The Weld County Health Department has reviewed this proposal. The proposed amendment to the Avery
Acres PUD is to add two additional residential lots, north of existing Lot 1, and to vacate that portion of
existing Outlot A, south of Avery Drive. The proposed residential lots will be 3.36 and 3.35 acres in size
and will be served by North Weld County Water District and individual sewage disposal systems. Based on
the acreage of the development(42.31 acres)and re-evaluating the density for two additional lots, the
overall density is one septic system per 6.04 acres which meets current Department policy.
The Department recommends approval with the following conditions:
1. Water service shall be obtained from North Weld County Water District
2. This subdivision is in rural Weld County and is not served by a municipal sanitary sewer
system. Sewage disposal shall be by septic systems designed in accordance with the
regulations of the Colorado Department of Public Health and Environment, Water Quality
Control Division and the Weld County Code in effect at the time of construction, repair,
replacement, or modification of the system.
• 3. A stormwater discharge permit may be required for a development/redevelopment
/construction site where a contiguous or non-contiguous land disturbance is greater than or
equal to one acre in area. Contact the Water Quality Control Division of the Colorado
Department of Public Health and the Environment at www.cdphe.state.co.us/wq/PermitsUnit
for more information.
4. During development of the site, all land disturbances shall be conducted so that nuisance
conditions are not created. If dust emissions create nuisance conditions, at the request of the
Weld County Health Department, a fugitive dust control plan must be submitted.
5. In accordance with the Regulations of the Colorado Air Quality Control Commission any
development that disturbs more than 5 acres of land must incorporate all available and
practical methods that are technologically feasible and economically reasonable in order to
minimize dust emissions.
6. If land development creates more than a 25-acre contiguous disturbance,or exceeds 6 months
in duration, the responsible party shall prepare a fugitive dust control plan, submit an air
pollution emissions notice, and apply for a permit from the Colorado Department of Public
Health and Environment.
7. "Weld County's Right to Farm"as provided in Appendix 22-E of the Weld County Code shall be
placed on any recorded plat.
The following comment was recorded on the Avery Acres Change of Zone plat and is still applicable:
1. Lot owners should be informed that a crop dusting facility is located directly north of this PUD. It is
legally permitted through Use by Special Review Permit#814 and is eligible to apply for expansion.

1) The applicant shall provide construction plans for PW review of the proposed entrance
road off CR 43 through the cul-de-sac. These plans shall show the plan and profile, sign
placement on the newly proposed roadway and proposed cross section of the proposed
roadway.
2) The applicant shall show on the plans how the existing irrigation ditch within the CR
72 dedicated right of way will be moved, replaced or eliminated for the new roadway to be
constructed.
3) The applicant shall complete a Nonexclusive License Agreement for the Upgrade and
Maintenance of Weld County 72 Right-of-Way. This agreement also requires signs to be
placed at the county road intersection.

Sorry to keep bothering you but I need to finalize my 2nd AMPF-496 recommendation and get
it over to the Clerk to the Board Office today. Do you have any referral comments for this
case? I already added a condition that the applicant shall address Department of Public
Works comments dated May 7, 2008.

Dear Mr. Gathman,
We have reviewed the above referenced proposal to subdivide a 189.53-acre parcel into three
portions, one of which will be a single-family residential lot and the two remaining will be for agricultural crop
production. A Water Supply Information Summary Sheet was not included in the referral material and no
estimates of water requirements were provided.
The proposed water supply is listed as the North Weld County Water District (District) which provides
service to the residential lots of the Avery Acres development. However a letter of commitment for service
from the District for the one residential lot of this project was not included in the referral material. Based on
• current records on file in this office and the draft water service agreement, the District will typically furnish
70% of an acre-foot (228,000 gallons) of water per tap per annual water year if the allotment for the
Colorado-Big Thompson (CBT) project water, as determined by the Northern Colorado Water Conservancy
District, is 50% or greater. The District will restrict the delivery as necessary when the CBT allotment is less
than 50%. Based upon information from September 2005, the District currently has an adequate
uncommitted water supply to provide the residential water associated with this project.
Pursuant to Section 30-28-136(1)(h)(II), C.R.S., it is our opinion that with the District as the water
supplier, the proposed water supply for the residential lot may be provided without causing material injury to
existing water rights, and the supply is expected to be adequate, provided the developer obtain a letter of
commitment for service from the District for this additional residential lot. We recommend that the County
obtain a signed copy of the water service agreement from the District prior to the final approval of the
development.

reviewed the application from George Bollinger and wish to forward attached review comments from City
staff. The City of Greeley recommends against this scale of development outside of urban boundaries due to the
cost of extending services and maintaining adequate emergency response levels. If the application is approved,
dedicating the appropriate right-of-way and maintaining appropriate setbacks will better serve this property and the
surrounding area.
