Dear Ms. Taylor:
Your agreement for improvements for WCR 39 for stabilization for dust control will not expire
until May 14, 2009.
Mel Everhart, Grader Division Supervisor, would like to keep the option for stabilization for WCR
39 open for the additional year. The County has stabilized WCR 18 between Aristocrat
Ranchettes and WCR 37, directly one mile west of WCR 39 at your location. Although WCR 39
and WCR 18 are not being shown on the 2008 stabilization plan, things may change in a year's
time.
Your request for release of collateral for road stabilization is denied by the Weld County Public
Works Department at this time. You may re-apply for release after the expiration of your
Agreement in 2009.

County Roads 18 and 39
Red Baron Estates is a seven (7) Lot Estate Zone PUD with tvo Agricultural Zoned parcels of
79.71 and 5.36 acres respectively, and is located in the E2 E2 NE4 Section 6, T1 N, and part
SE4 Section 30, and part E2 E2 Section 31, T2N, all in Range 65 West of the ei P.M., Weld
County, Colorado.
Access to the development is via County Road 39, located to the east of the development off of
State Highway 52.
Per the Final Plat Resolution, the applicant entered into a Public Road Maintenance Agreement
for the required improvements to County Road 39up to County Road 18. These improvements
included the full buildout width of County Road 39 and road stabilization for dust control Monies
were escrowed with the sale of each development parcel within the PUD for the proportional
share of maintenance of the County Road
The applicant also entered into a Private Road Maintenance Agreementfor internal roads.
Improvements are guaranteed via an Irrevocable Letter of Credit No. 1407-06 from Valley Bank
and Trust in the amount of 109,593.00 dollars.
The road improvement agreement was prepared by Public Works, reviewed by theCounty
Attorneys office, signed by Ms. Taylor and accepted by the Board of County Commissioners at a
public hearing. The agreement is term limited with a date for review set at May 2009.
The Department of Planning Services defers to the Department of Public Works for the
appropriate response to Ms. Taylor's inquiry given that the inquiry addresses a County
maintained public road.

I am writing on behalf of Platte Valley Airpark and Red Baron Estates regarding road conditions on
WCR 18 and WCR 39.
Enclosed you will find a recap of property taxes paid by both of the above entities. As you can see,the
taxes have increased considerably from 2006. For the year 2007, property owners along the one mile of
road(WCR 39 between WCR 16 and WCR 18) have been charged a total of$60,566.78 from Weld
County for property taxes. I have not completed any research,however I would question whether
there are any other county roads bordered with this substantial tax base that are not at least treated in
some way or possibly even paved.
I realize that Red Baron Estates has a Road Improvements Agreement in place with Weld County to
share in the cost to complete road stabilization for dust control when the subdivision is sold out. The
agreement requires an escrow amount of$3,600 from each of the seven lots as they are sold.
Ultimately the final amount of$25,200 would be combined with a contribution from Weld County to
complete the road improvement. To date, Red Baron Estates has only sold three of the seven lots. The
resistance from buyers always comes down to several factors, unsatisfactory access roads and high
property taxes. At this point,with the increased development and usage of Platte Valley Airport, Red
Baron Estates has a minimal traffic impact on WCR 39.
At this time, I would like to request that Weld County temporarily disregard the Road Improvements
Agreement for Red Baron Estates and consider the inadequate access situation for Platte Valley lot
owners,tenants and patrons. I should also point out here that in addition to the property owners
substantial tax contribution,the airport rental tenants and daily patrons also contribute to the local
economy of Hudson and Fort Lupton with their patronage of retail services.

Improved access for Platte Valley Airport would also require additional development of WCR 18
between WCR 37 and WCR 41. This road section is heavily traveled by trucks,etc., and is continually in
need of grading.
I know that Weld County uses the car count method for determining future road improvements and
budgeting. I also know that WCR 18 and WCR 39 have been slightly under the 200 car minimum
requirement specified by Weld County for road improvement. However, I am hopeful that Weld County
will consider a variance on this requirement and strongly review the necessity for improvements on
WCR 18 and WCR 39 as outlined in this letter.
Finally, I know you are very aware and appreciative of all of the new development that Platte Valley, Red
Baron Estates,the Vintage Aero Flying Museum and Eagles Nest Aviator Homes are bringing to Weld
County,specifically to the Hudson/Fort Lupton areas. Any assistance that you can offer in helping with
our goal for better road access will be greatly appreciated.
