RESOURCES WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 3rd day of October, 1984 , at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the application of R.A. Resources, P .O. Box 2475 , Greeley, Colorado 80632 , for a Use by Special Review for oil and gas pro- duction facilities in a Residential One Zone District on the following described real estate, to-wit: NE4j Section 32 , and SW4 , Section 33 , all in Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance . 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4. 2 of the Weld County Zoning Ordinance as follows: a. All mineral resources are fixed in location. The mineral extraction industry is, therefore , re- stricted in its operations to those areas where the resources lay. The subject site is zoned Residential-One (R-1) , but the site is not platted for residential development. The Comprehensive Plan policies encourage mineral extraction prior to residential development. Residential develop- ment on the subject site could reduce the feasi- bility of ever developing the minerals in question. The proposal is allowed as a Use by Special Re- view in a Residential Zone District. c. The attached Operation Standards will make the proposal compatible with existing and future de- velopment of the surrounding area as permitted by the existing zoning and with future develop- ment as projected by the Comprehensive Plan of the City of Greeley. d. The Greeley Planning Commission recommended no objections at its meeting on August 29 , 1984 . The concerns of the Greeley Planning Commission are addressed in the Operation Standards and additional comments . e. Use by Special Review Operation and Design Stand- ards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application for a Use by Special Review for oil and gas production facilities in a Residential One Zone District on the hereinabove described parcel of land be, and hereby is , granted subject to the follow- ing conditions: 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . The prescribed Use by Special Review activity shall not occur nor shall any building or electrical per- mits be issued on the subject property until the Use by Special Review plat has been delivered to the De- partment of Planning Services Office and the plat has been recorded in the office of the Weld County Clerk and Recorder . 3 . Prior to recording the Use by Special Review plat and starting the prescribed use, the operator shall submit a copy of a policy of insurance in the amount of five hundred thousand dollars ($500 , 000 ) insuring the ap- plicant and the County against all claims or causes of action made against either or both the applicant and the County for damages to persons or property arising out of the drilling, maintenance, production or other work done with respect to such proposed oil or gas Page 3 RE: USR - R.A. RESOURCES well . Such policies shall be written by a company authorized to do business in the State of Colorado. Evidence of the insurance policy shall be filed with the Department of Planning Services . In case the insurance policy required shall lapse or become void for any reason whatsoever, the Use by Special Review Permit shall cease to exist until a new insurance policy shall be provided and filed with the Department of Planning Services . All well acti- vity shall be shut-down and all operations and produc- tion thereof shall be suspended and discontinued, con- sistent with safety consideration, until the operator provides evidence of insurance in the prescribed amount. The permitted use shall be oil and gas production facilities as described in the submitted application materials, and as located on the Use by Special Review plat. 2. The drilling and producing of the wells shall comply with the City of Greeley's Ordinance pertaining to oil and gas development. 3. All tank batteries shall be designed to meet the following standards: The tank battery cluster shall be bermed to contain the greatest amount of liquid that can be released from the largest tank, assuming a full tank. - A six (6) foot chain link fence with three (3) strand barbed wire top shall enclose the tank battery cluster. 4. All production equipment fixed at the site with a source of ignition, including heater/treator and separators, shall be placed a minimum of seventy-five (75) feet from the well head and tank battery cluster. The well head shall be a minimum of seventy-five (75) feet from the tank battery cluster. 5. The applicant shall comply with all Eaton Fire Protection District requirements. 6. Prior to start-up of the activity, the operator shall provide the Eaton Fire Protection District a list of four (4) names, phone numbers and addresses of responsible parties it can contact in case of an emergency. 7. Smoking shall not be permitted at any well location or tank battery location at any time, and signs indicating such prohibition shall be placed on the well site and at the tank battery location. 8. Fire extinguishers shall be maintained on the well site at all times during drilling and production. 9. Prior to start up of the activity, a metal sign shall be placed on the property indicating the name and telephone number of the person(s) to contact in the event of an emergency. 10. All land within twenty-five (25) feet of any oil or gas tank containing flammable or combustible materials, or other appurtenant well production equipment shall be kept free of dry weeds, grass, or rubbish. 11. The applicant shall comply with the Drilling and Completion Policies of the Oil and Gas Conservation Commission dated March 19, 1984, including but not limited to the equipping of the bradenhead access to the annulus between the production and surface casing with a needle valve and gauge fittings to permit the observation of pressure. The Weld County Health Department may accompany inspectors of the Colorado Oil and Gas Conservation Commission who are implementing the March 19, 1984, Policy as to the well permitted hereby. 12. Brine water produced at the site during oil and gas production shall be disposed of by formation injection or disposal into a commercial brine disposal site. 13. Drilling muds can be used as an agricultural enhancement. The drilling muds MUST be applied and disked into sandy soils with the landowners consent. 14. Upon cessation of the proposed use, the oil and gas production facilities shall be removed and the land shall be reclaimed to its prior use. 15. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 16. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 17. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 18. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. 19. The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 20. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. HEARING CERTIFICATION DOCKET no. 84-59 RE: USE BY SPELIAL REVIEW, OIL AND GAS PRODUCTION FACILITIES IN A RESIDENTIAL ONE ZONE DISTRICT - R.A. RESOURCES A public hearing was conducted on October 3 , 1984, at 2:00 P.M. , with the following present: Commissioner Norman Carlson, Chairman - Excused Commissioner Jacqueline Johnson, Pro-Tem Commissioner Gene Brantner Commissioner Chuck Carlson- Excused Commissioner John Martin Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Bruce Barker Planning Department Representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated September 12, 1984, and duly published September 20, 1984, in the La Salle Leader, a public hearing was con- ducted to consider the application of R.A. Resources for a Use by Special Review for oil and gas production facilities in a Residential One Zone District. Bruce Barker, Assistant County Attorney, read this application into the record. Rod Allison, Planning Department representative, read the favorable recommendation of the Planning Commission, stating that Condition 3 needs to be amended to read, "Prior to recording the Use by Special Review plat and starting the prescribed use.,," rather than "Prior to scheduling a meeting before the Board of County Com- missioners,, ;' Mr. Allison stated that 20 Operation Standards have been recommended in conjunction with this Use by Special Review application. Keith Abbott, vice- president of R.A. Resources, came forward. He stated that they are now insured, with proof of insurance being in the mail. He also informed the Board that they will need to make a slight change in the location of the well to be located in Section 33 due to the landowner's lease agreement. Following discussion, Can- missioner Brantner moved to approve this Use by Special Review for R.A. Resources, with Condition 3 amended as discussed, and included the Operation Standards as recommended. ADDENDUM Attached to and made a part of that certain application for Use By Special Review dated July 26, 1984 submitted by R A Resources, Inc. The purpose of this application is to obtain approval to drill and produce oil and gas from four drill sites. Two sites will be located in the NE1/4 of Section 32 and two sites will be located in the SW1/4 of Section 33 (refer to map) . This proposal is consistent with the Weld County Comprehensive Plan in that a very small amount of acreage (i.e. 1 acre per well ) will actually be taken out of agriculture production. Even though this District has been zoned R-1, it is basically Agriculture and industry land. All well sites will be at least 500 feet from the nearest dwelling unit. All Agriculture land will be preserved as much as possible and the surface owner of the actual drill sites will be reimbursed for all losses incurred resulting from oil and gas production. All requirements pertaining to oil and gas drilling and production will be complied with. Safety will be our prime concern. Equipment and structures at the well site will consist of one (1 ) 400 barrel oil holding tank, one (1 ) 100 barrel water holding tank, one (1) horizontal separator, one (1) meter house, and the well-head valve. The highest structure will not exceed 20 feet. All distance requirements will be complied with. Structures and equipment will be painted with company colors (white with red trim) , and a fence will be erected around the battery site. A berm will be built around the two tanks and will be of sufficient height and strength to contain liquids in the tanks in the event of a leak, assuming both tanks are full. Upon the abandonment of the well the hole will be plugged in accordance with the Colorado Oil and Gas Conservation Commission regulations, and the abandoned well site will be restored to a condition substantially similar to the original contours and condition or better. Vehicular traffic into the site will be minimal and will consist of daily inspections made by employees in pick-up trucks and approximately once a week a tanker truck will go into the site on the access road to load oil from the oil holding tank. Any water produced from the well in conjunction with the oil and gas produced will be separated and held in the water holding tank. Tank batterys will be located 100 feet from the well head and the well site is more than 300 feet from the nearest structure. R A Resources will post signs at the site listing four phone numbers to call in case of emergency as well as giving the legal description and name of the well. Our wells will be in compliance with both the Western Hills Fire Department and the Eaton Fire District. "No Smoking" signs will be posted. In conclusion, we will comply with all relevant ordinances, both local and state. We will work in conjunction with the landowner in order to minimize damage to agriculture lands. The natural gas from these wells will be sold to Greeley Gas Company for local use. A-1 COMPLETION PRACTICES IN THE NORTHERN ) PORTION OF THE DENVER BASIN FRONT ) ORDER NO. A-1-2 RANGE CORRIDOR REPORT OF THE COMMISSION This cause came on for hearing before the Commission on July 16, 1984 at 9 : 00 a.m. , in Room 110 , State Centennial Building , Denver , Colorado, after giving Notice of Hearing as required by law, on the Commission ' s own motion to consider the provisions of Order No. A-1-1 , ordered May 21, 1984 , as part of the Rules and Regulations of the Commission. FINDINGS The Commission finds as follows : 1. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law. 2. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order . 3 . Based on the status of investigations currently being conducted n the area, it may be necessary from time to time to redefine the area and modify some of the requirements as provided by Order No. A-i-1 . Such modifications are easier handled under procedures of orders rather than part of the rules and regulations. Therefore, the requirements for drilling and completion practices of oil and gas wells in an area in the northern portion of the Denver Basin Front Range Corridor should remain as an order of the Commission. 4 . The following order , as modified , sets requirements for the drilling and completion of oil and gas wells which should assist in the further protection of the environment and prevention of pollution. ORDER NOW, THEREFORE, IT IS ORDERED, that the following rules and regulations shall apply hereafter to wells drilled, completed , or recompleted in the area extending from and including Township 1 North to and including Township 12 North and west from and including Range 59 West to and including Range 70 West, 6th P.M. , unless otherwise indicated below: Rule 1. Surface Casing . A minimum of two hundred ( 200) feet of surface casing shall be run. In those areas where the base of the Fox Hills aquifer is five hundred (500) feet deep or less, surface casing shall be set at least fifty (50) feet below the base of the aquifer. In those areas where the base of the Fox Hills aquifer is at a depth in excess of five hundred (500) feet, the operator may select between the options provided in Rule 317 (h) , (k) and (i) , formerly (c) (d) and (k) of the general rules and regulations of the Commission; however, such operation shall result in cement from fifty (50) feet below the base of the Fox Hills aquifer across all aquifers above it. Cement shall be circulated to the surface or one hundred ( 100) feet into the surface casing if stage , cementing is selected and allowed to set a minimum of eight (8) hours prior to commencing drilling operations (Note : Logs of wells in the vicinity or Hydrologic Atlas No. 650 of the U.S. Geological Survey may be reviewed for estimating the depth to the base of the Fox Hills aquifer) . Rule 2. Requirements After Fracing - Upon completion of the frac operation the operator shall furnish the Commission with a copy of the bond log , the frac charts showing pressure and time, as well as a detailed description of the work program. A copy of the service company job summary may be submitted in lieu of the work program. IT IS FURTHER ORDERED, that the following rules and regulations shall apply to those wells drilled , completed or recompleted in the area from Township 4 thru 7 North and Range 64 thru the E1/2 of 68 West, inclusive , unless otherwise waived by the Director . Rule 3. Production Casing . After thorough circulation of a hole , cement shall be pumped behind the production casing as provided for in Rule 317 (h) , formerly (d) , to a height in the annulus sufficient to result in a good bond extending at least 300 feet above the top of the Niobrara formation. Rule 4 . Intermediate Stage Cementing . (a) All wells hereafter drilled within five hundred (500) feet of a residential area with an existing or _ platted density of two (2) acres per dwelling or greater; . within five hundred (500) feet of a dwelling ; or , within five hundred ( 500) feet of a building of public assembly shall be stage cemented between the production casing and the drilled hole from a depth of three thousand feet (3 , 000) or fifty (50) feet below the sandstone encountered at a depth of approximately two thousand seven hundred fifty (2 , 750) feet in the vicinity of the town of La Salle to the surface of the ground, or at least one hundred (100) feet into the surface casing . (b) In areas other than defined in (a) above, these sands need not be squeezed unless pressure in the annulus between the surface and production casing develops as determined in paragraph 6 below. Preparation for the possible squeezing may be by the following option.. . (1) A sliding sleeve may be placed to allow cementing across the Sussex-Shannon formation and those potential water or gas sands at approximately 1100 feet and 2700 feet. (2) If no sliding sleeve is placed as provided for in (1) , the operator assumes the responsibility for perforating and squeezing in the event pressure develops in the annulus between the surface and production casing . Rule 5. Requirements Before Fracing - Before any operator fracs a well for production in an area as defined in above, he must submit a Form 4, Sundry Notice, indicating his intention to frac, setting forth the interval to be fraced, the method of fracing, a detailed account of the work to be performed, and the name of the contractor doing the work . The Commission shall be advised of the height of cement properly bonded above the zone to be fraced . Approval of procedures must be obtained prior to undertaking such work, but the Commission shall endeavor to respond within 24 hours of receipt of such notice of intention to frac. Cement placed behind the production casing in accord with Rule 3 shall be allowed to set a minimum of forty-eight (48) hours prior to the undertaking of any frac operation. Verbal approval may be given, but must be confirmed in writing.Rule . etion rements - Upon of any well for production and oonplall wells ulpresently completed, the completion shall equip the bradenhead access to the annulus between the production and surface casing with a needle valve and fittings to allow for a pressure reading . Following release of any pressure developed during • - 2 - (A-1-2) completion operations and at least 24 hours thereafter , the operator shall observe the pressure and every 24 hours thereafter for a period of 96 hours and shall record the date, time and pressure. In the event that the pressure exceeds 150 psia the operator shall immediately contact the Commission and prepare a remedial plan, which plan may provide for cement squeezing of the annulus as soon as practicable. A copy of the readings for the first 96 hours shall be submitted to the Commission. If no pressure in excess of 150 psia is noticed following initial bleeding of this annulus after completion and for a period of 96 hours, the operator shall observe the pressure every three months, and maintain such records in their office for a period of three (3) years. These records shall be submitted to the Commission upon request. Rule 7 . Workovers - Prior to undertaking any workover which involves the pulling of tubing from a well located in an area as defined in 4 (a) above, the operator or contractor shall contact the Commission by submitting a Sundry Notice Form 4 , and shall indicate thereon the name of the operator and contractor , the location of the well with a detailed description of the work to be done and the date on which the work is to commence . Verbal approval may be given, but must be confirmed in writing . Rule 8. Blow-out Preventors - Blow-out preventors and kill line or lines shall be installed prior to commencement of any operation to remove tubing from any well completed in the Niobrara, Codell or "J" Sand formations unless waived by the Director upon a showing that no danger from blow-out exists. All blow-out equipment must be in good working order and operated once each 24 hours. Timing of Operations - The cooperation of the various operators and contractors is solicited in timing work events to allow maximum opportunity for observance of work procedures by Commission personnel.
