We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
• 1. The applicant shall file an Air Pollution Emission Notice (A.P.E.N.) with the
Colorado Department of Health and Environment's (CDPHE) Air Pollution Control
Division.
2. A Ground Water Monitoring Plan shall be submitted to the Weld County
Department of Public Health & Environment (WCDPHE)for review and approval.
3. If appropriate, Stormwater Discharge Permit coverage shall be obtained from the
CDPHE Water Quality Control Division.
We recommend that the following requirements be met prior to receiving final approval
of building permits:
1. A concrete secondary containment structure (floor and walls) surrounding each
tank or battery of tanks shall be constructed. The volume retained by the
structure shall be 150% greater than the volume of the largest tank inside this
structure. A registered professional engineer shall design the structure. The
structure shall prevent any release from the tank system from reaching land or
waters outside of the containment area. The operator shall provide evidence
from the engineer to the Weld County Dept. of Public Health and Environment

• (WCDPHE) indicating that the structure has been constructed to meet this
criterion.
2. A detailed design of the "concrete unloading pad" shall be submitted to WCDPHE
for review and approval. The design shall demonstrate how all spilled waste,
stormwater and wash down water will be contained within the receiving area and
concrete sump. The design shall also include the method in which seams will be
sealed to prevent leakage through the pad. A leak detection system shall be
designed and installed beneath the "concrete unloading pad". The "concrete
unloading pad" shall be constructed and operated in accordance with the
approved design.
3. The applicant shall submit evidence to the WCDPHE, Weld County Planning
Services and the Colorado Oil and Gas Conservation Commission (COGCC) that
the facility was constructed in accordance with application materials.
4. A copy of the drilling log shall be submitted to the WCDPHE.
5. An individual sewage disposal system (I.S.D.S.) permit is required for sewage
flow from the proposed operations building. The system must be designed by a
Colorado Registered Professional Engineer and in accordance with Weld County
I.S.D.S. Regulations.
• 6. Solids and sediment will accumulate in the storage tanks. The facility shall
submit a detailed plan to WCDPHE for approval that describes the method of
solids removal, including all on-site handling procedures and disposal. Any
amendments to the approved plan shall be submitted in writing to WCDPHE for
approval.
7. A Detailed Closure Plan shall be submitted to the Weld County Department of
Public Health and Environment and the Colorado Oil and Gas Conservation
Commission. The Closure Plan shall include a description of the manner in
which the well will be plugged and abandoned, as well as specific details
regarding reclamation of the property. No structures or equipment associated
with the facility shall remain on the property following closure.
8. The facility shall post financial assurance with the COGCC. The financial
assurance shall be adequate to cover a third-party closure of the facility,
including the plugging and abandonment of the well, in accordance with industry
standards, and the removal of all structures (including concrete) on the facility.
The site shall be returned to its original grade. In the event the COGCC does not
have the authority to require financial assurance for the entire cost required for
the third-party closure, the facility shall post the remainder of the financial
assurance with Weld County. The facility shall submit evidence, in writing, to the
WCDPHE that the appropriate financial assurance has been obtained.

• We recommend that the following requirements be incorporated into the permit as
development standards:
1. The facility shall be constructed and operated to ensure that contamination of soil
and groundwater does not occur.
2. A manager, knowledgeable in operating an injection well, shall be on site when
the facility is receiving waste.
3. No disposal of waste, other than Class II, as defined by the Environmental
Protection Agency, is permitted. Any changes from the approved Class II use
would require an amendment to this Special Use Permit.
Any wastes generated on the facility shall be disposed of in accordance with the
Colorado Solid Waste Act, Section 30-20-100.5, C.R.S., or other appropriate
rule, regulation or law.
5. This facility shall adhere to the maximum permissible noise level of 70 dBA as
allowed in the industrial Zone as delineated in 25-12-103 C.R.S.
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
• '7, All chemicals must be stored secure, on an impervious surface, and in
accordance with manufacturer's recommendations.
8. The facility shall comply with Colorado Air Quality Control Commission
Regulations and any air permits issued by the CDPHE Air Pollution Control
Division.
9. All liquid wastes received at the facility shall be unloaded on the unloading pad.
The concrete unloading pad shall be cleaned at a frequency that prevents oils
and other wastes from building up on the pad. At a minimum, the pad shall be
pressure washed daily to remove any waste build-up. During winter months, the
facility shall maintain the unloading pad free of ice.
10,`Any analysis of waste shall be forwarded to the WCDPHE, who reserves the right
to require additional, more extensive monitoring at a later date.
11,All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
12.Any petroleum contaminated soils on the facility shall be removed, treated or
disposed of in accordance with all applicable rules and regulations.

• 13.The property owner or operator shall be responsible for complying with all of the
Development Standards. Noncompliance with any of the Development
Standards may be reason for revocation of the Permit by the Weld County Board
of County Commissioners.
14.The facility shall comply with the approved groundwater monitoring plan.
1'5.All storm water, which has come into contact with waste materials on the site,
shall be confined on the site. In the event that storm water is not adequately
controlled on the site, upon written notification from the WCDPHE or CDPHE, a
comprehensive site-wide storm water plan shall be developed and implemented.
The plan must be approved, in writing, prior to implementation by WCDPHE and
CDPHE.
16.All contaminated soils shall be stored on an impervious surface where any
stormwater that comes into contact with the soils would be contained.
17.Adequate drinking water, hand washing, and toilet facilities shall be provided.
1'8.Any individual sewage disposal system (I.S.D.S.) on the property shall be
permitted, installed, maintained and operated in compliance with all provisions of
the Weld County Code, pertaining to I.S.D.S.
• 19.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

SUBJECT: USR-1665, High Plains Disposal, Inc.
The Weld County Public Works Department has reviewed this proposal. This project
falls primarily under the purview of the Use by Special Review Standards, Weld County
Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements
are as follows:
COMMENTS:
The most current road counts for U.S. Highway 34 they are 12,600 AADT for WCR 49 are 4,365
AADT taken in April of 2008, for WCR 47 they are 443 AADT taken in April of 2008, and for
WCR 54 they are 728 AADT taken in April of 2008.
REQUIREMENTS:
• Final Plat:
1. All drawings shall be stamped and signed by a registered professional engineer,
licensed to practice in the state of Colorado.
2. Please include a grading plan for the site.
3. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious
weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the
noxious weeds.
4. The applicant is required to comply with all Colorado Department of Health and
Environment (CDPHE) regulations regarding berming and spill prevention for
materials and liquids stored on site.
5. The applicant is required to comply with all Colorado Oil and Gas Conservation
Commission (COGCC) rules and regulations including drilling pad construction,
storm water controls, and reclamation and must show proof of acquiring a drilling
permit from the COGCC.
6. Please provide a copy of the Underground Injection Control Permit obtained from
the U.S. Environmental Protection Agency (EPA).
7. All reports must be final.
Offsite:
1. Please address and resolve all redlines in the traffic study prior to resubmitting
• for review.
2. The designated haul routes shall be as follows:
a. Trucks coming from the south shall travel northbound on WCR 49 and turn
•
onto WCR 50 westbound. From WCR 50, the trucks will turn onto WCR
47 northbound and then onto WCR 54 eastbound wherein the site shall be
accessed.
b. Trucks coming from the north or the west shall travel westbound on U.S.
Highway 34. From Hwy 34, the trucks will turn onto WCR 47 southbound
and then onto WCR 54 eastbound wherein the site shall be accessed.
c. Trucks coming from the east shall travel via Hwy 34 westbound. From
Hwy 34, the trucks will turn onto WCR 49 southbound and then onto WCR
54 westbound wherein the site shall be accessed.
d. Haul trucks shall exit the site via the proposed access directly onto WCR
54 westbound. From WCR 54, the trucks shall either proceed northbound
onto WCR 47 and then either direction onto Hwy 34; or southbound onto
WCR 47, then eastbound onto WCR 50, and southbound onto WCR 49.
3. The applicant shall pave WCR 50 with asphalt, or as an alternative, recycled
asphalt (rap) from WCR 49 to WCR 47. An offsite long term road maintenance
agreement and an offsite road maintenance agreement with both Exhibits A & B
filled out shall be required.
a. Please include the WCR 50 pavement/rap requirements in the
geotechnical report including recommended pavement thickness.
4. As several of the trucks will be traveling on U.S. Highway 34, please contact
Gloria Hess-Idler, CDOT, at the Greeley office at (970) 350-2148 for any
additional requirements that may be necessary for the intersections of WCR 47
• and WCR 49 with Hwy 34.
5. No parking or staging of commercial vehicles is allowed on County roads.
Access:
1. Road Access Culverts Sec. 8-3-10. Installation of culvert. The owner of the
property shall pay for materials and the cost of installation for new road access
culverts whenever the installation of a culvert is made necessary by the creation
of a new access from private property to a County road, by any alteration of the
natural flow of water across private property by the owner, or for any other
reason created by any owner of private property. The culvert shall be installed
according to the specification of the Department of Public Works as to size and
location in the County rights-of-way or other County property in which such
culverts may be installed. The culvert size will be determined in accordance with
standard engineering practices. The property owner shall be responsible for
cleaning the borrow ditch to the extent required to accommodate the road access
culvert and insuring proper drainage.
2. Intersection sight distance triangles at the development entrance will be required.
All landscaping within the triangles must be less than 3 % feet in height at
maturity, and noted on the final roadway plans.
3. The applicant shall pave the internal access road.
a. An on-site private road maintenance agreement with both Exhibits A & B
filled out shall be required. Collateral will be required for 100% of the
• estimated costs on schedule A.
4. Contact Amy Burry, Utility Coordinator for Weld County Public Works, at (970)
• 304-6496 ext. 3764 for a Right-of-Way permit for any work that may be required
in the right-of-way on WCR 54. A special transport permit will be required for any
oversized or overweight vehicles that may access the site and may be obtained
by contacting Amy as well.
5. Please install a stop sign at the site entrance for all traffic exiting the site. The
current edition of the Manual on Uniform Traffic Control Devices (MUTCD) shall
govern the signing plan.
6. A 60' radius is required for the access onto WCR 54 to accommodate the WB-50
truck traffic per the Geometric Design of Highways and Streets manual
(AASHTO's Green Book) Exhibit 9-24.
Drainage:
1. Please address and resolve all redlines on the Drainage Report and drawings
prior to resubmitting for review.
2. Please include calculations to show that the discharge from the detention ponds
on site does not overflow the borrow ditch.
3. The applicant shall design and install an emergency spillway capable of
conveying the peak 100-year storm discharge draining from the detention pond
outlet per Weld County Addendum Chapter 10 Section 3.3.3. The sizing of this
spillway shall be done in accordance to this standard.
4. Please show elevations of the proposed detention pond as well as the volume for
each pond.

• Prior to the start of any construction, alterations, or change of occupancy;
1 A building permit application must be completed and two complete sets of plans including
engineered foundation plans bearing the wet stamp of a Colorado registered architect or
engineer must be submitted for review. A geotechnical engineering report preformed by a
registered State of Colorado engineer shall be required.
2 A plan review shall be approved and a permit must be issued prior to the start of construction.
3 Setback and offset distances shall be determined by the 2006 International Building Code

Dear Mr. Gathman:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
project or the ability of the water supply plan to satisfy any County regulations or requirements. In
addition,the comments provided herein cannot be used to guarantee a viable water supply
• plan or infrastructure,the issuance of a well permit, or the physical availability of water.
According to the referral information the operation will be served by the Central Weld County
Water District("District"). Our office has no comments regarding the District's ability to serve the
commercial operation.

To Whom It May Concern:
• Our Planning Commission met on August 5, 2008, and reviewed the above mentioned
referral. They find that the Town of Kersey has no conflicts with our interests. However,
the Town has several recommendations as follows: the applicant should work with the
Weld County Weed Division and develop a weed management plan; if traffic increases
and negatively impacts Kersey roads that the applicant enter into a long term road
maintenance and improvement plan with the Town; upon completion of the project, the
site needs to be restored to useful conditions; if the site will be operating 24 hours a day
that exterior lighting be addressed; and that surrounding bridge weight limit requirements
will meet the trucks weighing 40 tons as indicated in the proposal.

I apologize for not getting comments back to you sooner. It appears that their traffic
can be accommodated by the existing street/road network, but based upon their numbers they
are borderlined when it comes to needing permits. If I required, they would probably
argue and might even be successful in that argument. No improvements are necessary at
those intersections, so a permit is probably not necessary. However, if their traffic is
greater than that shown in the study, permits are definitely needed.
Also, they need to be aware that per the US 34 Access Control Plan, CR 47 will be
restricted a 3/4 access in the future.
