B. "The applicant shall address the requirements and concerns of the
Weld County Department of Services Landscape referral, dated November
9, 2006. Evidence of such shall be submitted, in writing, to the Weld
County Department of Planning Services."
Section 23-3-250.A.2 Parking. Response:
We feel that all parking issues have been addressed including the
addition of parking blocks at designated parking areas. The existing USR
document states "that this is a private facility with little public contact,
staff will waive the parking requirement. Staff will not require the site to
meet ADA standards."
Section 23-3-250.A.3 Street Access Response:
All lots shall have safe access to an approved public or private street. We
have taken necessary measures which designate the points of ingress
and egress for all residents and customers on this particular site through
clearly labeled signs at each location.
Section 23-3-250.A.4 Required Yards - Setback Response:
All uses are further than the 20ft distance to the existing or proposed
highway or street right-of-way. There are no off-street parking areas to
address. In addition the fencing requirements have been addressed as
there has been the addition of screening and no fences arc greater than
six foot in height.
Section 23-3-250.A.4 - Required Yards - Offset Response:
All uses and/or accessory uses arc located at a distance greater than the
ten foot requirement to the existing lot lines. Again off-street parking
does not apply to this particular situation. Fences located on the
property are no greater than six foot in height.
Section 23-3-250.A.5.A Required Landscaped Areas Response:
We will be planting a dry land pasture mix of wild grass to meet the
fifteen percent landscape requirement once the ground has thawed from
the winter season. We feel that all other requirements under this
particular section have been addressed and approved by Weld County.
Those items included: fencing, lighting, and adjacent property screening.
According to what has bccn previously been recorded in the USR, it has
clearly been stated that the Department of Planning Services will require
no formal Landscape Plan as highlighted in the attached document. We
have also responded that the existing landscaping will meet the
requirements of the Department of Planning Services due to the fact that

we have little to no customer traffic on site.
Section 23-3-250.A.5.B Response:
The portion of the lot which abuts a public or private street right-of-way
shall be landscaped for a distance of ten feet. We are planning on
planting a dry land pasture mix in additional to other flowering plants
once the ground thaws to meet the requirements listed.
Section 23-3-250.A.6 Response:
Areas used for trash collection have been enclosed from public rights-of-
way and all adjacent properties. All trash areas have been enclosed to
ensure that they are protected from wind. All trash areas have also been
enclosed to ensure that the trash contained cannot be disturbed by
wildlife.
Section 23-3-250.A.7 Water Supply Response:
All uses do have an adequate source of potable water. This water is
provided via residential well permit # 169485. This is strictly a domestic
well as it only supplies water to the residential structure located on this
property. There are no water supplies to any other structures on this
property.
Section 23-3-250.A.8 Sewage Disposal Response:
The septic system located on this property is solely for residential use.
The permit for this is septic permit#G19920158. All other structures
located on this property do not require any sewage disposal due to the
fact that they are not plumbed for this use.
Section 23-3-250.A.9 Outside Storage Response:
Any material stored on the property is screened by the required six foot
screening. Storage of this material has been approved by Michelle
Martin.
Section 23-3-350.B Operation Standards Response:
Not applicable.
Section 23-3-250.B-1 Noise Response:
Noise standards have been met in accordance to section 25-12-101
C.R.S.

Regarding Special Review Permit # 1589
Responses to the necessary conditions
C. "The applicant shall submit a Dust Abatement Plan, for review and
approval, to the Environmental Health Services Division of The Weld
County Department of Public Health and Environment. Evidence of such
shall be submitted to the Weld County Department of Planning Services?
Response: Michelle, I spoke with Char Davis on Monday November 26
regarding the dust abatement plan. She was asking what type of surface
material the driveway and parking spaces consisted of due to her
concern of dust produced. I shared with her the driveway and some
parking is concrete with a couple of additional parking spaces being
surfaced with gravel. She accepted this information and asked me to
relay this onto you. She did ask once you receive this if you would mind
sending this information back to her.
A. 9 "Section 23-3-360. F of the Weld County Code addresses the issue
of on-site lighting, including security lighting if applicable, and states
'any lighting... shall be designed, located, and operated in such a
manner as to meet the following standards: sources of light shall be
shielded so that beams or rays of light will not shine directly onto
adjacent properties...".
Response: All of the existing lighting on the property is downcasted and
does not shine into any of the adjacent properties. In addition, there are
no plans for future lighting to be installed.

Response: In regards to item B, we feel that the existing landscaping will
meet the requirements of the Department of Planning Services due to the
fact that we have little to no customer traffic on site.
H. "The applicant shall submit a Waste Handling Plan, for approval, to
the Environmental Health Services Division of the Weld C county
Department of Public Health and Environment. "Evidence of approval
from the Department of Public Health and Environment shall be

submitted to the Department of Planning Services. The plan shall
include, at a minimum, the following:
1) A list of wastes which are expected to be generated on the site (this
should include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on the
site.
3) The waste handler and facility where the waste will be disposed of
(including the facility name, address, and phone number).
Response: After meeting with Rocky Mountain Recycling on. November
19 of 2007, it was determined that there would not be enough waste
produced from the production of our portable buildings to order an on-
site storage container. We agreed to build our own waste storage
container and once necessary transfer any waste to their facility. The
gentleman that you may contact is Dewey Eyrich. The facilities address
is 6510 Brighton Blvd. Commerce City CO 80022. Their phone
number is 303-288-6868.
