SUBJECT: USR-1707, Joel Mendez
The Weld County Public Works Department reviewed the submitted application for critical items, including
but not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and
Flood Hazard Development Permit. A detailed review of these items was not complete at this step in
process. Comments made during this stage of the review process will not be all inclusive, as revised
materials are submitted other concerns or issues may arise. All issues of concern and critical issues
during further review must be resolved with the Public Works Department.
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002) WCR 31 is a full depth magnesium chloride
treated gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot right-
of-way. The applicant is reserving an additional 10 feet of right-of-way for future build out. This road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-
90), the required setback is measured from the future right-of-way line.
Our most recent average daily traffic (ADT) count reflects 240 vehicles per day taken in 2006; the 85th
percentile reflects speed limits at 50 mph. We do not have any truck percentages at this location.
Access: The access to both Lots A and B are from a shared access point being identified as a 60 -foot
non-exclusive access and utility easement. The applicant is identifying a 60 -foot access turning radius in
both directions to accommodate a large 18 -wheel tractor trailer trucks.
Off-street parking spaces including the access drive shall be surfaced with gravel, recycled asphalt, or
the equivalent and shall be graded to prevent drainage problems.
The applicant shall contact the adjacent property owner, which shares the non-exclusive access and
utility easement to make sure that they are aware that there will be a change in use of the access to allow
two additional 18 -wheel tractor trailer semis to utilize the existing shared access.
Storm Water Drainage: A water quality capture feature such as a small open berm or something to
control run-off from your property is required.
The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of
storm run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.

Environmental Health Services has reviewed this proposal for truck parking. The
application indicates that there will be a total of three persons using the site which
includes his parents, who reside at the property, and the applicant who does not live on
site.
The residence on site will be available for restroom purposes. The residence is served
by an individual sewage disposal system (Permit #SP -0100124) and, according to our
records, was sized for a 4 bedroom home which is equivalent to 8 persons at 75 gallons
per day. This existing system is adequately sized for the three people (two residents
and the applicant) using the site, and, therefore, would not require review by a Colorado
Registered Professional Engineer. The site is served by an individual well (Permit #
232249) and is limited to domestic purposes; household purposes inside one single
family dwelling, the watering of four large, non-commercial domestic animals, and the
irrigation of not more than one acre of home gardens and lawn. Use of the domestic
well for any other purpose, such as truck washing or dust control would be prohibited.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan, detailing on site dust control
measures, for review and approval, to the Environmental Health Services, Weld
County Department of Public Health & Environment.
2. The applicant shall submit written evidence from the Colorado Division of Water
Resources, demonstrating that the well (Permit #232249) is appropriately
permitted for the proposed business use.

3. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
7. Adequate handwashing and toilet facilities shall be provided at all times.
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.

9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
10.The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Dear Ms. Hatch:
This referral does not appear to qualify as a 'subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
project or the ability of the water supply plan to satisfy any County regulations or requirements. In
addition, the comments provided herein cannot be used to guarantee a viable water supply
plan or infrastructure, the issuance of a well permit, or the physical availability of water.
According to the referral information, the site is served by an existing well. According to the
records available in the State Engineer's Office the existing well is permitted under well permit no.
232249. Well permit no. 232249 is permitted for a pumping rate of 15 GPM, annual withdrawal of
2.57 acre-feet and use of ordinary household purposes inside one (1) single family dwelling, the
watering of four large, non-commercial domestic animals, and the irrigation of not more than one (1)
acre of home gardens and lawns.
According to the referral information there will be no employees (other than the current
residence of the property) and no customers visiting the site. Therefore, the well can be used to
serve the property, as currently permitted, as long as the well is operated in accordance with the
terms and conditions of the well permit.
