RESOLUTION R-2008-35
A RESOLUTION OF THE COUNCIL OF THE CITY OF LONGMONT, COLORADO,
FINDING THAT THE PETITION FOR ANNEXATION OF CERTAIN PARCELS OF LAND
LOCATED IN WELD COUNTY, STATE OF COLORADO KNOWN AS THE UNION
RESERVOIR ANNEXATION NO. 3 (GENERALLY LOCATED WEST OF WELD COUNTY
ROAD 5 AND NORTH OF WELD COUNTY ROAD 26) SUBSTANTIALLY COMPLIES
WITH THE COLORADO REVISED STATUTES SECTION 31-12-107
WHEREAS a petition for annexation of a certain parcel of land as described in the
attached Exhibit A, has been filed by the City of Longmont, through its Mayor, with the
Longmont City Clerk; and
WHEREAS the petition has been referred to the Longmont City Council for a
determination of substantial compliance with the requirements of C.R.S. 31-12-107; and
WHEREAS the City Council has been advised by staff, and has taken official notice of
all maps, records and other information and other materials on file with the City of Longmont,
Colorado, regarding said petition.
WHEREAS, the City Council adopted Resolution R-2008-34, on April 22, 2008,
finding the annexation in substantial compliance with C.R.S. 31-12-107, and setting the matter
for public hearing on June 10, 2008; and
WHEREAS, the City and petitioner desire to revise the legal description of the parcel in
Exhibit A, and the City is now required to adopt a new resolution setting the public hearing;
NOW, THEREFORE, THE COUNCIL OF THE CITY OF LONGMONT,
COLORADO, RESOLVES:
Section 1
The Longmont City Council hereby approves and ratifies the Mayor's or Mayor Pro
Tem's signature on the petition and indicates the City of Longmont's intent, in compliance with
all applicable provisions of the Municipal Annexation Act of 1965, Title 31, Article 12, Part 1,
C.R.S., to annex the land described in the petition.
Section 2
The Longmont City Council hereby finds the annexation petition substantially complies
with the applicable portions of C.R.S. 31-12-107.
Section 3
The City Council shall hold a public hearing on the proposed annexation on June 24,
2008, at 7:00 p.m. in the City Council Chambers, Civic Center Complex, Longmont, Colorado,
to determine if the proposed annexation complies with the C.R.S. 31-12-104 and 105, or such
parts thereof as may be required to establish eligibility for annexations.
Section 4
The City Clerk shall publish a notice of hearing once a week for four successive weeks
before the hearing in a newspaper of general circulation in the area proposed for annexation.
Section 5
The resolution is effective upon adoption.
Section 6
The Council repeals all resolutions or parts of resolutions in conflict with this resolution,
but only to the extent of such inconsistency.

PETITION TO ANNEX TERRITORY TO THE CITY OF LONGMONT
The undersigned, being "Landowner" as defined in C.R.S. § 31-12-103(6), hereby
Petitions the City of Longmont, Colorado, for annexation of the following described real
property and further states:
1. The legal description of the property which the Landowner requests to be annexed is
attached hereto as Exhibit A, hereinafter referred to as the"Property".
2. It is desirable and necessary that the Property be annexed to the City of Longmont.
3. That following requirements of C.R.S. § 31-12-104 exist or have been met:
(a) Not less than one-sixth of the perimeter of the Property is contiguous with the
City of Longmont.
(b) A community of interest exists between the Property area proposed to be annexed
and the City of Longmont. The Property is urban or will be urbanized in the near
future and the Property is capable of being integrated into the City of Longmont.
4. None of the limitations provided in C.R.S. § 31-12-105 are applicable and the
requirements of that statute have been met because:
(a) The annexation of the Property will not result in the Property being divided into
separate parts or parcels under identical ownership;
(b) No land or contiguous parcels of land, except as may be situated entirely within
the outer boundaries of the City of Longmont, held in identical ownership and
comprising 20 acres or more and which, together with improvements, has an
assessed valuation in excess of$200,000.00 for ad valorem tax purposes for the
year next preceding the annexation, is included in this petition without the written
consent of the landowners;
(c) No annexation proceedings have been commenced for annexation of any part of
the Property by any other municipality, with the exception of a portion of Weld
County Road 26, annexation of which is being processed in accordance with
C.R.S. § 31-12-114 and which area is fully described in Exhibit A-1;
(d) The entire width of all streets and alleys to be included within the area annexed
are included;
(e) The annexation of the Property will not result in the detachment of area from any
school district or the attachment of same to another school district;

(f) Annexation by the City of Longmont of the Property will not have the effect or,
and will not result in, the denial of reasonable access to landowners, owners of an
easement, or owners of a franchise adjoining a platted street or alley; and
(g) The annexation of the Property will not have the effect of extending a boundary of
the City of Longmont more than three miles in any direction from any point of the
municipal boundary in the past 12 months.
5. The Landowner comprises the owner in fee of 100 percent of the area of the Property and
comprises 100 percent of the landowners of the Property, exclusive of public streets and alleys.
6. As an express condition of annexation, the owner consents to inclusion into the Northern
Colorado Water Conservancy District (District) and the Municipal Subdistrict (Subdistrict),
Northern Colorado Water Conservancy District pursuant to Section 37-45-136 (3.6), C.R.S. The
owner acknowledges that, upon inclusion into the District and Subdistrict, the owner's property
will be subject to the same mill levies and special assessments as are levied or will be levied on
other similarly situated property in the District and Subdistrict at the time of inclusion of owner's
land. The owner agrees to waive any right to an election which may exist to require an election
pursuant to Article X, Section 20 of the Colorado Constitution before the District and Subdistrict
can impose such mill levies and special assessments as it has the authority to impose. The owner
also agrees to waive, upon inclusion, any right which may exist to a refund pursuant to Article X,
Section 20 of the Colorado Constitution.
7. The Landowner requests that the City of Longmont approve the annexation of the
Property.
8. This Petition is accompanied by four (4) copies of an annexation boundary map in the
form required by C.R.S. § 31-12-107(1)(d) and attached as Exhibit B.

ANNEXATION IMPACT REPORT
CONCERNING THE
Union Reservoir No. 3 Annexation
In Accordance with Section 31-12-108.5 of the Colorado Revised Statutes Annotated.
The City of Longmont is submitting the following annexation impact report to fulfill all
such required action far the above named annexation. This impact report specifically
analyzes the above annexation and identifies what impact it will have on the City of
Longmont and the municipal services that will be provided. This impact report has been
completed at least twenty-five days before the date of the Public Hearing established
pursuant to Section 31-12-108 of the Colorado Annotated Statutes.

Annexation and the City of Longmont
State statutes require that any municipality annexing property must provide "urban level
services" (i.e. water, wastewater, police, recreation, schools, and other services) to those
areas they intend to annex. The City of Longmont recognizes this responsibility and can
successfully provide these services to those areas under consideration by the City. The
City of Longmont has adopted the Longmont Area Comprehensive Plan (LACP) and
Development Regulations that both describe and require future development within the
City to meet standards that will provide for the same level of service to these new areas
as it is currently being provided within the existing City.
Union Reservoir No. 3 Annexation
The property included in these annexations is to be known as the Union Reservoir No. 3
Annexation to the City of Longmont. Applications for annexation and zoning of city
owned property have been submitted. The LACP designates this property's land use as
Open Space. The property is contiguous to the City of Longmont and the total area of
these three annexations is approximately 144 acres. The parcels included in this
annexation are currently farmland and open space.
City Boundaries § 31-12-108.5 (a) (I)
The City's present and proposed boundaries are shown on Map 1 of this Impact Report.
The City of Longmont is currently contiguous to this property to the south. The area
contiguous to the City of Longmont is in excess of the 1/6`h contiguity requirement.
Existing & Proposed Infrastructure § Section 31-12-108.5 (a) (II)
A. Storm Drainage
A master drainage plan shall be prepared for the Property to show how the
developed runoff from the site will be controlled to release only the runoff
historically generated from the Property. The drainage plan shall not alter historic
flows in any manner that would adversely impact upstream or downstream
properties. The master drainage plan shall meet City Drainage Criteria Manual
and City Design Standards and Construction Specifications and be subject to
approval by the City. If any portion of the Property lies within a floodplain as
defined by the Federal Emergency Management Agency ("FEMA"), including
unmapped floodplains, the necessary floodplain studies shall be submitted to
FEMA for approval for any proposed changes to the floodplain designation.
B. Streets
With annexation of open space, no additional traffic generation is anticipated
beyond historic agricultural use and no further roadway development will be
generated. No traffic impact studies would therefore be anticipated for these
annexations. The annexation will include portions of existing Weld County
Roads that will come under the jurisdiction and maintenance responsibility of the
City.

C. Water/Wastewater
Extension of water and sewer mains to the site and to the extreme boundaries of
the development shall be completed in accordance with the Updated Treated
Water Master Plan and the updated Wastewater Master Plan, as amended and
updated.
D. Longmont Power and Communications (LPC)
Extension and relocation of LPC facilities shall be completed in accordance to the
Rates, Rules and Regulations Governing Electric Service.
E. Fire Department
The area being annexed is not within the 5 minute 59 second fire and EMS
response time benchmark. The City of Longmont benchmark is not required to be
met until the property has a preliminary or final plat recorded. City shall petition
the Mountain View Fire Protection District for exclusion to their district upon
annexation to the City of Longmont.
Existing and Proposed Land Uses § Section 31-12-108.5 (a) (III)
The existing land use for the property to be annexed is open space and agricultural. The
property is currently zoned A- Agricultural in Weld County. Upon Annexation the
property will be A- Agricultural. The proposed zoning is in conformance with the
proposed LACP designations of Open Space.
Preannexation Agreements § Section 31-12-108.5 (b)
There will not be an annexation agreement for this property per Land Development Code
requirements for City owned properties.
Site Data § Section 31-12-108.5 (c)
The information below sets forth the plans of the municipality for the provision of
municipal services to the area proposed to be annexed. The information below is a
summary of the existing services being provided to the property within this annexation.
This summary identifies those services as they exist today and how they will be provided
to this area after the annexation. Included in this summary is a statement of how the City
of Longmont will finance this expansion and what the City will require of the property
owner upon development of the property.

Financing of Municipal Service Expansion § Section 31-12-108.5 (d)
The decision to provide urban services (including the extension of utilities) to the
property shall be at the sole discretion of the City. Service extension to the property may
come through the approval of a public improvements agreement or through the City's
construction of improvements through the Capital Improvement Plan and such decision
to extend services will be made according to the policies of the City at the time which
include,but are not limited to, the Longmont Municipal Code and the LACP.
