SUBJECT: Pioneer- Vesting of Zoning and Extension of PUD timeframes The purpose of this memo is to identify for you the justification for entering into a "development agreement"under state and local laws that establish a period of vesting the Pioneer PUD. Under the same format I propose that we address the timing of future entitlements as set forth in the Weld County Code. ts4: nirCS As you know, Section 23-8-60 of the Weld County Code states: g: t srt c� ;c The BOCC may enter into development agreements with landowners provided that 4(4 the Property rights shall be vested for a period exceeding three(3) years where -t o warranted, in light of all relevant circumstances, including but not limited to, the size P.I- and phasing of the development, economic cycles and market conditions. Such development agreements shall be adopted as legislative acts subject to referendum as "- provided for in the Home Rule Charter. The owners of Pioneer wish to avail themselves of the above described development agreement process in order to vest the PUD Zone District, containing the Change of Zone W Plat, land uses and Development Guide for a period of twenty-five (25) years from the date Z q—$-$ of the recordation of the Change of Zone Plat. Pioneer acknowledges that it must comply with all other regulations regarding platting and building in effect at the time each final plat is processed and building permits permitted. This request is based on all of the applicable criteria set forth in Section 23-8-60 of the Code. The Pioneer PUD encompasses 5073.1 acres of unincorporated Weld County and is the largest PUD in Weld County. It is so large that Pioneer is its own Mixed Use Development Designation. Development of the first unit in Pioneer will require the expenditure of Eighty • Million dollars ($80,000,000.00) for water, sewer, roads and other necessary infrastructure to EXHIBIT 2008-0069 Memorandum October 8, 2007 Page Two • serve this MUD and PUD. The extension of these improvements will necessarily be sized to accommodate the full development potential of Pioneer that will take approximately 25 years to achieve full build-out. As development progresses, additional on-site and off-site improvements will be built, requiring additional funding. These improvements will be financed in large part by bonds, sold to investors based on a 25 year projected build-out contained in the approved metropolitan district service plans. Vesting the PUD for the same period of time as the approved finance plan permits a reasonable time horizon for private investment and a measured approach to full build out taking into account phase size and market conditions. By granting the vesting requested by Pioneer, the County is acknowledging the substantial developer and district financing commitments required to bring urban level services to the growing part of southern Weld County, and reaffirm its findings made as part of the earlier service plan approval that development of this area will take many years at significant cost. It is my opinion that should the County desire to extend vested rights protection for the Pioneer PUD, the timing of processing a final plan pursuant to Section 27-8-50 of the Code should be amended to provide consistency with the vesting period. Attached hereto for your review is a first draft of the type of developer agreement envisioned • by Pioneer. I look forward to talking with you shortly about this issue. JER/ Encl. cc: Brad Mueller Chris Paulson • DEVELOPER'S AGREEMENT • THIS AGREEMENT, dated this day of 2007, by and between PIONEER COMMUNITIES, LLC a Colorado limited liability company and HP FARMS, LLC, a Colorado limited liability Company (collectively referred to as "PIONEER") and THE BOARD OF COMMISSIONERS OF WELD COUNTY, a political subdivision of the state of Colorado (the `BOCC"). WHEREAS, PIONEER is the owner of approximately 5,600 acres of real property located within unincorporated Weld County more specifically described in Exhibit A, attached hereto and incorporated herein (the "Property"); and, WHEREAS, PIONEER has applied for and the BOCC has approved a comprehensive plan amendment for the Property designating the Property as residential and agriculture; and, WHEREAS, PIONEER has applied for and the BOCC has approved a Mixed Use Designation, known as the SoutUast Weld Mixed Use Designation for up to 10,000 dwelling units, 200,000 square feet of commercial and Agriculture encompassing the Property; and, WHEREAS, PIONEER has applied for and has had six (6) metropolitan districts • approved by the Weld County District Court to assist in the development of Pioneer. Based on the approved service plans for the Pioneer Districts a twenty-five (25) year build out is presumed with an approved financial plan for infrastructure development of approximately $144,993,20Xfor infrastructure improvements; and, WHEREAS, the BOCC approved a service plan for Resource Colorado Metropolitan District to develop and extend water and wastewater services to other districts including Pioneer at an estimated cost of$ $29,849,400; and, WHEREAS, PIONEER has submitted and received approval of a Sketch Plan in accordance with Article IV of Chapter 27 of the Weld County Code showing 9,455 residential units, agricultural uses and 200,000 square feet of commercial uses; and, WHEREAS, PIONEER has submitted an application for a Change of Zone pursuant to 1\ Article V and VI of Chapter 27of the Weld County Code for the development of 9,455 residential units, agriculture and commercial land uses for approximately 5,073.1 acres, �y ►� more particularly described in Exhibit B, attached to and incorporated herein (the "PUD 1 ' Property"); and, WHEREAS, once approved and recorded Section 27-8-50 of the Weld County Code requires a final plan for all of the PUD Property be completed within three (3) years from the date of the PUD Zone District; and, • WHEREAS, the parties hereto acknowledge that final planning the PUD Property within • the three (3) year requirement is impracticable; and, WHEREAS, the parties acknowledge that prior to the first unit in the first filing of the PUD Property being conveyed to a third party, PIONEER, the Pioneer Metropolitan Districts and Resource Metropolitan District and related entities will expend approximately$80,000,000.00 to bring the necessary utilities to and throughout the first filing; and, WHEREAS, the parties acknowledge that due to the size of the project, the large capital outlay of monies for infrastructure improvements and the long term phased approach to developing the PUD Property, a vesting period for the PUD Zone District is appropriate; and, WHEREAS, the BOCC is authorized under Section 23-8-60 of the Weld County Code to enter into Development Agreements to vest property rights for a period exceeding three years where warranted based on all relevant circumstances, including, but not limited to the size and phasing of the development, economic cycles and market conditions; and, WHEREAS, the BOCC is authorized under Section 24-68-104 (2) of the Colorado Revised Statutes to enter into a development agreement providing for a longer vesting period where circumstances dictate; and, • WHEREAS, the parties desire to set forth their mutual agreement regarding a vesting period for the PUD Zone District. NOW THEREFORE, in reliance on the consideration set forth herein and other good and valuable consideration, the receipt of which is hereby acknowledged, the parties agree as follows: P„�,� 1. The PUD Zone District shall be vested for a period of twenty-five (25) years from the date of recording the Change of Zone Plat. The vesting period is reasonable in light of the size of the project, the economic investment to bring necessary infrastructure to the area, the numerous phases required and the changing market conditions. 2. During the vesting period described above, the County agrees that it shall initiate no change to the land uses, development standards or PUD Change of Zone Plat without the consent of PIONEER. PIONEER shall have the right to undertake and complete the development and use the Property under the terms and conditions f the PUD Zone District. It is understood that Pioneer may apply for amendment to the PUD Zone District during the Vesting Period to modify the uses and standards of the PUD Zone District or to conform to requirements contained within the PUD Zone District Development Standards. Any such modification proposed by • Pioneer shall be in conformance with the amendment procedures outlined • in the Development standards of Pioneer. 3. Pioneer shall abide by all rules, regulations and ordinances of the County applicable to final plans and construction of public improvements as such rules, regulations and ordinances apply at the time. 4. The Development Agreement is authorized by Section 23-8-60 of the Weld County Code and Section 24-68-104 (2) of the Colorado Revised Statutes. 5. Due to the term of the Vesting Period set forth above, the BOCC hereby grants an extension of the time frame for submitting a final plan for the Property set forth in Section 27-8-50, to coincide with the Vesting Period term. 6. This Vesting Period shall run with the land and shall benefit Pioneer and it successors and assigns. 7. By: • • tit t J &N Fo*tee sin j r A UntO t< • RESOLUTION RE: DECLARING INTENT TO CREATETHEWELDCOUNTY PIONEER COMMUNITY LAW ENFORCEMENT AUTHORITY WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado; and WHEREAS,Section 30-11-401,et seq.,C.R.S.,the Law Enforcement Authority Act of 1969, provides the authority to create law enforcement authorities and directs the procedures for establishment thereof, and WHEREAS,certain property owned by H.P. Farms, LLC,and Pioneer Communities, Inc., (the "Property Owner")in southern Weld County,currently has minimal on-site law enforcement protection and is to be developed for urban density,which will exceed the resources available to the Weld County Sheriff, and WHEREAS,a law enforcement authority is intended to provide additional or alternative law enforcement to residents in developments located in unincorporated areas of counties, and • WHEREAS,after discussions between the Weld County Sheriffs Office,the Weld County Attorney's Office,and the Weld County Director of Finance and Administration,the creation of a law enforcement authority is necessary and appropriate in order to provide adequate law enforcement in the Pioneer Subdivision, and WHEREAS,certain owners of property within the boundaries of the proposed Weld County Pioneer Community Law Enforcement Authority have submitted a request for the creation of such Authority to the Board of County Commissioners, and WHEREAS, the area to be included within the law enforcement authority consists of approximately 5,700 acres,and is generally located lying northeasterly of the Town of Hudson,Weld County,Colorado. Though not all the roads are constructed within the entire area,the property is generally bounded by the Weld County road grid on the south by Weld County Road 20,on the north by Weld County Road 28, on the west by Weld County Road 45, and on the east by Weld County Road 55. NOW,THEREFORE,BE IT RESOLVED that the Board of County Commissioners of Weld County,Colorado,hereby declares its intent to create an Authority pursuant to Section 3011-401, et seq., C.R.S.,which shall be known as the Weld County Pioneer Community Law Enforcement Authority (hereinafter referred to as Pioneer Community LEA). The territory of the Pioneer • Community LEA shall generally include the property more particularly described in Exhibit A. He indicated language had been bantered back and forth with Planning and it went to Bruce yesterday in the AM. He did let me know Scott had resigned, but thought that based on emails between Gloria and Scott that they were generally OK with the triggers. There may be some tweaks but nothing radical. We would really like to hear back from the County (Bruce?) on whether we have reached acceptable language for the finding of"willingness and financial capacity to upgrade the street jaystem". If and when this language gets finalized —and I'm optimistic that it will, before the PC hearing —we should all realize that the harder discussion will be on the specifics of the modification of the Table and/or its equivalent. But I would expect that discussion to continue after the PC, but before the BCC. We met with the Fire Chiefs on Wednesday and are preparing a summary of that meeting for them and will share it with you. This is a helpful update. Hopefully they will be at the hearing. The key points are: 1) they will serve the Property - 2) SEWFPD will serve everything east of 49 under an auto aide agreement with Hudson. 3) the permanent station needs to be located north of 22 in the SEW District for the Board to support funding. Pioneer will work with SEW on an appropriate site and will still commit to a land dedication. 4) a written Service plan is premature and the Districts do not want something in writing but would prefer a will serve arrangement that evolves with development. They would like additional information on: 1) phasing 2) Mill levy table modified to show the combined valuation and taxes assessed for their Districts based on the District mill levy plus the additional 2 mills. Also I don't remember if I shared that the School Board did vote to remove opposition to Pioneer. At the Board's request we have an "executive summary letter" being prepared that provides an overview of what Pioneer is providing the District. The Board understood that the Sept 28 letter addressed all the PUD Zone Plat issues. Also a good update. Staff Report comments OPEN ISSUES- 1) We have not heard back from Bruce on the vesting matter which spills into several points in the staff report. (W and X page 14, and DD page 19.) I would not necessarily expect an answer on this before Tuesday. If is it supportable, then we would have to present it to the Board separately anyway, since it is a legislative matter. Inadequate water Farmers in this part of the county have to shut off their wells because there is inadequate water for their crops, but a monstrous community is being considered that will deplete this precious commodity. 2. Fire protection: The addition of thousands of homes and even more people will bring hazards for all of us concerning inadequate fire and paramedic services — especially in • the building phase when no community plan is in place. 3. Traffic issues: Traffic will impact the road conditions, traffic congestion and safety. Will • there be adequate road repair for WCR 49 and who will pay for it? 30,000 more people will cause a nightmare for traffic control and who will patrol this sudden onslaught of people? Who will provide road plowing in the winter— already a problem for the residents that live on this road? 4. Police protection: What are the plans for enforcing the law with 30,000 residents? 5. Road widening: Will the people that live along WCR 49 have their land confiscated to widen the road to accommodate this large number of cars that will come and go all day long? Who is paying for the road widening project? 6. Community size: This community is going to be larger than any of the surrounding communities within 20 miles. Why is this community not being attached to existing towns that already have fire protection, law enforcement, schools, waste water management and disaster plans in place? 7. Schools: Who is paying for the needed addition of schools to educate all these new children? Will the long time rural residents be required to foot the bill for this? 8. Gas and oil wells: This part of Weld County is covered with gas and oil wells. How are • the safety issues and access issues being dealt with when these wells will be surrounded by families unfamiliar with the hazards? The current wells are constantly being serviced. How will they access these wells and who is providing safety when the wells are being drilled or refractured and serviced? 9. Future plans: Will this community add commercial business to their project over time? This could possibly turn into another town that would incorporate, even if that is not the • plan now. 10. The housing market is in such a decline, it is unfathomable why any business would risk millions of dollars on a project that appears to be a financial disaster. Our property was devalued $50,000 this year. If the value of the home is less than the worth, why build it? Although we have been told CDOT, the environmental study, and water supply issues are all onboard with this project, there are still many unanswered questions that need to be addressed, not ignored. We do not want a zone change. No one has said how it will affect us if and when we decide to sell our land. Common sense tells us that this is not the time to tear up land for a project that appears to be"pie in the sky". There are two projects in Keenesburg that have been failures; one commercial and housing, and a housing development in town. The two houses built have had to be leased because they can't sell. The lots for the remaining 21 homes are bare -weeds have taken over-an eyesore. It would appear that the developers haven't made any money on these. We don't want the acreage on Kersy road to be a sandbox if the project starts but is never finished, destroying the land and property values decline. Our second suggestion is on page 33 under section Local Parks;we would like to recommend a section that states Fencing should of a design that allows free passage for wildlife. This will help prevent wildlife from becoming trapped or tangled by fencing. These are our recommendations for changes to the application.
