RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR SCHOOL SUPPLY PROGRAM
AND AUTHORIZE CHAIR TO SIGN - UNITED WAY OF WELD COUNTY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding for the
School Supply Program between the County of Weld, State of Colorado, by and through the Board
of County Commissioners of Weld County, on behalf of the Department of Human Services, and
the United Way of Weld County, commencing May 1, 2009, and ending December 31, 2009, with
further terms and conditions being as stated in said Memorandum of Understanding, and
WHEREAS, after review, the Board deems it advisable to approve said Memorandum of
Understanding, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Memorandum of Understanding forthe School Supply Program between
the County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Department of Human Services, and the United Way of Weld County
be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said Memorandum of Understanding.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 1st day of June, A.D., 2008, nunc pro tunc May 1, 2009.

RE: Memorandum of Understanding between the Department of
Human Services and United Way of Weld County
Enclosed for Board Approval is a Memorandum of Understanding between the
Department and United Way of Weld County for the School Supply Program. This
Memorandum of Understanding was presented at the Board's April 27, 2009, Work
Session.
For the past two years the Department of Human Services has collaborated with
United Way's School Supply Program in an effort to decrease the barriers to
educational success for the students of Weld County due to poverty. The total
number of students that attend Weld County schools for the school year of 08 - 09,
including St. Vrain RE -1J, is 59,952 and 38% (22,996) of them are currently
participating in the Free and Reduced Lunch Program. Although the enrollment of
these school districts decreased by 430 students from 2007 to 2008, the number of
students participating in the Free & Reduced Lunch program increased by 872
students indicating a significant increase of families living at or below the poverty
guidelines in Weld County.
This MOU will bring $51,500 total including supplies from the County's Community
Services Block Grant (CSBG) and/or Colorado Works funds to support the 38% with
an additional of up to $1,500 to cover costs such as fuel to deliver supplies, rental
equipment, and signage.
The term of this agreement shall commence on May 1, 2009 and terminates on
December 31, 2009.

MEMORANDUM OF UNDERSTANDING
WHEREAS, the following outlines the components of a Memorandum of Understanding
(hereinafter referred to as the Agreement) between United Way of Weld County (hereinafter referred to as
United Way) and Weld County Department of Human Services (hereinafter referred to as the County)
regarding services for Weld County School District School Supply Program
WHEREAS, each organization is independent and capable of providing to the identified
community the services described in this Agreement. The organizations to this Agreement also
understand that by combining their leadership, skills, and talent, that the potential to offer these needed
services can be accomplished better and more effectively.
NOW THEREFORE, the undersigned organizations and in good faith are resolved to execute this
Memorandum of Understanding and enter into an agreement as follows:
I. Purpose of Statement:
The purpose of this Agreement is to establish a collaborative effort of collecting and distributing school
supplies throughout Weld County Schools with the County's intent to serve only eligible clients.
II. Population Served:
Per the 2000 census, in Weld County:
11.9% of two parent households with children under the age of 18 have incomes that are
below the poverty level.
Of the total number of single parent families with children under the age of 18, 32%
live on incomes that are below the poverty level.
14.6% of all school aged children are living in poverty.
The median family income is $49,569.
Per the 2000 Census Scope:
93.81% of the residents have legal residency.
Per the Colorado Department of Education Fall 2008 PK — 12 Free and Reduced Lunch by District
document
Of the PK — 12, enrollment (35,218 students) in Weld County School Districts and the
(5,706 students) of St Vrain RE -1J district, 42% (17,202 students) participate in the
Free and Reduced Meal program.
In comparison to the same report dated Fall 2007, the enrollment in Weld County
School Districts decreased by 430 students (from 35,648 students to 35,218 students)
however, the number of students who qualified and participated in the Free and
Reduced Meal program increased by 872 students. This is a 6% increase from 2007
school year.
The average cost of school supplies per child is $40.00 per year. This does not include the cost of the
calculator required by most high schools ($110.00 per student), the cost of a second back pack (average
$13.25/ back pack) that is recommended by most middle and high schools or replacing/replenishing
supplies throughout the year. Other costs to families that should be considered are lab fees and field trip
fees.
United Way's Responsibilities
1. Collaborate with the County to provide quality service to the identified clients.
2. Scheduling information sessions with every school district within Weld County.
3. Developing the funding to support the program.
4. Working with private businesses collecting the needed supplies.
5. Purchasing needed supplies.
6. Sort and package supplies by school district and specific schools based on "Free and Reduced
Meals" program.
7. Facility to have the supplies delivered.
8. Store, organize, and package the school supplies.
9. Coordinate the delivery of all school supplies with school districts.
10. Respond to requests for information in a timely manner.
County's Responsibilities
1. Collaborate with United Way School Supply Program to provide quality service to the identified
clients.
2. Agree to coordinate and share appropriate information with United Way School Supply Program
regarding the identified client as well as other agencies as needed.
3. Agree to contribute up to 93.81% of all funding up to $50,000 total from the County's Colorado
Works funds to support the 17,202 students receiving Free and Reduced meals and $1,500 for
overhead, salaries, fuel, rental equipment and signage. It is the intent of the County to only
provide school supplies to eligible Colorado Works families.
Term of the Agreement
The term of this agreement shall commence on June 1, 2009 and terminates on December 31, 2009.
Confidentiality Standard
United Way and the County shall comply with all applicable standards; rules and regulations regarding
confidentiality arid treatment of clients as such may be related to their responsibilities.
Termination of the Agreement
This Agreement may be terminated by United Way or by the County upon 30 days' written notice in the
event of the other party's failure to perform in accordance with the terms of this Agreement.
Assignment and Subcontracting
United Way is not obligated or liable under this agreement to any party other than the County named
herein.
Non -Discrimination In Employment and Service Delivery
The connection with the delivery of services under this Agreement, United Way agrees not to refuse to
hire, discharge, promote or demote, or to discriminate in matters of compensation against any person

otherwise qualified, solely because of race, creed, color, religion, sex, age, national origin, sexual
orientation or ancestry. United Way further agrees not to refuse services for any person otherwise eligible,
solely because of race, creed, color, religion, sex, age, national origin, sexual orientation, or ancestry.
Indemnity
The County shall defend, indemnify, and hold harmless United Way, its successors and assignees, and its
Directors, officers, agents, and employees against any and all losses or damages to property or injuries to
or death of any person or persons, including property and employees or agents of United Way and defend,
release, indemnify and save and hold harmless United Way from all claims, demands, suits, losses, and
expenses, direct, indirect, or consequential (including but not limited to fees and charges of attorneys and
other professionals and court costs), actions or proceedings of any kind or nature, including but not
limited to workers' compensation claims, resulting or arising from negligence or misconduct by the
County in the performance of this Agreement.
Insurance
During the term of this contract, and any extension(s) hereof, United Way agrees that it will keep in force
an insurance policy or policies, issued by a company authorized to do business in Colorado, in the kinds
and minimum amounts specified below. In the event of cancellation of any such coverage, United Way
shall immediately notify the County of such cancellation.
1. Standard Worker's Compensation and Employers' Liability as required by Colorado statute,
covering all employees on or off the work site, acting within the course and scope of their
employment.
2. General, Personal Injury, Professional, Automobile Liability (including bodily injury, personal
injury and property damage) with minimum coverage of:
• Occurrence basis policy: combined single limit of $1,000,000 or Claims -Made policy:
combined single limit of $1,000,000
• Annual Aggregate Limit policy: Not less than $3,000,000 plus agreement that the
contractor will purchase additional insurance to replenish the limit to $3,000,000 if
claims reduce the annual aggregate below $3,000,000.
Authority

This Agreement is upon execution a valid and binding obligation between United Way and the County,
and making and performance of which has been duly authorized by all necessary corporate or official or
other action, and will not constitute a violation of any law or requirement imposed by a judicial or arbitral
body or governmental instrumentality, nor the charter or by-laws of statute, ordinance or regulation
controlling United Way, nor a default under any agreement or instrument by which it is bound or affected.
Neither the making nor performance of this Agreement requires the consent or approval of any
governmental instrumentality nor, if such consent or approval is required, such has been obtained.
