RE: APPROVE FIRST ADDENDUM TO INTERGOVERNMENTAL AGREEMENT FOR
ROADWAY IMPROVEMENTS TO LARIMER COUNTY ROAD 1 / WELD COUNTY
ROAD 13 AND AUTHORIZE CHAIR TO SIGN - LARIMER COUNTY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with the First Addendum to the
Intergovernmental Agreement for Roadway Improvements to Larimer County Road 1 / Weld County
Road 13 between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Works, and Larimer County,
Colorado, commencing upon full execution, with further terms and conditions being as stated in said
addendum, and
WHEREAS, after review, the Board deems it advisable to approve said addendum, a copy of
which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the First Addendum to the Intergovernmental Agreement for Roadway
Improvements to Larimer County Road 1 / Weld County Road 13 between the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of
the Department of Public Works, and Larimer County, Colorado, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said addendum.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 21st day of October, A.D., 2009.

FIRST ADDENDUM TO
INTERGOVERNMENTAL AGREEMENT

This First Addendum To Intergovernmental Agreement (Addendum) is made this Os day of
N( jnbeq , 2009, between the Board of County Commissioners, Larimer County, Colorado
(Larimer County) whose address is 200 West Oak Street, Fort Collins, CO 80521 and the Board
of County Commissioners, Weld County, Colorado (Weld County) whose address is P.O. Box
758, 915 10`h Street, Greeley, CO 80632.
WHEREAS, Larimer County and Weld County into an Intergovernmental Agreement (For
Roadway Improvements to Larimer County Road 1/Weld County Road 13) (Agreement) dated
December 9, 2008; and
WHEREAS, Section 6 of the Agreement states:
ADDITIONAL ROADWAY LOCATED WITHIN JOHNSTOWN: The one-half
Mile section of roadway connecting LCR1/WCR13 to US Highway 34 ("Connecting
Section") has been annexed by the Town of Johnstown, Johnstown was approached
by both counties to be included as an active partner in the Project, but did not have
adequate funds in order to participate (see the attached Exhibit "A"). As a result,
the Parties have decided to leave Connecting Section unimproved. If funding does
become available before the Project's completion, the parties hereto will consider
whether to include Connecting Section in the construction contract upon payment of
All costs associated with improvements to Connecting Section by Johnstown.
WHEREAS, funding is available to improvement the Connecting Section within Johnstown; and
WHEREAS, Larimer County and Weld County see the improvements to be in the best interest of
the traveling public, and Johnstown consents to such improvements; and
WHEREAS, Larimer County and Weld County seek to have such improvements made and are
willing to pay the costs for such improvements as provided in this Addendum.
NOW, THEREFORE, in consideration of their mutual promises, the parties agree as follows:
1. The Connecting Section shall be included and improved as part of the Project. The
improvements shall consist of the widening and paving of the Connecting Section. The
width of paving shall be 36 -feet and shall consist of two, twelve foot -wide travel lanes
and two, six foot wide shoulders.
2. Total costs for improvements to the Connecting Section are estimated to be $350,000.
3. Larimer County and Weld County shall share equally in the costs to improve the
Connecting Section.
4. Except as modified by this Addendum, all terms and conditions of the Agreement shall
remain the same.
