RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
ZCV #0800284 AGAINST FRANK AND CAROL HIRT FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Frank and Carol Hirt, ZCV #0800284, are allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of March, 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Frank and Carol Hirt were not present or represented at said hearing, although
all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Frank and Carol Hirt to remedy the violation of the Weld County Code, and any
other persons occupying the properties, any persons claiming an interest in the properties, and any
persons acting in active concert with the identified parties.

NONCOMMERCIAL JUNKYARD: An area where any waste, junk or used or secondhand
materials are stored or handled, including but not limited to scrap iron and other metals,

JUNKYARD may also include the storage or keeping of DERELICT VEHICLES registered
last or currently registered under the property owner and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the
NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from all ADJACENT properties and public
rights -of -way.
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on
surrounding uses. A SCREENING PLAN shall be submitted and approved by the
Department of Planning Services.

During my latest inspection, I noted that Derelict Vehicles are not the only violation occuring on this
property, I noted wood, barrels, derelict vehicles and miscellaneous debris in general. While the
presence of a NONCOMMERCIAL JUNKYARD consisting of the above mentioned items is an allowed
use within an Agriculturally zoned subdivision, such as Aristocrat Ranchettes, it must be completely
SCREENED from all adjacent properties and public rights -of -ways; otherwise, any Derelict Vehicles
shall be operational at all times and evidence of current registrations shall be submitted to this office.
The remaining items shall be removed from the property or screened as mentioned above.
Please keep in mind if the above items have been addressed prior to March 6th, the above scheduled
Violation Hearing will be cancelled.
RECOMMENDATION
The Department of Planning Services recommends this case to be forwarded to the County Attorney's
Office for immediate legal action.

Upon a visual inspection of the property, the following
items were noted: derelict vehicles. No pictures were
taken during this inspection.
Carol Hirt (303-857-2651) called. She said she received
my letter. I explained what my inspection revealed. She
said she only has 1 (one) Derelict Vehicle on the
property and it belongs to her grandson. She said he is
re -doing the transmission. She said every other vehicle
on the property works and has current license plates and
insurance. I asked if 60 days would be enough time for
him to finish restoring the vehicle. She said she would
make sure it was. I explained if she needed additional
time to make sure to call me, since my next step would
be to schedule a Violation Hearing if the property was not
back in compliance by the end of the 60 days. She said
she would.
Upon a visual inspection of the property, the following
items were noted: barrels, derelict vehicles, wood and
miscellaneous debris. No pictures were taken during this
inspection.

Please also be advised that I will be taking video and/or pictures from the road or adjacent
properties the business day before or as soon as possible to the above mentioned Violation
Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation including
the action necessary to correct the violation, and that you were given sufficient time to remedy

zoned subdivision, such as Aristocrat Ranchettes, it must be completely SCREENED from

Hopefully this 60 day extension will grant your grandson enough time to finish restoring the
vehicle currently situated on your property.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have until
12/08/2008, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the
County Attorney's Office for legal action.

interest and all charges thereon, as in said lien/mortgage mentioned; and whereas said lien note/
mortgage has been assigned to Central Bank Of Denver
AND WHEREAS, the said Lienor(s)/Mortgagor(s) ha ye paid and fully satisfied said lien note/
mortgage, together with all interest and charges thereon, according to its tenor;
NOW, THEREFORE, in consideration of the premises, the said CENTRAL BANK AND TRUST
COMPANY a/k/a CENTRAL BANK OF DENVER, a banking corporation, does hereby remise, re-
lease, and forever quit claim unto the said Lienor(s)/Mortgagor(s) and their
heirs and assigns forever, all the right, title, and interest which it has by virtue of said lien note/
mortgage in and to the said real estate, and more particularly described as follows, to wit:

situate, lying and being in the County of Weld
State of Colorado
TO HAVE AND TO HOLD THE SAME, together with all and singular the privileges and ap-
purtenances unto the said Lienor(s)/Mortgagor(s), their heirs and assigns forever.
And further, that the said lien note/mortgage is, by these presents, to be considered as fully and
absolutely released and canceled and forever discharged.
