HomeMy WebLinkAbout20081829.tiff 087 RESOLUTION RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT#599-OGLIVY IRRIGATING AND LAND COMPANY,C/O TARH E AND P HOLDINGS, L.P.,AND TEXAS AMERICAN RESOURCES COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated December 28, 1983, the Board did approve the request of Bellwether, Cache and Elwood Oil Companies, c/o Kenneth Lind, 1011 Eleventh Avenue, Greeley, Colorado 80631, for Use by Special Review Permit #599, for Oil and Gas Production Facilities, on the following described real estate, to-wit: Parts of Sections 23, 25, and 26, all in Township 6 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has received a request from Oglivy Irrigating and Land Company, 822 7th Street, Suite 760, Greeley, Colorado 80631, c/o TARH E and P Holdings, L.P., and Texas American Resources Company,410 17th Street,Suite 1610, Denver,Colorado 80202,c/o Winters, Hellerich and Hughes, LLC, 5754 West 11th Street, Suite 101, Greeley, Colorado 80634-4811, to vacate a portion of said Use by Special Review Permit#599, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present,studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said partial vacation, conditional upon the following: 1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant shall submit a revised Partial Vacation Use by Special Review Plat, conforming to Section 23-2-260.D of the Weld County Code. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Use by Special Review Permit#599 be, and hereby is, partially vacated, with the abovementioned condition. There is presently a Special Use Permit application (USR-1628) that was approved by the Board of County Commissioners on March 5, 2008 that encompasses a portion of USR-599. Since USR-599 covers multiple properties,all current property owners within the boundaries of USR-599 were notified of this request for partial vacation. USR Background: USR 599 (a Use by Special Review Permit for Oil and Gas Production Facilities) was approved by the Board of County Commissioners on December 28, 1983. The USR encompasses the SE4 of Section 23, the NE4 of Section 26 and the NW4 of Section 25 of T6N R66W. The Department of Planning Services is in support of this request. The Department of Planning Services recommends the following amendments to the USR-599 partial vacation plat map: 1)Insert a vicinity map showing the boundaries of the USR site prior to this amendment and a vicinity map showing the boundaries of the USR site after this amendment. 2) The Amended Operations Standards approved for USR-599 shall be indicated on the partial vacation plat. 3)The USR-599 partial vacation plat shall meet the remaining requirements outlined under 23-2-260.D of the Weld County Code. This section of the Weld County Code provides that the applicant requesting a decrease in the land mass occupied by a USR must submit a letter requesting the partial vacation and submit a revised map to the Department of Planning Services. Pursuant to Section 23-2-200.G. of the Weld County Code,the applicant is requesting a partial vacation of USR 599. The portion to be vacated is reflected on the USR Vacation Map enclosed herewith and lies within the area marked "Vacated Portion of USR 599" as indicated by the hash marks. This request complies with provisions of Section 23-2-200.G., as this request is required by the Weld County Planning Department and the Board of County Commissioners pursuant to the Resolution approving USR 1628. This request does not create separate parcels and is consistent with the requirements of the Weld County Planning Department and the Resolution Approving USR 1628.
