Copies of the letters and petitions are included in the attached materials. After examination of the letters and petitions , the prevalent issue appears to be whether or not the Protective convenants of West Ridge Subdivision apply to the property under consideration. The County Attorney's office has advised the Planning Commission that Weld County has no authority to enforce covenants. Kirby: On July 22, 1980 the City of Greeley Planning Commission reviewed the request by Gordon J . Adler to subdivide Lot 6 of Ken-Wil Acres into two lots . At that meeting the Greeley Planning Commission recommended no objections to the request as presented subject to meeting the City requirements for curb, gutter, and sidewalk . Since the July 22, 1980 meeting the Commission has learned that this area is included in the area covered by the restrictive covenants which apply to the Westridge area . Apparently one of the restrictive covenants precludes resubdivision of lots into smaller parcels. The Commission understands that the City or County does not have the ability to enforce such covenants . However, it is the City ' s policy to try to honor covenants and not take actions contrary to those covenants. The Commission discussed this request further at its meeting on August 12 , 1980 and recommended that no action be taken on this request until the problems with the covenants are resolved . Cunliffe: I have been retained by certain residents of the West Ridge subdivision of Weld County, Colorado, to object to the replatting of Lot 6 Ken-Wil Acres subdivision. It is the position of the home owners, copies of their petition are attached, that they are opposed to the sub- dividing of Mr. and Mrs . Adler ' s property. Their concerns are in several areas : 1. The area is predominately medium acreage properties and subdividing a three and a half acre property will tend to destroy the image of the area . 2. There is a protective covenant in which Mr . and Mrs . Adler ' s property is included which I believe was filed on July 23, 1971, which indicates that no lot may be subdivided or resubdivied into any area containing less than two and one half acres of land . We are sensitive to the economic advantages that Mr . and Mrs . Adler would have by allowing the subdivision. We feel that allowing this type of subdivision will further encroach on the property values and style of living of the area, and by allowing one property owner to subdivide will serve as precedent for other property owners to subdivide if they so desire . We would ask the planning commission to not approve a request for the replatting of Lot 6 , Ken-Wil Acres subdivision. West Ridge covenant strictly prohibits lots smaller than 21/2 acres. 2. When Ken Will Acres was originally plotted this lot was designated to canply with West Ridge Covenant. You as a board denied the request of Ken Will Acres to break up this particular lot into lots smaller than 22 acres at that time.
