The Weld County Public Works Department has reviewed this proposal. This project falls under
the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4,
Section 23. Staff comments made during this phase of the Use by Special Review process may
be all-inclusive, as other issues may arise during the remaining application process.
CDOT: The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses
to the state highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or
970-350-2163) to verify the access permit or for any additional requirements that may be
needed to obtain or upgrade the permit. (U. S. Highway 85)
The U. S. Highway 85 Access Control Plan (MP244.42) mile post marker identifies U. S.
Highway 85 and WCR 18 as the nearest intersection. Improvements of this intersection has
included acceleration/deceleration left turn lane extensions the free right. This is a full
movement intersection that is non -signalized. The medium adjacent to the entrance is being
identified as closed.
Approach/Access: The applicant is indicating the existing 25 -foot entrance with a 20 -foot
paved radius adjacent to U. S. Highway 85. The approach and proposed parking areas
adjacent the proposed building/office service area shall be paved with adequate parking areas
to accommodate visitors, vendors, and employees. The applicant is indicating three ADA
parking spots in the proposal. The wheel guards or curb stops shall be required for parking
areas adjacent to the office if curbs are not available. The appropriate striping shall be provided
to indicate parking spaces. A stop sign shall be placed in the appropriate location prior to
entering on U. S. Highway 85.
There is a salvage yard and an impound lot identified at the rear of the facility. Both are fenced
with adequate access to both facilities. The applicant is indicating proposed crushed asphalt in
both locations.
The existing garage area is gated and has asphalt in place.
Storm Water Drainage: The applicant has provided the water quality control volume
calculation from Freese Engineering. Please contact Clay Kimmi, Drainage Division, for review
and comments at 970-356-4000, Ext. 3750.
Traffic Study: The access is to U. S. Highway 85. If the State requires a traffic study, Weld
County Public Works would like to have the opportunity to review the numbers associated with
the facility. The applicant is indicating approximately 10 employees on site and would be
providing a vehicle tracking pad prior to asphalting the facility. Please contact Janet Carter,
Traffic Engineer, for any follow-up necessary for the traffic study at 970-356-4000, Ext 3750.

Easement: This property is associated with many easements. All recorded easements shall be
noted on the plat with adequate circulation through the facility to accommodate the access. No
structures shall block any access through the easements. If easements are gated and locked,
keys shall be provided to all users of the easement.
Flood Hazard Development Standards: This area is not in a Special Flood Hazard Area
(SFHA) as determined by the Federal Emergency Management Agency (FEMA).

Environmental Health Services has reviewed this proposal for an automotive repair,
sales, salvage and service business. There is a house located on the property but it
appears from the application it will be used for the applicants' residence and not in
association with the business.
Water for the business will be provided by a commercial well (permit 67171-F). A new
septic system will be installed in conjunction with the construction of the new building.
The application indicates that portable toilets will be utilized until the new building is
constructed. It is the policy of this department to allow portable toilets and hand
washing units for temporary uses that typically do not exceed 6 months in duration.
The proposed building can not contain floor drains unless it is a self contained system
and the fluids are disposed of off site at an appropriate disposal site. The proposed
concrete washout pit must be designed so hazardous fluids do not come into contact
with soils or groundwater. A minimal dust abatement plan will be required for on site
dust. The plan should include items such as a reduced speed limit and watering, as
necessary. A waste handling plan was submitted with the application but further
information is needed. Names, addresses and phone numbers for the paint suppliers
should be included in the waste handling plan. In addition, all products must be stored
in compliance with manufactures recommendations.
The Air Pollution Control Division at the Colorado Department of Health and
Environment will determine if an Air Pollution Emission Notice (A.P.E.N.) and Emissions
Permit is required for the paint booth.

We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan, for on site dust, for review and
approval, to the Environmental Health Services, Weld County Department of
Public Health & Environment.
2. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment, if applicable.
Alternately, the applicant can provide evidence from the APCD that they are not
subject to these requirements.
3. In the event that 1 or more acres are disturbed during the construction and
development of this site, the applicant shall obtain a stormwater discharge
permit from the Water Quality Control Division of the Colorado Department of
Public Health and Environment
4. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirement be incorporated into the permit as a
condition that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations.

We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in Section 14-9-30 of the Weld County Code.
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
9. Adequate toilet facilities (portable toilets) and hand washing units shall be
provided during the construction of the facility.
10. Bottled water shall be utilized for drinking during construction of the project.
11.Adequate hand washing and toilet facilities shall be provided for employees and
patrons of the facility, at all times.
12.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. The facility shall utilize the existing commercial well.(Permit 67171-F).

13. All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
14. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
15.This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. domestic use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.
16.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

There are two historical building permits listed for this parcel, one has expired and one has been
finaled.
1. A building permit shall be obtained prior to the change of use, or construction of any new
structures. The new building will probably be classified as an B/ S-1 occupancy.
2. A plan review is required for each building for which a building permit is required. Two
complete sets of plans are required when applying for each permit. Include a Code Analysis
Data sheet provided by the Weld County Building Department with each Building permits
Submittal plans shall include a floor plan showing the specific uses of each area for the building.
The Occupancy Classification will be determined by Chapter 3 of the 2006 International Building
Code. The plans shall also include the design for fire separation and occupancy separation
walls, when required by Chapter 5 and 7 of the 2006 International Building Code. Fire Protection
shall conform to Chapter 9 and exiting requirements by Chapter 10.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006
International Building Code; 2006 International Mechanical Code; 2006 International Plumbing
Code; 2006 International Fuel Gas Code; and the 2008 National Electrical Code and Chapter 29
of the Weld County Code.

Upon review of my case files and computer, an active Zoning Violation (ZCV08-00385) was noted. This
violation was initiated due to the operation of M & B Towing and salvage yard without first obtaining the
necessary Weld County Zoning Permits. This case has not yet been presented to the Board of County
Commissioners through the Violation Hearing process.
This application if approved by the Board of County Commissioners will correct the violation. If this
application is denied, please ask the Board of County Commissioners to refer this case to the County
Attorney's Office, but to delay legal action for 30 (thirty) days in order to give them adequate time to
remove all commercial storage and operations from the property.

The Department of Planning Services reviewed the above referenced Use by Special Review
documentation and drawings and offers the following comments:
The Use by Special Review Plat shall be prepared in accordance with Section 23-2-260.D of the
Weld County Code. In addition to these requirements, the plat scale shall be 1" = 40 feet. The
Vicinity Map scale of 1" = 2000 feet scale shall be accurately delineated on the plat.
Response number 6 of the questionnaire states:
"Proposed landscaping will include trees, shrubs, sod and
xeroscaping. As indicate on the plot plan the front of
the building will have trees every four feet. The
front of the property does have a 6' ft chain link
fence, the rear of the property has a 7' ft sold metal
fence. Around the house we will have sod, native grass
and flowered shrubs, xeroscaping will be used to
conserve water."
Section 23-3-250.A.5.A
Required Landscaped Areas
No more than eighty-five percent (85%) of the total area of a lot shall be covered. Land shall not be
deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered by
decorative gravel or wood chips, or if it is otherwise suitably landscaped. There was not a schematic
Landscape and Screening Plan submitted with the application materials. The applicant shall
address this issue and provide additional documentation including all proposed fencing, lighting,
adjacent property screening and landscape treatment to meet this section of the Weld County Code.
Further, staff will require an approved weed management plan and a reseeding /post construction
plan to facilitate soil stabilization and plant material growth. Further, staff will require an updated
landscape and screening plan that addresses the issue of the landscape and screening component
for the buffer between the outdoor storage component and the adjacent properties for this proposed
facility. Written evidence of compliance shall be submitted to the Department of Planning Services.
At a minimum, staff requests information on the common and botanical name of each proposed
plant, including the seed mix, method of installation, and if sod is utilized, how installed and what
genus. Further, native plant material, including xeric materials require regular watering for a period of
approximately one year to establish themselves in the disturbed soils associated with this facility.
Staff requests evidence of ability to water, source of water and rate of application.

Section 23-3-250.A.6
Areas used for trash collection shall be screened from public rights -of -way and all adjacent
properties. These areas shall be designed and used in a manner that will prevent wind- or animal -
scattered trash. The application materials did identify the location of the three dumpsters for
recycling on the plat, however, there was no evidence of immediate screening or other recycling
material control device employed to control this issue. Future submittals shall address this issue as
outlined in this Section of the Code. Written evidence of compliance shall be submitted to the
Department of Planning Services.

Outside Storage. Uses involving outdoor storage of vehicles, (including the parking of employee
vehicles) equipment or materials when permitted shall be screened from public rights -of -way and all
adjacent properties. The applicant shall submit documentation as to how the outside storage will be
screened during the construction period, and for periods thereafter as applicable.
Section 23-3-350.B.
Operation Standards. Uses shall demonstrate conformance with the following operation standards to
the extent that they are affected by location, layout and design prior to construction and operation.
Section 23-3-250.6.6
Light. Any lighting, including light from high temperature processes such as welding or combustion,
shall be designed, located and operated in such as manner as to meet the following standards:
sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent
properties; neither the direct nor reflected light from any light source may create a traffic hazard to
operators of motor vehicles on public or private streets; and no colored lights may be used which may
be confused with or construed as traffic control devices. The application materials did not include a
Lighting Plan. Should exterior lighting be a part of this facility, all light standards shall be delineated
on the USR Plat.
Section 23-3-250.B.7
Property Maintenance. Property shall be maintained in such a manner that grasses and weeds are
not permitted to grow taller than twelve (12) inches. In no event shall the property owners allow the
growth of noxious weeds. The application materials do not address property maintenance. Future
correspondence shall identify how the property will be in compliance with this Section of the County
Code.

Comments:
1. Access during all phases of construction must be maintained. Access roads must be at
least 20' wide, all weather construction, and capable of supporting fire department
apparatus.
2. Painting operations must be conducted in an approved spray booth complying with the
requirements of the IFC Section 1504. If a spray booth needs to be installed, then plans
need to be submitted to FLFPD for review and approval.
3. FLFPD would like the owner to install a Knox Box or Knox Paddle Lock for emergency
access td the property after business hours. If the owner agrees to install one of the above
noted locks, then they need to contact FLFPD for approved Knox Forms.
4. Shop drawings need to be submitted for the proposed automotive repair building.

This letter is to confirm that the Fire Deparlment is not requiring a Knox Box or Knox Key Lock
to be installed at the business. The Fire Department was making the business owner aware that
the department would like to see one installed. However without the business being required to
install a sprinkler or fire alarm system, the Fire Department cannot require them to install one. If

Jacqueline,
Here is the CDOT comment for Mr. Balderas referral. As the applicant has shown you, he has already obtained a
permit from CDOT for this business. However, his access is not constructed according to the dimensions shown
on his permit and on his site plan, and his permit not in good standing with CDOT.
His permit calls for a 25 foot wide driveway with 20 foot radius. Currently, Mr. Balderas has a 40 foot wide
driveway with very little radius. Additionally, instead of using fill dirt or roadbase to cross the barrow ditch between
his chain link fence and the highway, small flat stones were piled on top of each other, which has created a wall-
like structure and a safety hazard. Mr. Balderas contends that our retired Access Inspector gave permission for
the access to be constructed in such a way, but we can find no records here of that blessing. The onus is on Mr.
Balderas to prove our inspector did give permission for this access configuration.
In our last conversation Mr. Balderas thought he had something in writing from CDOT giving him that permission,
which he was going to provide to CDOT. I am still waiting on that documentation. As such, CDOT requests you
put Mr. Balderas' county process on hold until his issues with CDOT are resolved, either with him producing prior
written permission or him reconfiguring his driveway.
