RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST JAMES AND ROXANNE GOODRICK FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, James and Roxanne Goodrick, ZCV #0800249, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of February, 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Roxanne Goodrick, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until April 10, 2009, to allow adequate time for the property owners to restore, remove
or screen the noncommercial junkyard from all adjacent properties and public rights -of -way to bring
the subject property into compliance and for an inspection of the property by the Department of
Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0800249 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against James and Roxanne Goodrick to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until April 10, 2009, to allow adequate time for the
property owners to restore, remove or screen the noncommercial junkyard from all adjacent
properties and public rights -of -way to bring the subject property into compliance.

STRUCTURE or visually SCREENED from all ADJACENT properties and public
rights -of -way.
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on
surrounding uses. A SCREENING PLAN shall be submitted and approved by the
Department of Planning Services.
REMEDY
All DERELICT VEHICLES shall be SCREENED from all adjacent properties and public rights -of -ways.
I believe you indicated that you intend to construct a structure on the back portion of the property to
house the remaining vehicles. Please keep in mind that a building permit will probably be required for
such a structure (you can call the above number to determine if one is required or not).

Upon a visual inspection of the property, the following
items were noted: multiple derelict vehicles. No pictures
were taken during this inspection.
Roxanne Goodrick (303-709-0888) called and left a
message. I returned her call. She said her father
passed away and she had to take her vehicles off of his
property. She said several of the vehicles, would be
going to scrap. She said they would be looking at
constructing a lean-to type structure for any remaining
derelict vehicles. I explained that I would send her a 60
day letter and if they needed more time, she would need
to make sure to call me prior to the end of that 60 day
time frame; otherwise, my next step was to schedule a
Violation Hearing and typically once a hearing is
scheduled, I do not vacate the hearing. She said she
would make sure to call me if they needed more time.
Roxanne Goodrick (303-709-0888) called. She said with
her father passing away, they have spent almost every
weekend over at his place dealing with the estate. She
asked for an extension. I explained that currently they
have until 11/24/08. She said she was aware of that, but
there was really no way she would be able to make that.
I advised her that I would grant an extension, but I was
going to do it by scheduling her case for the February
Violation Hearings. I explained that it would be on
February 10th, but I would do my last inspection by
February 6th. I explained if the property is in compliance
prior to the hearing, the hearing would be cancelled. I
offered to conduct an inspection in January to give them
a heads up of any remaining issues. I told her to call me
in January or whenever she thought they were pretty
close. She said she would. I explained that the hearing
letter comes out in Certified mail so not to be surprised
when she gets it. She said thanks.

Roxanne Goodrick (303-709-0888) called. She said they
were about 90% done, but not finished. I explained that I
would be happy to meet her out on the property this
Friday at 2:30 to discuss any remaining issues. I
explained if the property was finished, the hearing would
be cancelled and the case would be closed. If not, she
would need to attend the hearing next Tuesday to
request additional time from the Board. I told her I would
support a delay of legal action for 30 days. We
scheduled an on -site appointment for Friday, February 6,
2009 @ 2:30.

the remaining vehicles. Please keep in mind that a building permit will probably be required fo

additional time is needed, you can request more time from the Board at the hearing.
This hearing will take place in the County Commissioners Hearing Room, first floor, Weld County
Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners
might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent
properties the business day before or as soon as possible to the above mentioned Violation
Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation including
the action necessary to correct the violation, and that you were given sufficient time to remedy

After our conversation, it is my understanding that a recent death in family has caused this
temporary violation. Hopefully, by extending this violation for 60 days, this will allow enough
time for the property to be brought substantially into compliances. As we discussed, any
DERELICT VEHICLES shall be SCREENED from all adjacent properties and public
rights -of -ways. I believe you indicated that you intend to construct a structure on the back
portion of the property to house the remaining vehicles. Please keep in mind that a building
permit will probably be required for such a structure (you can call the above number to
determine if one is required or not).
As we discussed, if you do see that you are going to need more time, please do not forget
to call me and let me know; otherwise, a Violation Hearing may be scheduled. Once a
hearing has been scheduled, I do not vacate the hearing unless the property is brought
completely into compliance.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have until
11/24/2008, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the
County Attorney's Office for legal action.
