Dear Mr. Brown; The Department of Planning Services has determined that the asphalt mixing plant can remain on site once the gravel operations have ceased. LaFarge will be required to apply for and be approved by the Board of County Commissioners for a Partial Vacation of 2nd AMUSR-488 in compliance with Section 23- 2-200.G of the Weld County Code. At this time the Department of Planning Services will at a minimum be requiring that the boundaries of 2nd AMUSR-488 continue to comply with Development Standard #26 which states "the asphalt mixing plat shall be located no closer than one-fourth of a mile to any residence on adjoining properties". Lafarge looks forward to continuing our professional relationship with Weld County generally and with your Planning Department specifically. This letter is in regards to the Cott'nwood Pit located on WCR 20 1/2;parcel number 131317000016. This property was originally permitted in 1983 for the operation of a gravel pit. In 1984, this special review was amended to allow for the addition and operation of an asphalt mixing plant. A second amendment was approved in 2001 for the addition of four accessory buildings on the property. Lafarge respectfully requests your verification that the allowed asphalt mixing plant can remain as an independent allowed use once mining activity has ceased. As stated on the 2nd Amendment to the Special Review (Case#488:82:3) "The uses permitted on the hereon described parcel shall be the extraction of sand and gravel and an asphalt mixing plant..." It appears clear that the asphalt mixing plant is described as an independent use and therefore may continue,but we would like a formal interpretation before committing to a substantial capital investment on this property.
