Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In • addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure,the issuance of a well permit, or the physical availability of water. According to the referral information the operation will be served by the Central Weld County Water District("District"). Our office has no comments regarding the District's ability to serve the commercial operation. Should you have any questions in this matter, please me at 303-866-3581. S UB E CT:07/25/2008 SR-1662 NOBLE ENERGY DATE:COLORADO Environmental Health Services has reviewed this proposal for a tubular storage yard for Noble Energy. The site will be served by Central Weld County Water District, however a will serve letter was not included with the application. An individual sewage disposal system will be installed. The waste management plan included in the submittal is adequate. A dust abatement plan will be required. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: • 1. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 2. Submit documentation from Central Weld County Water District indicating that water service is available. 3. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment, if applicable. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. 4. In the event washing of vehicle will occur on site the applicant shall ensure that any vehicle washing area(s) shall capture all effluent and prevent discharges from the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. Vehicle washing areas should be designated on the plat. • • • • We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved waste handling plan. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement • plan at all times. 6. Any vehicle washing area(s) shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 8. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. 9. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 10.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 11.If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. • 2 • • • 12.The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. • • 3 Weld County Planning Department • • GRE?LEY OFFICE annR avi MEMORANDUM ® TO: Kim Ogle, Planning Services WI I D C• DATE: July 22, 2008 COLORADO FROM: Matt Flggs, Public Works, and de Don Dunker, P.E., Public Works SUBJECT: USR-1662, Noble Energy, Inc. The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: Please revise the approximate number of trips for the site. The current value does not take into account daily trips made by employees and visitors. • REQUIREMENTS: Final Plat: 1. All drawings as well as the drainage report shall be stamped by a registered professional engineer, licensed to practice in the state of Colorado. 2. All terms on the Northern Colorado Geotech report shall be defined. 3. Please show the on-site concrete ditches as well as the existing above-ground gas pipelines at the southeast corner of the site on the site plans. Access: 1. Road Access Culverts, County Code Sec. 8-3-10. Installation of culvert. The owner of the property shall pay for materials and cost of installation for new road access culverts whenever the installation of a culvert is made necessary by the creation of a new access from private property to a County road, by any alteration of the natural flow of water across private property by the owner, or for any other reason created by any owner of private property. The culvert shall be installed according to the specification of the Department of Public Works as to size and location in the County rights-of-way or other County property in which such culverts may be installed. The culvert size will be determined in accordance with standard engineering practices. The property owner shall be responsible for cleaning the borrow ditch to the extent required to accommodate the road access culvert and insuring proper drainage. 2. Intersection sight distance triangles at the development entrance will be required. All landscaping within the triangles must be less than 3 1/2 feet in height at • maturity, and noted on the final roadway plans. • • 3. Additional paving shall be required beyond the site's gated entrance. See • redlines on site & utility plan for details. 4. An on-site private road maintenance agreement with both Exhibits A & B filled out shall be required. Collateral will be required for 100% of the estimated costs on schedule A. 5. Contact Amy Burry, Utility Coordinator for Weld County Public Works, at (970) 304-6496 ext. 3764 for a Right-of-Way permit for any work that may be required in the right-of-way on WCR 38. A special transport permit will be required for any oversized or overweight vehicles that may access the site, and may be obtained by contacting Amy as well. Offsite: 1. An offsite long term road maintenance agreement with both Exhibits A & B filled out shall be required. a. As WCR 38 intersects State Highway (SH) 60, contact Gloria Hess-Idler, CDOT, at the Greeley office at (970) 350-2148 for any additional requirements that may be necessary for the intersection of WCR 38 and SH 60. 2. The haul trucks shall exit the site via the proposed access directly onto WCR 38 eastbound. From WCR 38, the trucks will turn either right or left onto SH 60. This haul route shall be followed unless local traffic necessities deem it unnecessary. • Drainage: 1. Please address and resolve all redlines on the Drainage Report and drawings prior to resubmitting for review. 2. The portion of land that flows into Culvert A (18" RCP in Basin A) shall be its own basin, separate from the existing Basin A. 3. Please include all culvert calculations in the final drainage report. 4. Please show all time of concentration flow paths on the drainage plan drawing. 5. A separate letter shall be submitted to Dave Bauer, Weld County Public Works, requesting a variance to allow a retention pond to be utilized on site. The applicant shall address the comments listed above for this review process.
