RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST BRIAN AND TERESA ZEHNDER AND HERB WRIGHT FOR
VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Brian and Teresa Zehnder and Herb Wright, ZCV #0900048, are allegedly in
violation of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of May, 2009, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Brian and Teresa Zehnder and Herb Wright were not present or represented
at said hearing, although all parties were notified of said hearing by Department of Planning
Services staff, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until June 12, 2009, to allow adequate time for the property owners to restore, remove
or screen the noncommercial junkyard from all adjacent properties and public rights -of -way to bring
the subject property into compliance and for an inspection of the property by the Department of
Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0900048 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Brian and Teresa Zehnder and Herb Wright to remedy the violation
of the Weld County Code, and any other persons occupying the properties, any persons claiming
an interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until June 12, 2009, to allow adequate time
for the property owners to restore, remove or screen the noncommercial junkyard from all adjacent
properties and public rights -of -way to bring the subject property into compliance.

COMMERCIAL VEHICLE: Any vehicle, other than an automobile, used or previously used
to facilitate an activity where goods, products or services are bought, sold or transferred in
ownership on a fee, contract or barter basis, excluding those uses listed by right and
accessory uses in the A (Agricultural) Zone District. A COMMERCIAL VEHICLE shall
include, but is not limited to, semi -trailers, dump trucks, construction equipment, railroad
cars and cargo containers. A COMMERCIAL VEHICLE shall not be allowed to deteriorate
to the condition of a DERELICT VEHICLE.
DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power);
is partially or totally dismantled; has all or portions of its body work missing or is
substantially damaged; does not have valid registration with the State, as required by
Section 42-3-103, 42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is
not permanently attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is
lacking proper equipment to the extent that it would be unsafe or illegal to USE on public
road rights -of -way or otherwise not equipped with lamps and other equipment, as required
in Sections 42-4-202 to 42-2-227, C.R.S. This definition shall not include implements of
husbandry, farm tractors or vehicles customarily operated in a FARMING operation.

NONCOMMERCIAL JUNKYARD: An area where any waste, junk or used or secondhand
materials are stored or handled, including but not limited to scrap iron and other metals,
paper, rags, rubber tires, building materials and bottles. A NONCOMMERCIAL
JUNKYARD may also include the storage or keeping of DERELICT VEHICLES registered
last or currently registered under the property owner and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the
NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from all ADJACENT properties and public
rights -of -way.
REMEDY
As I indicated in my initial letter while the presence of a NONCOMMERCIAL JUNKYARD consisting of
DERELICT VEHICLES and miscellaneous debris is an allowed use within the Agricultural Zone
District, it must be completely SCREENED from all adjacent properties and public rights -of -ways;
otherwise, any Derelict Vehicles shall be operational at all times and evidence of current registrations
shall be submitted to this office.
Additionally, the presence of multiple COMMERCIAL VEHICLES (more than 1) requires specific
Zoning permits.
RECOMMENDATION
The Department of Planning Services recommends this case be forwarded to the County Attorney's
Office for immediate legal action.

Upon a visual inspection of the property, the following
items were noted: several apparent derelict vehicles,
commercial vehicles and miscellaneous debris. No
pictures were taken during this inspection.
Teresa Zehnder (303-431-6894) called. She said all the
junk belongs to her tenant. She said she thought they
were going through a divorce, but she knows all the junk
is his. She said she would give him a call and find out
how long it would take him to remove all the junk. We
also discussed just the removal of all the commercial
vehicles and building an opaque fence (like a standard
wooden privacy fence) around the remaining derelict
vehicles, tires, etc - NOT Commercial Vehicles). We
discussed the April 10th deadline. I advised her that if I
did not hear from her my next step would be to schedule
a Violation hearing and once a case was scheduled, I did
not cancel it unless the property was in compliance. She
said she understood and should be able to call me back
in a couple of days or so.
Teresa Zehnder (303-431-6894) called. She said her
father told her that the tenant has moved some things
out, but it is not finished. She asked if they could have
some more time. I explained that I could give them
some time, but the way I would do it was to schedule the
property for a Violation Hearing to occur on May 12,
2009 at 10:00, but if the property was brought into
compliance by the 8th of May (when I conducted my final
inspection), the Violation Hearing would be cancelled.
She asked what happened if it was not in compliance by
the 8th. I explained that she or someone else would

want to attend the hearing and explain to the Board their
situation and request a little extra time. She said she
was not going to tell that to their tenant. She was just
going to tell him he had to be done by the 8th. I said that
was probably a good idea. She said she would talk to
me again probably about in a month. I said that sounded
good. I reminded her again that a hearing notification
would be headed out in the mail. She said okay.

properties the business day before or as soon as possible to the above mentioned Violation

Sections 42-4-202 to 42-2-227, C.R.S. This definition shall not include implements of
husbandry, farm tractors or vehicles customarily operated in a FARMING operation.
NONCOMMERCIAL JUNKYARD: An area where any waste, junk or used or secondhand
materials are stored or handled, including but not limited to scrap iron and other metals,
paper, rags, rubber tires, building materials and bottles. A NONCOMMERCIAL JUNKYARD
may also include the storage or keeping of DERELICT VEHICLES registered last or
currently registered under the property owner and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the
NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from ,all ADJACENT properties and public
rights -of -way.
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding
uses. A SCREENING PLAN shall be submitted and approved by the Department of
Planning Services.
