Gentlemen:
In the process of title examination for the captioned lease, there is an
ambiguity in the Resolution pertaining to the captioned lease which we
wish to have clarified. In the seventh paragraph on the Resolution
authorizing the Weld County Commissioners to issue the captioned lease to
Calvin Petroleum Corporation, (which Resolution is recorded in Book 983,
Reception #1910779) , there is the statement that the lease ". . .which lease
is to run for a period of three years commencing December 1, 1982 and
ending December 1, 1985. . ." We feel certain that this is an oversight
on the part of the County. This provides that the lease expires December 1 ,
1985 whether or not there is oil and gas being produced from this lease
or lands pooled therewith.
It is our desire to have the Resolution agree with the language of the
lease, namely, ". . .this lease shall be for a term of three years from
this date (called "primary term") and as long thereafter as oil , gas or
other hydrocarbons, is produced from said land hereunder or lands pooled
therewith. "
It is kindly requested that we be furnished with a corrected copy of
the recorded Resolution. Thank you for your cooperation in this matter.
