RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
ZCV #0900141 AGAINST RICHARD AND MICHAELEEN CARLSON FOR VIOLATION OF
THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Richard and Michaeleen Carlson, ZCV #0900141, are allegedly in violation of
the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of July, 2009, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Richard and Michaeleen Carlson were not present or represented at said
hearing, although all parties were notified of said hearing by Department of Planning Services staff,
and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Richard and Michaeleen Carlson to remedy the violation of the Weld County
Code, and any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties.

last or currently registered under the property owner and/or tenant's name.

NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from all ADJACENT properties and public
rights -of -way.

Violation Summary Report
During my most recent inspection conducted yesterday, I noted that the number of ANIMAL UNITS has
been reduced to fall within the Use by Right parameters for the Agricultural Zone District.
However, the NONCOMMERCIAL JUNKYARD is still present, consisting of DERELICT VEHICLES,
iron/metal, appliances, wood, tubs (not being utilized for the animals), coolers and miscellaneous
debris. While typically the presence of a Noncommercial Junkyard is an allowed use within an
Agriculturally zoned subdivision, such as Vantage Acres, if completely SCREENED from all adjacent
properties and public rights -of -ways, this use of a Noncommercial Junkyard is not an Accessory Use to
the Use by Right (there is no permitted residence on the property). Therefore Screening is not an
option, the Noncommercial Junkyard shall be removed from the property.
RECOMMENDATION
The Department of Planning Services recommends this case be forwarded to the County Attorney's
Office for immediate legal action.

Upon a visual inspection of the property, the following
items were noted: 13+ cows, 7+ horses, derelict
vehicles, RR ties, wood, tires and miscellaneous debris.
No pictures were taken during this inspection.
Richard Carlson (303-549-1741) called. He said he has
a tenant that is renting the pasture and is over on the
animal units. He said he has already removed some and
still has a few more to go. He said he is just going to tell
him that he either needs to do what I say or get out. He
asked if he could have an extension. I explained that I
could not grant him an extension this time, but I think he
still had some time left through my last letter. I looked it
up and explained that my letter actually isn't up until the
19th. He said he would call me on the 19th for an
inspection. I told him that would work.
Complainant called again. Stated they are down to 2
horses, 1 cow and 3 calves. I explained that was great
because they have 2 acres they can actually have a total
of 8 (so they are actually 2 under). I explained that their
time was due tomorrow and as a result, I would be
inspecting it on Monday. If still in violation they would be
scheduled for July 14, 2009 Violation Hearings. I told
him I would call him either way.
Upon a visual inspection of the property, the following
items were noted: the number of livestock has been
reduced to well within allowed numbers. However, I did
still note multiple vehicles (apparently full of debris). I
also noted an area with wood, iron/metal, appliances,
trash, tubs and miscellaneous debris. See pictures
dated 06/22/09.

properties the business day before or as soon as possible to the above mentioned Violation
Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation including
the action necessary to correct the violation, and that you were given sufficient time to remedy

Vehicles shall be operational at all times and evidence of current registrations shall be
submitted to this office.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have until
06/19/2009, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the
County Attorney's Office for legal action.

and agree to and with the grantee, his heirs and assigns, that at the time of the ensealing and delivery of these presents, he is
well seized of the premises above conveyed, has good, sure, perfect, absolute and indefeasible estate of inheritance, in law, in
fee simple, and has good right, full power and lawful authority to grant, bargain, sell and convey the same in manner and form
as aforesaid, and that the same are free and clear from all former and other grants, bargains, sales, liens, taxes, assessments,

The grantor shall and will WARRANT AND FOREVER DEFEND the above -bargained premises in the quiet and peaceable
possession of the grantee, his heirs and assigns, against all and every person or persons lawfully claiming the whole or any part
thereof The singular number shall include the plural, the plural the singular, and the use of any gender shall be applicable to all
genders.

Bethanie,
I spoke with you on the phone when this issue first came up and I really appreciate your prompt and efficient response
on the matter. Yes we do live out of town and we all have our ways of doing things but this piece of property is going to
the extreme. When he first came in he starting drilling holes and pulling up fencing without asking, and also drilling
holes on our side of the property line. You can see them come down the road with the truck filled with stuff that they
had collected that day. Filled to the top as they have plywood that goes up the bed to fill it even more. Then we just
junk it on the property. The animals are not properly penned as a few days ago I had some of his animals in my front
yard. The pen that he has set up for one of the horses comes right out to the road. It is a haphazard mess all over. I
would hope the board would take into consideration that they would not want this in their neighborhood either whether
you live in the city or the country you take pride in how your neighborhood looks. We have had many issues in this
neighborhood because of the fact that we do live out of town and it seems like people think that it is o.k. to do what they
want and not have any consideration for those others who live in the area. We all look out for each other and we hope
that the board will take into consideration we would like to keep this a clean, friendly and quite neighborhood. There are
clear violation made and prompt action should be taken.

I am sending pictures of the property at 19242 197 nth Way. please view.
The person or persons Residing at 19242 197 nth Way does not have a clue how to take care of these incident
animals. The inhuman and much neglect is the biggest part of my complaint. He or she has taken on more than is possible to
take care of these incident animals in the best human way. The fence is too close to the road, and it has a sharp curve were the
fence and animals are housed. There is no light that would enable a person going around the curve to see it soon enough to
stop. Thus one or many animals would be in juried. I hope the pictures tell most of the story. This person needs to take some
kind of refresher course in animal care, housing and upkeep of livestock.
