RE: APPROVAL OF RECORDED EXEMPTION NO. 567 - THOMAS J. AND
MARY LEE COUGHLIN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 567 , being the property of Thomas
J. and Mary Lee Coughlin, described as part of the N1 NE', Sec-
tion 22, T1N', R67W of the 6th P.M. , Weld County, Colorado, being
more particularly described in the plat which shall be provided
by the applicant and known as Exhibit "A" , said plat to be re-
corded, does not come within the purview of the definition of the
terms, "subdivision" and "subdivided land", pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Thomas J. and Mary Lee Coughlin be, and
hereby is, exempt from the definition of the terms, "subdivision"
and "subdivided land" .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 18th day of
August, A.D. , 1982.

Re: Recorded Exemption #567
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Thomas 3. and Mary Lee Coughlin for a recorded exemption.
The parcel of land on which this request is being made is described as
the 141/2 NE1, Section 22, TIN, R67W of the 6th P.M., Weld County, Colorado.
The property is located 3.5 miles northwest of Brighton on Weld County
Road 8. The property contains approximately 80 acres of Class IIe
irrigated soil and IIIc nonirrigated soils.
The request is to divide the property into parcels of 77.493 acres and
3.067 acres, more or less. The applicants propose to divide Lot "A" from
the farm because it is separated by the Brantner Ditch, making it difficult
to farm. The Coughlin's will continue the farming operation on Lot "B".
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The request complies with Section 9-2 C. of the Weld County
Subdivision Regulations submission requirements.
2. The request complies with Section 9-2 E. of the Subdivision
Regulations as follows:
- The 80 acres, more or less, under consideration will allow
agricultural and related uses to be the predominant uses.
The use will be compatible with existing and surrounding
agricultural uses. These facts also support the proposal
as being consistent with the intent clause of the Agri-
cultural District.

- The proposal is in compliance with Section 1-3 of the Weld
County Subdivision Regulations and the proposed land division
complies with the Weld County Comprehensive plan; therefore,
the proposed use is consistent with efficient and orderly
development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for
land division.
- The Division of Water Resources has indicated adequate water
service is available for this proposal.
- The proposed lots are not part of a recorded exemption
within the last five (5) years.
- The two lots proposed will have adequate access from Weld
County Road 8.
- The Weld County Health Department has indicated, in a letter
dated June 30, 1982, that both lots will have adequate sewage
capacity.

This is a request for a Recorded Exemption for that
Northwrt Northwesterly
the N1 of the NE1 of Section 22, T1N, R67W
Of the Brantner Ditch. This parcel of, land is cut off D4om
the rest of the land in this parcel and is not irrigated at this
time. Because this parcel of land has a natural boundary we
feel that a homesite is the best use for this land.

Dear Mr. Allison:
We have received the above referenced exemption proposal to separate
3.067 acres from a tract of approximately 80 acres. The applicants propose
a well as the source of water on the smaller parcel. There is apparently an
existing well on the larger parcel. The existing well may be number 109826,
late registered to George Norden. A review of the permit raises questions
about the location of that well, however.
We can make a household use only well for the 3.067 acre tract since
this proposal would involve only one additional well and it represents a first
time exemption. Since we could make a well permit available, we can recom-
mend approval. Plat note, covenant, and other suitable methods of notices
should be employed to make potential purchasers aware that lawn and garden
irrigation and other outside use of water is prohibited.
