RE: GRANT CHANGE OF ZONE FROM A-AGRICULTURAL DISTRICT TO
C-COMMERCIAL DISTRICT WITH A UNIT DEVELOPMENT PLAN FOR
NICK SEKICH, ET AL. , 6769 WELD COUNTY ROAD 32, LONGMONT,
COLORADO 80501.
WHEREAS, the Board of County Commissioners of Weld County,
c Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
•., affairs of Weld County, Colorado, and

WHEREAS, Section 8 . 2 and 8 . 3 of the Weld County Zoning
Resolution authorizes the Board of County Coituaissioners to
grant a change of zone with a Unit Development Plan upon the
showing by the petitioner of certain facts, and
WHEREAS, the Board of County Commissioners heard all of
the testimony and statements of those present, has studied
the request of the petitioner and the recommendations of the
Weld County Planning Commission, and having been fully
informed, is satisfied that the request for re-zoning complies
with the Weld County Comprehensive Plan and the conditions
set out in Section 8 .2 and 8 . 3 of the Weld County Zoning
Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado that the petition of
Nick Sekich, et al. , for a change of zone from A-Agricultural
District to C-Commercial District with a Unit Development
Plan on the abovedescribed tract of land be, and hereby is,
granted subject to the following:
1. The Development Standards for the
Change of Zone.
2. No building or electrical permits
shall be issued on the property
until the Development Standards
for the Unit Development have
been placed on the Unit Develop-
ment plat and said plat has been
delivered to the office of the
Department of Planning Services.
BE IT FURTHER RESOLVED by the Board that the reasons for
approval contained in the Planning Commission recommendations
dated December 18 , 1979 be, and hereby are, incorporated as
the findings of fact of the Board of County Commissioners in
this matter.

The following business was transacted:
I hereby certify that pursuant to a notice dated December 24 , 1979
duly published December 27 , 1979 and January 17 , 1980 in the
Platteville Herald , a public hearing was held on the request of
Nick Sekich, et al for a change of zone from A (agricultural)
' .to C (Commercial) . Mr . Nick Sekich Jr . was present for the
hearing and reviewed the request . No one in attendance at the
hearing was opposed to the granting of the change of zone .
After all testimony was received , Commissioner Carlson made a
motion to approve the change of zone , unit development , and
development standards . Commissioner Dunbar seconded the motion
and it carried unanimously.

PLANNING COMMISSION RECOMMENDATION
December 18, 1979
"The expansion and development of agri-business and
agriculturally oriented industry will be encouraged,
provided these enterprises do not adversely affect
the total economy or environment. "
It is the opinion of the Planning Commission that the applicant has
demonstrated that it would be impractical or unprofitable to locate
the proposed agri-business facility which is designed to serve the
agricultural community within an existing municipality. In addition,
the request would not appear to have any adverse effects on the
total economy or environment.
3 . It is the opinion of the Planning Commission that the request
will be compatible with the surrounding land uses , will have
an adequate water and sewer service available to serve the
permitted uses within the proposed zone district, and will
have adequate road and highway facilities to provide access
to the property. In addition, the property does not appear
to have sand, gravel, or other mineral resources on or under
the subject property, is not located within a Flood or
Geologic Hazard area, and does not have moderate and/or severe
soil limitations. This determination is based, in part,
upon a review of the information submitted by the applicant,
other relevant information regarding the request and responses
of the referral entities which reviewed the request.
The Planning Commission recommendation for approval is subject to the
following items being accomplished:
1 . The attached Development Standards being recommended and adopted
for the Unit Development Plan which accompanies this request.
2 . No building or electrical permits shall be issued on the property
until the Development Standards for the Unit Development have
been placed on the Unit Development plat and said plat has been
delivered to the office of the Department of Planning Services.

DEVELOPMENT STANDARDS
1 . The permitted uses within the Commercial Unit Development area
may be those uses as listed in the Commercial Zone District of
the Weld County Zoning Resolution. The permitted uses shall
be conducted within the structure (s) as shown hereon. Agri-
(/' cultural production will be permitted. If agricultural pro-
duction is not pursued on all or any portion of the Commercial
Unit Development that portion not in agricultural production
shall be maintained in a manner so as to prevent fugitive dust,
erosion, growth of noxious weeds , and non-ornamental ground
cover shall not exceed 12 inches in height.
2. Display of merchandise may be permitted. For purposes of this
statement "display merchandise" is defined as representative
samples of the business ' inventory or product, which are put
on display for the purpose of informing the public and attracting
business, and which are displayed in a neat and acceptable manner.
3 . Outdoor storage shall be limited to farm equipment, farm supplies ,
and farm vehicles .`
4. Minimum setback for structures shall be 200 feet from State
Highway right-of-way. Side and rear setbacks shall be in
compliance with the requirements for Commercial zoning in the
Weld County Zoning Resolution.
5. All signs located on the unit development area shall be in
compliance with the requirements of the Weld County Zoning
Resolution.
6 . The unit development area shall be maintained in such a manner
so as to prevent soil erosion, fugitive dust and the growth of
noxious weeds .
7. All construction and electrical work shall be done in accordance
with the Weld County Building Code.
8 . Access to Colorado Highway 66 shall be limited to one 35 foot
commercial access as shown on the unit development plat. All
accesses shall have the approval of the Weld County Engineering
Department and/or the Colorado Division of Highways . All
accesses shall be constructed in accordance with the recommendations
and/or requirements of the Weld County Engineering Department and/or
the Colorado Division of Highways.
9 . Use of property shall comply with all County and State Health
Standards and Regulations pertaining to air quality, water quality,
noise emission, and sanitary disposal systems.
10. Lighting shall be arranged to minimize illumination onto
adjoining property and to prevent glare directed at vehicles on
public right-of-ways.
11 . As shown on the Unit Development plans , reservation for the
additional right-of-way for Colorado Highway 66 shall be
thirty-five ( 35) feet .
12 . A 20 foot landscape strip shall be maintained along the north
side of the 35 feet of future right-of-way as shown hereon.
The landscaping may be l7egetation, a hedge row, berm, wall
or combination thereof. Maintenance of the 20 foot strip shall
be the responsibility of the owner and/or operator of subject
property.
13 . The Unit Development plan shall be limited to the plans submitted
and governed by the Development Standards stated above and
applicable Weld County regulations. Any material deviations
from the plans and/or Development Standards as shown or stated
above shall require the approval of an amendment to the Unit
Development Plan by the Planning Commission.'

The current zoning of the parcel i;s' agriculture and it is proposed
to change the zoning to Commercial with Planned Development. While
this proposal is not strictly consistent with the Weld County
Comprehensive Plan, it is felt by the petitioners that changing
conditions in the area warrant a change of zone and that the pro-
posed change is consistent with the needs of the Agricultural
Community. Agriculture needs service businesses, they need to
be within a reasonable distance (use, need to save gas). This
part of Weld County has no close-in proximity agriculture service
towns. If agriculture is to remain in existence in this area it
is vital that Agri-Business be allowed to thrive. Longmont,
Frederick and others are now becoming urban oriented.
Requested uses shall be a Farm Supplier, Farm Equipment, & Farm
Truck Repair Shop, and Farm Tire Sales Shop. These used are
agri-business in nature and are compatible with the surrounding
land uses which are Ag. , and Agri-Business in nature.
Adequate water service is available to service uses requested
(see enclosed copy of letter from Little Thompson Valley Water
District, dated July 20, 1979). Sewer service can be supplied
by septic tank and leach field. There appears to be no problem
with either soil conditions or high water tables.
Road and highway facilities providing access to the property are
adequate in size to meet the requirements of proposed zone district.
Highway 66 services the site and there is an I-25 interchange
within one-half mile of the site. Coordination has been accomplished
with State Highway Department; Required setbacks , future ROW
reservations, and highway access are shown on the drawings . There
appears to be no additional requirements to upgrade the road and
State Highway facilities. Applicant is willing at his own expense
to construct required road access needed to connect the site with
2506 6th Ave. State Highway #66.

The proposed zone change is not located within either a
flood or geologic hazard area as identified by maps adopted
by Weld County and proposed change to zone is not known to
contain a commercial mineral deposit as defined by Colorado
State Statues. Soil conditions on the site do not present
limitations to the construction of structures or facilities
proposed to the site. A copy of the Soil Conservation
Survey has been provided as part of this submittal .
