adequate access from Weld County
Road 28
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements
of Section 9-2C. (4) of the Weld County Subdivision Regulations. The
plat shall be submitted within ninety (90) days from the date of
approval by the Board of County Commissioners.

Dear Mr. Mayerl:
We have reviewed the above referenced application to separate 5.95 acres
from 160 acres. The proposed source of water for this tract is an existing
domestic well which is located on the 5.95-acre tract. The well permit for
this well was issued limiting it as the only well in the SE1/4 SE1/4, Sec. 28,
T3N, R66W. No additional well permits could be made available on this 40-acre
tract. A new domestic well permit could be made available for other 40-acre
tracts on the remaining 154.05 acres. Therefore, we recommend approval con-
ditioned upon it being made clear by covenant, plat note, or other instrument
that no additional well permits will be available in the SE1/4 SE1/4, Sec. 28,
T3N, R66W.

Supporting Statements
A. Purpose and reason for dividing lot into two lots.
The lot is being divided into two separate lots, because I am
selling the residence located on the smaller lot to Scott and
Nancy Sarchet, my son and daughter-in-law.
B. Consistency with Policies of Weld County Comprehensive Plan.
One single family dwelling per legal lot is specifically
allowed as a use permitted by right on agriculturally zoned
areas.
C. Consistency with Intent of the Agricultural District.
The small lot will continue to be used for agricultural
purposes except for the area upon which the residence is
located which is specifically allowed by the Comprehensive
Plan.
D. Compatability with Surrounding Land Uses .
All land surrounding subject property is agricultural land.
No inconsistency of use is presented by this application.
E. Compatability with Future Development.
No contiguous residential development is anticipated.
Continuing agricultural uses of the property and surrounding
property poses no conflict.
F. Water and sewage disposal.
There is an existing well and septic system on the property.
A copy of the well permit is attached to this application.
G. Property Not within Hazard Area.
The property under consideration is not located in a flood
