RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST OSCAR AND DEBRA DE LUNA FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Oscar and Debra De Luna, ZCV #0800195, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 18th day of November, 2008, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,and
WHEREAS, Oscar and Debra De Luna were not present or represented at said hearing,
although all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until December 18, 2008, to allow adequate time for the property owner's daughter
to move and reduce the number of dogs to the allowed amount to bring the subject property into
compliance and for an inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0800195 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Oscar and Debra De Luna to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until December 18, 2008, to allow adequate time
for the property owner's daughter to move and reduce the number of dogs to the allowed amount
to bring the subject property into compliance.

household pets of two (2) or more species, are kept or maintained. Property that is zoned
(A) Agricultural and not part of a platted subdivision or unincorporated town and which is
larger than ten (10) acres shall be permitted to keep or maintain eight(8) HOUSEHOLD
PETS of one (1) species or sixteen (16) HOUSEHOLD PETS of two (2) or more species
without being considered a KENNEL.
REMEDY
The presence of more than 4 (four) dogs requires a Use by Special Review (USR) permit for a Kennel.
As we briefly discussed, the first step in correcting this violation is to complete the Pre-Application

08/01/2008 Phone Call Lucia De Luna (303-884-6649) called. She said that
approximately a month ago someone left a note
explained that she would need to get a kennel license in
order to have the number of dogs she has. She said she
spoke to a lady who was suppose to call her back with
that information. She never did. I explained that she
probably was speaking with Animal Control, which is who
advised me of her violation. I advised her that I would
send her the Pre-Application Request form. She would
need to fill it out and send it back in so the
pre-application meeting could be scheduled. This is the
first step. I explained this step was free. I told her that I
would also send her a Use by Special Review(USR)
application for the actual kennel. She said okay.

This hearing will take place in the County Commissioners Hearing Room, first floor, Weld County
Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a

Please also be advised that I will be taking video and/or pictures from the road or adjacent
properties the business day before or as soon as possible to the above mentioned Violation
Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation including

PRE-APPLICATION REVIEW REQUEST
• The pre-application request is the preliminary review of a land use proposal. Pre-application
reviews are required prior to beginning the application process; however, this review is not
an application.
• Pre-application reviews are held every Friday with the Weld County Departments of Public
Works and the Public Health and Environment. The first, third, and fifth Friday pre-applicant
reviews are held in the Greeley office. The second and fourth are held in the Longmont office
or as scheduled. To be on the pre-submittal agenda, the request and required checklist items
must be received one week prior to the review date.

PARAPHRASED STATEMENT OF RP KRISTIN;
I HAVE A COMPLAINT REGARDING MY NEIGHBORS DOGS BUT I DON'T WANT THEM TO KNOW I
CALLED. I DON'T KNOW HOW MANY DOGS A PERSON CAN OWN AND I THINK THEY HAVE TOO MANY. I
AM CONCERNED ABOUT THEM BECAUSE THEY ARE PITBULLS AND SEEM AGGRESSIVE.THE YARD IS
FENCED BUT THEY ARE NOT PENNED IN AND I LIVE NEXT DOOR, HAVE HORSES AND KIDS AND AM
REALLY WORRIED THAT IF THEY GOT OUT SOMEONE WOULD GET HURT. COULD YOU GO CHECK THIS
OUT PLEASE?
ACTIONS AND OBSERVATIONS;
UPON ARRIVAL AT THIS ADDRESS, I NOTICED 9 PITBULLS IN A KENNEL NEAR THE HOUSE, 2 PITBULLS
AND A SHEPHERD TYPE DOG LOOSE IN THE YARD. THE 3 ANIMALS IN THE YARD WERE VERY
AGGRESSIVE AND CAME AT ME WITH THEIR TEETH BARED AND GROWLING AS I ATTEMPTED TO GET
OUT OF MY VEHICLE.THEY WOULD NOT BACK DOWN AND I COULD NOT SAFELY GET TO THE FRONT
DOOR. I THEN DROVE TO THE BACK SIDE AND WAS ABLE TO PUT A CARD IN THE BACK DOOR,
REQUESTING THEM TO CALL ANIMAL CONTROL REGARDING THIS. THIS RESIDENCE IS OVER THE
LIMIT OF DOGS THEY CAN LEGALLY HAVE ON THEIR PROPERTY SO THIS CASE WAS REFERRED TO
PLANNING AND ZONING.
THIS CASE IS TO BE CLOSED AND ALL INFO WAS FORWARDED TO PLANNING AND ZONING.
