Gentleman:
On behalf of Connell Resources Inc. Jennifer Torrey has requested a continuance of case USR-1606 to
the January 8th, 2008 Planning Commission date.
The applicant is unable to attend today's hearing as he is out of town attending to a business matter.
This case is currently on the consent agenda however staff was going to request it be removed from the
consent agenda and be heard as there are changes that staff would like to make to the Conditions of
Approval and Development Standards. The applicant also had some concerns regarding the Conditions
of Approval and Development Standards and also was also going to request that the case be pulled from
the consent agenda.
Staff is supportive of the continuance request.

Dear Ms.Hippely:
The Town of Windsor Planning Commission will review the updated referral for USR-1606 at its regular
meeting of December 19,2007.
As can be seen by the enclosed draft realignment of WCR 23, the applicant is cooperating with engineers
from the Weld County Department of Public Works and the Town of Windsor Engineering Department and
it appears as though a realignment that will be beneficial to all parties is in process.
• As can also be seen by the enclosed letters dated October 25, 2007 from Mr. Richard"Ben" Connell to Mr.
Kelly Arnold,Windsor Town Manager and Mr. Scot Lewis,Weld County Department of Public Works,there
are several proposals to the Town and the County that require further discussion before entering into
appropriate agreements. However, given the on-going cooperative efforts that are currently taking place, the
Town does not wish to slow the applicant's Weld County process at this time, but will forward to you the
Planning Commission's recommendation following the December 19'"meeting.
The Town looks forward to continued work with the County and the applicant to resolve all of the respective

c) Not later than seven years from the date of recording of the initials

b) Permit use of the proposed private drive from the existing WCR 23
alignment through the area annexed to Windsor to serve the
equipment maintenance facility until access from the realigned WCR
23 is constructed.
c) Provide domestic water supply service for the current Weld County
USR and the ultimate development of the property. The current
submittal assumes that the North Weld County Water District will
provide the domestic water supply.
d) Permit the septic sewer system included in the Weld County USR to
serve the equipment maintenance facility until annexation of the
property east of the proposed realigned WCR 23 or when the sewer
main has been extended to allow installation of a building sewer
service line, which ever is later.
Please note that as requested by the Town of Windsor we have evaluated
• several conceptual WCR 23 alignments connecting the existing WCR 23
from the south to the proposed WCR 23 section line alignment to the
north diagonally across Connell's property and found that they create
problems with owning, operating and ultimately developing the property
and are therefore not acceptable.

Connell will willingly dedicate to Weld County an 80-foot of right-of-way
centered on the section line to realign WCR 23 through our property.
Alternatively, Connell is also willing to dedicate to Weld County such
additional right-of-way across our current WCR 23 frontage to create a 40'
half right-of-way. In consideration of either dedication, we expect that
Weld County will process the current USR submittal on the agreed upon
schedule and with a staff recommendation of approval and as discussed
above.

Dear Ms.Hippely:
The Windsor Planning Commission previously reviewed the initial version of this referral on May
16, 2007. Since that time, the applicant has been working with Weld County and Windsor staff to
amend the application to address concerns that have been raised. The applicant is asking the Town
• to support its current proposal to locate the maintenance facility improvements outside the Town's
GMA in order to continue with the Weld County process to gain approval of USR-1606 and
construct those improvements as soon as possible and in return the applicant will agree to annex the
property in stages and will continue to work on other issues including, but not limited to, the
realignment of WCR 23.
Upon receiving this recent referral, the Windsor Planning Commission reviewed this subsequent
referral at its regular meeting of January 3, 2008. Since there are ongoing discussions occurring
between Weld County, Windsor and representatives from Connell Resources concerning the
realignment of WCR 23 and between Windsor and representatives from Connell Resources
concerning future annexations of both of Connell Resources' parcels over a phased-in period, at the
January 3, 2008 planning commission meeting, the Windsor Planning Commission voted to
recommend conditional approval of this Use by Special Review, subject to all of the following
conditions continuing to be met.
1. The applicant shall submit an annexation petition and complete application for the property
west of the section line (Weld County Parcel #080723000053) to the Town of Windsor
within 180 days of USR approval by the Board of County Commissioners and shall
complete the annexation within one(1)year of submittal to the Town.

2. The applicant shall submit an annexation petition and complete application for the property
east of the section line (Weld County Parcel #080724000020) to the Town of Windsor
within seven (7) years of USR approval by the Board of County Commissioners and shall
complete the annexation within one (1) year of submittal to the Town. Windsor will serve
the subject properties with water, and it is assumed that when such water service is extended
to Connell it is perpetual. If the annexation east of the section line doesn't happen for any
reason the water service should stay with the property.
3. The applicant shall continue to work with Windsor and Weld County in the design and
dedication of right-of-way for the realignment of the WCR 23.
4. The applicant shall furnish, install and dedicate to Windsor a 16" water supply main running
northward along the proposed WCR 23 realignment from its current termination point to the
north end of the Connell property. It is the intention of the Town that, in accordance with
the Town's over-sizing reimbursement policy, reimbursement for any over-sizing associated
with the 16" water main shall occur within one (1) year of construction acceptance of the
16" water main, subject to (a)the annexation of the property on the west side of the section
line (Weld County Parcel #080723000053) being fully completed, and (b) future
• appropriations and availability of finds.
5. The maintenance facility shall connect to the Town's sanitary sewer system at such time that
the property east of the section line(Weld County Parcel#080724000020)is annexed to the
Town or at such time that the sewer line is extended to within four hundred(400) feet of the
property, whichever occurs first.
6. The applicant shall extend sewer to serve annexation west of the section line and shall not
utilize septic systems for those future uses.
7. All exterior light fixtures shall be "full cutoff' and shall not spill light outside the property
lines; and
8. Westbound trucks leaving the maintenance facility that are traveling on the future private
driveway that will intersect with the existing WCR 23 alignment shall not be allowed to turn
right (north) onto the WCR 23 and only shall be allowed to turn left(south) onto WCR 23,
and the applicant shall be required to post a"no right turn for trucks" sign where the private
driveway intersects with WCR 23, with said sign and sign location being reviewed and
approved by the Windsor Department of Public Works and Engineering prior to installation.
