WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , it has been determined by the Board of County Commissioners at a public meeting held on the 9th day of December, 1981 in the Chambers of the Board, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 523 , being the property of Great Northern Investments Co. , described as a parcel of land in the NE4 of Section 21, Township 6 North, Range 67 West of the 6th P.M. , being more particularly described as follows : Attached exhibit "A" is incorporated herein by reference. does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended. The parcel of land under consideration is dcccribed as Pt. NE1, Section 21, T6N, R.67W of the 6th P.M. , Weld County, Colorado. The property is located adjacent to the southeast part of the town of Windsor. The property contains 10.13 acres of Class IIE irrigated and Class IVE non-irrigated soils. The request is to split the property into parcels of 2.944 acres and 7.176 acres. The 2.944 acre parcel will be utilized as a construction supply center. The intended use of the 7.175 acre parcel is an industrial park. This property is located in the Town of Windsor's Comprehensive Planning Area. The existing zoning for the subject property is industrial (3). Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the request be approved for the following reasons: 1. The proposed split conforms with the recorded exemption intent clause and the Weld County Comprehensive Plan. The request is consistent with the Town of Windsor's Comprehensive Plan which identifies the area for future industrial land uses. The proposed uses of the property would be compatible with surrounding land uses. 2. The request complies with the provisions of Section 9-4A of the Weld County Subdivision Regulations. The Town of Windsor has set forth objections to this request. The Town has an existing sewer main within 400 feet of the subject property. The Town will not extend sewer service until the subject property is annexed by the Town. Further, the Planning Services Staff has reviewed the subject parcel for possible illegal parcel divisions. The staff has determined that no illegal divisions has occurred on this subject property. 810609 Board of County Commissioners December 7, 1981 Page 2 The Weld County Health Department was contacted for discussion about the sewer main problem. The Health Department's position is public sewage hook- up should be sought at all costs. It is the Health Departments policy to limit installation of independent sewer system where and whenever possible. However, if public sewer hook-up is not feasible, this policy can be waived in lieu of a another sewage system. The development of a septic system as a sewage disposal facility would limit the size and kind of development that could occur on the property. The applicant would be required to secure a proper septic permit at the time they make application for a building permit. Finally, the Town of Windsor and the applicant are in the process of annexation negotiations. Dear Rod: The Town of Windsor has an existing sewer main in the area of the subject property, however, no sewer hook up will be allowed until the area is annexed by the Town. This , therefore, does not fulfill the require- ments of Section 9-4 A (5) of the Weld County Subdivision Regulations. Furthermore , violations of the above regulations occurred in June 1979 , when the parcel in question was split without following proper procedures. BOX 621 WINDSOR, COLORADO 80550 December 8 , 1981 Weld County Commissioners County of Weld State of Colorado RE: RE523 Great Northern Recorded Exemption. Gentlemen ,and Commissioners : Donald E. Sandoval , Town Administrator, has written to the Planning Services Department express- ing his concern about this exemption. While the Town of Windsor would be happy to see this property occupied by a retail lumber and supply company, such occupancy without annexation to the Town would create an unreasonable burden on the community unless the adjoining streets were improved by the county and a sewer tap was properly obtained. The Town of Windsor, at the request of the property owner, furnished a sewer main to the south boundary of the property in anticipation of annexa- tion of the property to the Town. The property to the west, owned by Great Western is served by a sewer tap obtained years ago when the sugar plant was operating. When the Great Northern property constructed an office and lumberyard on their prop- erty, east of the Great Western Sugar Company prop- erty, a sewer connection was made between the two properties, dumping sewage from Great Northern into the Great Western sewer tap. This connection was made illegally, without the consent or knowledge of the Town of Windsor. The Town of Windsor obtained knowledge of the illegal tap and advised Great Western that their services would be terminated unless the Great North- ern sewer taps situation was resolved. Since that date there have been extended conversations and promises of annexation of the property but it now appears that this matter is not yet resolved, and an illegal sewer tap exists which is being relied 810609 Page 2 upon by Great Northern to meet your requirements for an exemption. If your board approves this exemption, you should be aware of the fact that there is no present legal sewer connection provided by the Town of Windsor to the subject property. With the cooperation of the present landowners , this matter could be easily re- solved. If the property is approved for division and then sold, as anticipated, without resolution of these problems , this situation will present nothing but greater difficulty to the Town of Windsor, Great Western Sugar Company and any subsequent property owner. Unless this property is annexed to the Town of Windsor and unless proper sewer service is provided to this property by the Town, there is little benefit to be gained by the Town from this recorded exemption.
