RE: AUTHORIZATION FOR CHAIRMAN TO SIGN QUIT CLAIM DEED TRANSFERRING
BURGER FRY PROPERTY TO THE CITY OF GREELEY.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 2nd day of April, 1980, the Board of County
Commissioners adopted a resolution declaring the following
described property as surplus property:
Lot 11, Block Two and the east twenty (20)
feet of Lot 1, except the south thirty (30)
feet, Block One, Burger and Fry' s Subdivi-
sion, a subdivision of Weld County, Colorado.
WHEREAS, said Resolution further stated that said property
shall be transferred to the City of Greeley on the condition that
the property shall be used for either public park or open space
purposes , and
WHEREAS, a quit claim deed effecting said transfer has been
prepared and the Board deems it advisable to authorize the Chair-
man of the Board to sign said deed.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado that the Chairman of the Board
be, and hereby is, authorized to sign the quit claim deed effecting
the transfer of the above described property to the City of Greeley.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 16th day of
April, A.D. , 1980.

Dear Mr. Morrell:
Per our phone conversation today, Weld County is prepared to
transfer the property in the Burger and Fry' s Subdivision offered
to the City of Greeley on October 10, 1978. As indicated to you,
the property has been cleared of all building structures and all
property can be conveyed by Warranty Deed with the exception of
two (2) lots cited below with the extenuating circumstances :
Lot 11, Block 2 was received by Weld
County by quit claim deed and is a
property which had previously gone to
tax sale (the owner at the time was
deceased. ) The East 20 feet of Lot 1,
except the South 30 feet, Block One,
was received by Weld County by a
Treasurer' s Deed (there was a tax sale,
but no one bid on the property. ) Copies
of the documents we have are enclosed
for your reference.
Because of the above problems, Weld County would request that
the City of Greeley accept Quit Claim Deeds on the two (2) lots
cited above and Warranty Deeds on the remainder. If this request
meets with the City Council ' s approval we will proceed immediate)
with the closing on the property.

Subject: Burger Fry Subdivision
In response to members of the Board's inquiry as to whether or not the lease
on the Burger Fry Subdivision with Big R could be extended, I have the following
to offer. The area being leased will fall within the City of Greeley's flood
plain, and with their adoption of their flood plain ordinance within the next
few weeks, it will prohibit use of that property by Big R for storage of
materials. Thus, since the use would be restricted in such a way that it would
not be useable by Big R, the lease should not be extended.
On November 21, 1978, the City of Greeley accepted the Burger & Fry subdivision
property with the provisions that the City receive a warranty deed rather than
a quick claim deed for the property, and that the property be cleared of all
building structures. The structures have been removed and Gary Fortner and
the County Attorney are now in the process of developing a warranty deed for
the property and hopefully within the next month the property can be transferred
to the City of Greeley. I would recommend that the property be transferred as
expeditiously as possible in light of the fact that once Big R removes all of
their items, unless the land is developed into a green belt or park area, it
will most likely become a weed patch that we would have to contend with.

The Weld County Board of County Commissioners has been considering •
the disposition of that part of Burger and Fry ' s Subdivision which
was involved in the acquisition/relocation project over the past
couple of years . The. property in question is more specifically •
described as Lots 5 , 6 , 7 , 8 , 9 , and 10, Block 1 , and Lots 1 , 2 , 3 , •
4 , 6 , 7 , 8 , 9, 10, 11 , and 12, Block 2 of Burger and Fry ' s Subdivi-
sion as shown on the attached plat . The Board would like to offer
to give the above described property to the City of Greeley with
the following stipulations :
1. The property must he used Tor public park or open space purposes,
and
2. The City of Greeley would prepare and file the necessary maps
and/or documents to vacate that part of the. subdivision plat
described above.

Gentlemen:
This is to notify you that as a result of the location of your
property(ies) in the floodway of the Cache La Poudre River , the
City is proceeding to initiate a rezoning of your property to CD
(Conservation District) . A public hearing to consider this rezon-
ing will be held during the Planning Commission meeting of August
28, 1979 at 1: 30 p.m. in the City Council Chambers , 919 Seventh
Street. The City Council will have a public hearing regarding
this matter on September 18, 1979 at 7 : 30 p.m. also in the City
Council Chambers .
Should you have any questions concerning this matter, please contact
the City Planning Department at the Greeley Civic Complex or call
Ed Powers at 353- 6123 ext . 240 .
Briefly, the floodway has been identified following a scientific
and engineering study conducted by the Federal Insurance Administra-
tion. This rezoning is being done pursuant to recent Zoning Code
amendments which adopt maps of the flood plain and which identify
the floodway as an area where further land development may result
in loss of life , injuries , property damage and other loss , both
public and private , due to floods. This rezoning also fulfills the
basic requirements of the Federal Insurance Administration to make
affordable insurance premiums available to property owners in flood
prone areas.

4 , 6 , 7 , 8, 9, 10, 11 , and 12, Block 2 of Burger and Fry ' s Subdivi-
sion as shown on the attached plat . The Board would like to offer
to give the above described property to the City of Greeley with
the following stipulations :
1. The property must be used for public park or open space purposes,
and
2 . The City of Greeley would prepare and file the necessary maps
and/or documents to vacate that part of the subdivision plat
described above.
