State Engineer 918 10th Street Greeley, CO 80631 Re: 2n° AmUSR-468 -A site specific development plan and an amended special review permit for a mineral resource development facility including oil and gas support and services Dear Mr. Ogle: This referral does not appear to qualify as a "subdivision" as defined in Section 30-28- 101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition,the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure,the issuance of a well permit, or the physical availability of water. • According to the referral information the compressor station will be served by an existing well constructed under well permit no. 122553. The well is permitted for drinking and sanitary use only in an individual commercial business, with outside irrigation limited to one acre or less. The well is permitted to withdraw water from the Laramie Formation, however, upon review of the construction information it was determined that the well is constructed to withdraw water from the Laramie-Fox Hills aquifer. According to item 3.5.7 of the executive summary, the well will be used for the restroom facilities and for the intermittent cleaning of the equipment at the station. The allowed permitted uses for the well do not include the cleaning of the equipment at the station. In addition, as stated above, the well was completed into the wrong source. Therefore, the subject well cannot be used, as currently permitted, to serve the proposed uses at the site. Prior to using the well for the proposed uses, a new well permit that allows water to be withdrawn from the Laramie-Fox Hills aquifer, for commercial use, must be obtained pursuant to C.R.S. 37-90-137(4). This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS AND REQUIREMENTS: WCR 10 is section line. There is presently a 60-foot right-of-way. The road is NOT maintained by Weld County. The applicant shall complete a Nonexclusive License Agreement for the Upgrade and Maintenance of Weld County Right-of-Way. The site is currently existing with the only addition requested being the proposed tower. The site currently has 3 access points off of Weld County Right-of-Way. Tower facilities will comply with all applicable rules and regulations. Access: Existing access will be utilized. No new access points are proposed. Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1 . The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control • Division (APCD), Colorado Department of Health and Environment. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. 2. The applicant shall submit a dust abatement plan for driving and parking areas for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 3. The Environmental Health Services Division was unable to locate a septic permit for the septic system serving the compressor site. The septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. • We recommend that the following requirements be incorporated into the permit as • conditions that must be met prior to operation: 1. A stormwater discharge permit may be required for a development/redevelopment/construction site where a contiguous or non- contiguous land disturbance is greater than or equal to one acre in area. The applicant shall inquire with the Water Quality Control Division (WQCD) of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a stormwater discharge permit. Alternately, the applicant can provide evidence from WQCD that they are not subject to these requirements. We recommend that the following requirements be incorporated into the permit as development standards: 1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. • 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 5. The operation shall comply with all applicable State noise statutes and/or regulations. 6. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. 7. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 2 • 8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 9. A building permit shall be obtained prior to the construction or placement of any gas processing equipment and any communication towers. An electrical permit will be required for any electrical service to equipment. A plot plan shall be submitted when applying for building permits showing all structures with accurate distances between • structures, and from structures to all property lines. 2. A plan review is required for each building for which a building permit is required. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. 3. New construction shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2006 International Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2005 National Electrical Code; 2006 International Fuel Gas Code and Chapter 29 of the Weld County Code. 4. Each structure set on a foundation will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Set back and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements.
