Dear Mr. Gathman:
This letter is to confirm that notice has been received by the Union Pacific Railroad Company("Railroad")
regarding the Public Hearing before the Weld County Planning Commission on Tuesday,August 5,2008,
at 1:30 p.m.in the Hearing Room at the Weld County Planning Department located at 918 10th Street in
Greeley,Colorado.
The Hearing is for the review of a request for an Amended Site Specific Development Plan and Special
• Review Permit for a business permitted as a use by right or an accessory use in the Industrial Zone District
(the addition of a railroad spur adjacent to the existing railroad car loading area for recyclable materials
from Andersen's Sales and Salvage Yard)in the A(agriculture)Zone District on a parcel of land described
as a part of the E1/2 of Section 29,T6N,R65W of the 6th P.M.,Weld County,Colorado.
It is understood that Colorado Revised Statutes require a minimum thirty(30)day notice period for all
mineral owners and lessees prior to the Public Hearing. Being that the Railroad is the sole owner of the
mineral rights to the property covered under Case Number AMUSR-1501 ("Property")and that there are no
existing mineral leases affecting the Property,this letter will serve as the Railroad's request to the County
to waive this thirty(30)day notification.
