HomeMy WebLinkAbout20082666.tiff RESOLUTION RE: APPROVE REVISIONS TO OPERATIONS MANUAL, SECTION 6.000, COLORADO WORKS IN WELD COUNTY AND CHILD CARE POLICIES AND PROCEDURES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with Revisions to Section 6.000, Colorado Works in Weld County and Child Care Policies and Procedures, for the Department of Human Services Operations Manual, and WHEREAS, after review, the Board deems it advisable to approve said revisions, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, ex-officio Board of Social Services, that the Revisions to Section 6.000, Colorado Works in Weld County and Child Care Policies and Procedures for the Department of Human Services Operations Manual, be, and hereby are, approved. Griego, Director, Hum ervtc Dep ent i COLORADO RE: Addition to Section 6.000, Colorado Works and Child Care Policies and Procedures, Weld County Department of Human Services Operations Manual Enclosed for Board approval is an addition to Section 6.000, Colorado Works and Child Care Policies and Procedures,Weld County Department of Human Services Operations Manual. This policy was reviewed at the Board's work sessions of June 23,2008, and September 22, 2008. The Department is requesting: 1. An addition of Section 6.007.8, County Diversion Disaster Funds. This policy and procedure specifies eligibility and how Colorado Works or Temporary Assistance for Needy Families funds will be used for a declared disaster designated by the Board of County Commissioners. 2. A revision of Section 6.012.6,Reimbursement Authority from the Department of Employment Services. This policy revision changes the FY 07-08 budget by shifting $2,000 from Overhead to Mileage. The overall budget total will remain at$740,193. 3. An addition of Section 6.014.1, D, and Section 6.014.12, Client Eligibility and Child Care Transition Program. This policy addition expands client eligibility from 185%of poverty to 200% of poverty for purposes of allowing clients to participate in a Child Care Transition Program. 4. An addition of Section 6.014.1,E,Client Eligibility. This policy addition mandates participation of clients of the Child Care Assistance Program to cooperate with child support. Manually written by the supplier 6.007.7 Emergency Assistance Program will provide services to families. 6.007.8 County Diversion Disaster Funds Added 6/08 In the event of a declared emergency by Weld County Government, in conjunction with state and federal government emergency declarations, County Diversion Disaster funds will be made available to eligible Weld County residents. 6.007.81 Eligibility for County Diversion Disaster Funds Added 6/08 The applicant in a declared emergency must: A. Have been a resident of the disaster area; or B. Worked in the disaster area; and C. Experienced a direct financial loss due to the disaster that includes, but is not limited to: 1. Damaged or destroyed real and/or personal property 2. Loss of wages and; D. Must be eligible for all the requirements of Colorado Works Basic Cash Assistance except for the household income requirements; and E. The household income must be less than $75,000 6.007.82 Diversion Assistance under A Declared Emergency Added 6/08 The Department will provide up to $10,000 in assistance to eligible applicants or recipients. The Department will not duplicate assistance of another agency's payment or subsidy. Assistance may be paid to vendors on behalf of the applicant or recipient or directly to the applicants and/or recipients. Types of assistance include, but are not limited to: A. Deductible assistance for: Colorado Works in Weld County and Child Care Policies and Procedures 1. Home insurance 2. Car insurance for all applicants or recipients who are employed, disabled, caring for a disabled family member and/or students 3. Rental insurance 4. Self-employment property insurance B. Clothing assistance of up to $500 per person C. Food assistance. If not eligible for Food Stamps, applicants would receive the full allotment, which is equivalent to the food allotment provided to Food Stamps eligible applicants or recipients. D. Fuel assistance of up to $250 per household E. Uninsured furniture assistance of up to $1,500 F. Uninsured vehicle assistance up to the Kelly Blue Book Private Party Value before damages due to the disaster G. Up to three months of rental assistance, of which includes deposit, first and last months rent H. Mortgage assistance for up to three months if there is a loss of employment as a direct result of the disaster I. Other miscellaneous household items of up to $500 per household J. Motel assistance for up to two weeks K. Car rental assistance while the primary vehicle is being repaired L. Other miscellaneous items on a case by case basis and approved by the Assistance Payments Administrator M. Counseling or mental health services not covered by Medicaid or other means. 6.007.83 Verification Requirements Added 6/08 The"State Declared Disaster"special indicator will be used until August 31, 2008. This special indicator waives all verification requirements for Colorado Works and it will be used on a case by case basis with collateral contacts being made where appropriate. This special indicator should only be used when the applicant's or recipient's declared that the home and/or vehicle that were destroyed had the verification documents in them. Colorado Works in Weld County and Child Care Policies and Procedures Receipts are required on all items under Section 6.007.82 except for deductibles, items under$500 and when purchases are questionable. If receipts are not returned as requested, recovery of the funds will be required for funds not accounted for by receipts. 6.007.84 Registration with Employment Services Added 6/08 Applicants for County Diversion Disaster Funds are encouraged to register with Employment Services if unemployed, underemployed or lost a job due to the disaster. 6.007.85 Waiver of Diversion Committee under A Declared Emergency Added 6/08 The Division Committee is waived for diversion payments made to applicants under a declared emergency. Oversight of the diversion payments will be provided through Department supervisory review and approval before issuance of diversions occurs. 6.007.86 Other Assistance under a Declared Emergency Added 6/08 For applicants or recipients who declare to be eligible for assistance under Section 6.007.8, other assistance may be provided directly after the disaster occurred and up to two weeks after the date of disaster. Other assistance includes: A. Grocery store gift card assistance B. Food box vouchers C. Motel assistance 6.008 Diversion Committee, Payment and IRC Processing Revised 10/06 6.008.11 Diversion Committee The purpose of the Diversion Committee is to determine whether or not an applicant or current basic cash assistance recipient may be eligible for a state diversion, a county diversion, up to six month "lump sum"basic cash assistance payment and/or supportive services that will keep the family unit in any one or more of the following: A. Assisting in keeping the family unit's structure together. B. Assisting in keeping the member(s) of the family unit employed. C. Assisting any member(s) of the family unit to become job ready. 6.008.12 Diversion or Supportive Services Determination The determination will be made by examining information which includes, but not limited to the following: A. The client's application with supporting documentation. Colorado Works in Weld County and Child Care Policies and Procedures 6.012.6 Reimbursement Authority from the Department to Employment Services Revised 7/1/98 Revised 9/99 The Department will remit to Employment Services an amount not to exceed$740,193.38 Revised 10/00 for services provided from July 1, 2007 through June 30, 2008. Employment Services Revised 9/01 will bill the Department for services provided as described in Section 6.012.4 of the Revised 5/02 Department's Operations Manual and will not seek additional reimbursement for these Revised 8/03 same services directly from the Colorado Department of Human Services. Colorado Child Care Assistance Program (CCCAP): A program of the State Division of Child Care which provides child care subsidies to families in the following programs: Low-Income, Colorado Works and Special Circumstance. B. Low-Income Program: A child care component within the Colorado Child Care Assistance Program that targets parents who are working and not participants in the Colorado Works Program. C. County Diversion Child Care Assistance for Working Families as outlined under Section 6.009.2: A child care component for working families who may be eligible for child care assistance funds through the County Diversion Program of the Colorado Works Program. 6.014.1 Client Eligibility Revised 9/99 Revised 3/01 A. Effective March I, 2007, families whose income does not exceed 185% of Revised 11/02 poverty level will be eligible for child care under the Colorado Works in Weld Revised 3/07 County Program. B. Families who meet eligibility requirements of Section 3.904 of the Colorado Department of Human Services, Staff Manual Volume 3. C. Families who meet eligibility under the Low Income Program under the Colorado Child Care Assistance Program and are authorized to receive Colorado Works Program funds under Section 6.009.2 of the Colorado Works in Weld County Operations Manual. Added 6/08 D. Effective February 1, 2008, families who are on the Low Income Program under the Colorado Child Care Assistance Program and exceed the 185% of poverty level, but do not exceed 200%of the poverty level will remain on the program for an additional six months as long as all of the other eligibility requirements are met and families do not exceed 200%during the six month period of time. This is called Child Care Assistance Transition Program, as defined under Section 6.014.12. Added 6/08 E. Effective July 1, 2008, as part of the eligibility criteria for the Low Income Program under Colorado Child Care Assistance Program (CCCAP) in Weld County, applicants and recipients must cooperate with Child Support Enforcement (CSE) by providing verifiable information about the absent parent. However, individual circumstances may warrant the applicant and recipient be given the opportunity to apply for a"good cause"for nonparticipation with Child Support Enforcement. Good cause criteria can be found in Section 3.919.1 of the Colorado Department of Human Services, Staff Manual Volume 3. Colorado Works in Weld County and Child Care Policies and Procedures 6.014.11 Eligibility Determination for Child Care under the Low Income Program Under Added 3/01 the Colorado Child Care Assistance Program and the Colorado Works County Diversion Program. A. Each applicant and recipient will complete the necessary State applications to determine eligibility for the Low Income Program and the County Diversion Program. B. Each applicant and recipient will complete an additional Individual Assessment (Exhibit L) and an Individual Responsibility Contract(Exhibit M)for the Low Income Child Care Program in order to be in compliance with Colorado Works eligibility requirements. 6.014.12 Child Care Assistance Transition Program Added 6/08 A. Families who are on transitioning from Child Care Assistance whose income drops under 185% of the poverty level during this period of time will be taken off of TCCAP. Families will then be eligible for an additional six months of TCCAP under the Child Care Assistance Transition Program if their income exceeds 185% of the poverty level, but does not exceed 200% of the poverty level. B. Families will not be eligible TCCAP if there is an intentional program violation during the current eligibility period. C.
