HomeMy WebLinkAbout20083018.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST OSCAR AND DEBRA DE LUNA FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Oscar and Debra De Luna, ZCV #0800195, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 18th day of November, 2008, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation,and WHEREAS, Oscar and Debra De Luna were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until December 18, 2008, to allow adequate time for the property owner's daughter to move and reduce the number of dogs to the allowed amount to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. She said that approximately a month ago someone left a note explained that she would need to get a kennel license in order to have the number of dogs she has. She said she spoke to a lady who was suppose to call her back with that information. She never did. I explained that she probably was speaking with Animal Control, which is who advised me of her violation. I advised her that I would send her the Pre-Application Request form. She would need to fill it out and send it back in so the pre-application meeting could be scheduled. This is the first step. I explained this step was free. COULD YOU GO CHECK THIS OUT PLEASE? ACTIONS AND OBSERVATIONS; UPON ARRIVAL AT THIS ADDRESS, I NOTICED 9 PITBULLS IN A KENNEL NEAR THE HOUSE, 2 PITBULLS AND A SHEPHERD TYPE DOG LOOSE IN THE YARD. THE 3 ANIMALS IN THE YARD WERE VERY AGGRESSIVE AND CAME AT ME WITH THEIR TEETH BARED AND GROWLING AS I ATTEMPTED TO GET OUT OF MY VEHICLE.THEY WOULD NOT BACK DOWN AND I COULD NOT SAFELY GET TO THE FRONT DOOR. I THEN DROVE TO THE BACK SIDE AND WAS ABLE TO PUT A CARD IN THE BACK DOOR, REQUESTING THEM TO CALL ANIMAL CONTROL REGARDING THIS.
