My property is located at 13292 CR 38.5;Donna's is located at 13031 CR 38. Although we do not fall within the 500 foot buffer requirement(Sec.23-2-2101,there are concerns with our properties that will cause additional impacts with Noble Energy's business. This area is already inundated with diesel smell, noise, dust and heavy traffic - water trucks,dump trucks, gravel trucks, oil equipment,commodity trucks,to name a few. We recently wrote a letter to Public Works requesting a count due to the heavy traffic on CR 38. At that time the traffic was coming from Sand Platte and Gravel. This situation may have been a two week special project;however, it was absolutely awful. At one point,I counted 39 trips by dump trucks in a 45-minute period utilizing CR 38. [Picture#1) The speed limit on State Highway 60 is 65 mph and is only a 2-lane highway. With the increase in traffic, the County and the State should be very concerned about the traffic on State Highway 60 between CR 38.5 and CR 38. At CR 38.5 you have the water trucks continuously going in and out of A&W Water's oil and gas support business site on a daily basis[7 days a week]. At CR 38 you have water trucks,gravel trucks,dump trucks,etc. If Noble Energy is allowed a USR at this location,this will increase congestion to this potential traffic hazard area. There are no signs indicating"Heavy Truck Traffic";"Caution:Trucks Entering the Highway" - not one sign. We have seen vehicles swerve around turning trucks,trucks go through stop signs to beat the traffic-all on • a regular basis. There is a serious need for some signage, even to the point of reducing the speed limit. The water trucks will clip along at a pretty good rate because of traffic behind them,then put on their"fake brake"to make a quick turn. As an example,on July 21,2008 there were 5 out of B trucks in a 20 minute period that did not stop entering onto State Highway 60. Additionally,on August 17,2007 A&W Water had a"Driver Appreciation Day"which generated a large amount of traffic at State Highway 60 and CR 38 Y ; plus another large gathering on October 4,2007. [Picture#2). A&W has a very large business with their oil and gas support operation in the agriculture zoned PRIME FARM LAND area. Not only do they haul water,they have allowed the oil companies to dump"sludge", in excess of the Oil and Gas Commissions regulations,on their property. In 2007,from January-November, on fourteen[14)occasions I documented the number of water trucks entering,or exiting,the main A&W Water driveway off of State Highway 60. The total time I surveyed was approximately 8 hours,which calculated to 223 water trucks per hour. In 2008, beginning around January or February,I noticed the 0� traffic becoming exceptionally heavy,between CR 38 and approximately'/2 mile north of CR 38 '/2, I continued to document the water trucks and sludge trucks. The water trucks,for the 17.5 total hours R. documented,was 395 trips which amounts to 22.1 trips per hour,the sludge trucks for the same amount of time,totaled 341 trips,which amounts to '19.5 trips per hour. These operations continues anywhere from 8-12 hours per day,7 days a week My calculations do not include commodity trucks,oil qompany's equipment, etc....just water trucks. (Picture#3 and Picture #4) • EXHIBIT i 66 us Page 2 • USASR 1662 Having another large business in this area is not compatible with this area for these reasons: SECTION 22-1-50-Content of Plan: D3 b.-Industrial: "Industrial uses directly related to agriculture may be accommodated in agricultural areas." SECTION 23-3-10 Intent: "Agriculture in the COUNTY is considered a valuable resource which must be protected from adverse impacts resulting from uncontrolled and undirected business, industrial and residential land USES." This is not an industrial zone; it is PRIME FARM LAND in the agricultural zone. This request is not related to, or dependent on agriculture. SECTION 22-4-10-Purpose-A,B&D: "....in order to preserve a healthy and positive quality of life for County citizens,the following four[4) principles should be considered in all land use issues: A. Impacts from proposed land uses on air,water,waste, noise and public health should be considered; B.Environmental impacts should be reduced or mitigated in order to prevent harm to life, health and property. D.The County shall encourage and promote coordination and cooperation between federal, state and local governmental entities charge with making decisions which may have environmental impacts on the land uses and residents in the County." Once again,the noise, dust and traffic issues make a huge impact on this area, posing health and safety issues. The dust is so thick your visibility is little to none. The County and State need to evaluate this entire area before allowing another industry in the Agricultural zone. (Picture #5) SECTION 22-4-40 Air-C: "In addition to emissions of criteria and hazardous pollutants,the County is concerned with nuisance emissions of odor and dust. The County will encourage development to occur in • a manner that minimizes these impacts." The trucks continue to cause a nuisance condition with the dust and diesel fumes. The large volume of trucks has made the area a major concern for health issues with the diesel fumes and dust Based on what Planner Kim Ogle told us, Public Works will require this operation to use only paved roads. There are no guarantees that will happen. SECTION 22-2-60 Agricultural goals and policies A.Policy 1.3 "Allow commercial and industrial uses, which are directly related to, or dependent upon agriculture,to locate with the A(Agricultural)Zone when the impact to surrounding properties is minimal, and where adequate services and infrastructures are currently available or reasonably obtainable. ...Agricultural business and industries are defined as those which are related to ranching, livestock production,farming and agricultural uses." This business is not related or dependent upon the Agricultural industry. SECTION 22-460 Noise and SECTION 22-470 Noise goals and policies-A.N.Goal 1: "Noise is a source of environmental pollution. Exposure to excessive noise levels over prolonged periods can be a threat to public health. Statutory noise standards have been established for areas where commercial, industrial and residential uses are located." A.N Goal 1: Minimize the impact of noise on County residences." Again,the large trucks and equipment make up for the noise concerns in this area. Per Noble's USR request, 30 trucks per day will utilize this area adding to the current adverse conditions. There is also no guarantee that there will only be 30 trucks,or that they will be only storing pipe at this location. The trucks loading or unloading the pipe will add to the noise. • Page 3 • USR 1662 SECTION 23-2-240-Design Standards-A.8:"An applicant for a Use by Special Review shall demonstrate compliance with the following design standards in the application and shall continue to meet these standards if approved for DEVELOPMENT:The access shall be located and designed to be safe; ingress and egress shall not present a safety hazard to the traveling public or to the vehicle accessing the property. For USES generating high traffic volumes and large number of large,slow-accelerating vehicles, acceleration and deceleration lanes may be required to mitigate a potential traffic hazard." SECTION 22- 1-50-Content of Plan:E2 Transportation: "The goals and policies of these Sections promote efficient and multimodal transportation that is sized and designed appropriate to the use. Any proposed land use changes will be required to address the impacts on transportation that may occur because of the change" SECTION 23-2-160-Site Plan Review-S: "A statement explaining how acceleration/deceleration lanes, when required by the Dept. of Public Works or the Colorado Department of Transportation,will provide safe,efficient access to ARTERIAL or COLLECTOR STREE I S." There is already the potential traffic hazard on State Highway 60 between CR 38 and CR 38 1/2, as well as west of State Highway 60 on CR 38. As stated above,there are no Department of Transportation signage indicating "Heavy Truck Traffic"or"Caution: Heavy Side Road Traffic", nor are there acceleration/deceleration lanes on State Highway 60 or on CR 38 west of State Highway 60. There are no Weld County signs on CR 38 or 38 1/2 indicating the same. This is a very potential traffic hazard. The traffic entering or exiting from CR 38,west of State Highway 60,is unbelievable. There is no guarantee that there will be only 30 trucks a day at Noble's site. Adding another industry to this traffic hazard area adds to the already adverse conditions. SECTION 23-2-250-Operations Standards-A:"An applicant for a Special Review Permit shall . demonstrate conformance with the following operation standards in the Special Review Permit application to the extent that the standards affect location,layout and design of the Used by Special Review prior to construction and operation. Once operational,the operation of the USES permitted shall conform to these standards:The operation of the USES shall comply with the noise standards enumerated in CRS:Section 25-12-101. CRS states "...noise is a major source of environmental pollution which represents a threat to the serenity and quality of life in the State of Colorado. Excess noise often has an adverse physiological and psychological effect on human beings, thus contributing to an economic loss to the community. Accordingly, it is the policy of the general assembly to establish statewide standards for noise level limits for various time periods and areas. Noise in excess of the limits provided in this article constitutes a public nuisance." The trucks sound like a train coming down the road, back off of their"jake brake", honk their horns. It is already a very noisy area with the trucks. When they come down these roads,the windows in the house rattle,you can't open windows to allow"fresh"air to come into the house. There is much concern with the dust issue and safety of trucks turning onto or off of State Highway 60, as well as the safety of vehicles utilizing these side roads. Requirements from CDOT should be in place to comply with their standards for the type and amount of volume. (This requirement should also apply to A&W Water and Sand Platte and Gravel; currently they produce a large amount of traffic) There is already in place a full fledged industrial operation going on with A&W Water. The State and County needs to evaluate this situation before allowing USR 1662 to be approved. There have been oil derricks and equipment stored on that property prior to Noble's request. This is Agriculture land, PRIME FARM LAND, not Industrial. • Page 4 • USSR 1662 We present these facts to you because there is a serious need in this area that the County and State need to evaluate. There are two large businesses,Sand Platte &Gravel and A&W Water that are affecting the area on State Highway 60 between CR 38 and CR 38 '/e. Another business would cause additional adverse conditions. Noble Energy is a large company and has obviously stored their equipment in other places,which they should continue to do. Our family has lived in this area since 1970. I, Diane, have lived at 13292 CR 38 '/z since 2002. My parents built this home in 1976. Donna's property at 13031 CR 38 is currently empty. We are in the process of cleaning, painting and selling this property. However, along with all of the above mentioned issues, allowing another industry to this area depreciates the value of this home. My renter had called the County in October 2007 to complain about the truck traffic generated from the oil and gas support business working from an agricultural zoned area. She was informed by Roger Caruso that"if that business was there before her,then she should move." He was to phone back with additional information and never did. We hope the information in this letter is better received. We contest to Noble Energy utilizing this area for their business purposes. If you have any questions,you may call me at 970-737-2225.
