RE: APPROVE EXTENSION CERTIFICATE FOR USE BY SPECIAL REVIEW PERMIT #966 -
WASTE MANAGEMENT OF COLORADO, DBA BUFFALO RIDGE LANDFILL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on October 14, 1992, the Weld County Board of Commissioners did approve
Use by Special Review Permit #966, for Waste Services Company, on the following described real
estate, to -wit:
Parts of Sections 2, and 3, Township 2 North, Range
64 West of 6th P.M., Weld County, Colorado
WHEREAS, on January 12, 1998, pursuant to certain Conditions of Approval, the Board
was presented with an Improvements Agreement According to Policy Regarding Collateral for
Improvements (Publicly Maintained Roads) between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, and East Weld Sanitary Landfill, dba
Buffalo Ridge Landfill, with terms and conditions being as stated in said agreement, and accepted
Guarantee Payment Bond #GP97-0504-OB from National Guaranty Insurance Company of
Vermont, 7 Burlington Square, 6th floor, Burlington, Vermont 05401, for an amount not to exceed
$187,000.00, and
WHEREAS, on December 6, 2004, the Board was presented with an Extension Certificate
for Guarantee Payment Bond #GP97-0504-OB from National Guaranty Insurance Company of
Vermont, 100 Bank Street, Suite 610, Burlington, Vermont 05401, for an increased amount, not to
exceed $242,000.00, and
WHEREAS, on March 2, 2009, the Board was presented with an additional Extension
Certificate for Guarantee Payment Bond #GP97-0504-OB for the current operator, Waste
Management of Colorado, Inc., dba Buffalo Ridge Landfill, from National Guaranty Insurance
Company of Vermont, for an increased amount, not to exceed $380,000.00, and
WHEREAS, pursuant to said Improvements Agreement, the Board has been presented with
an Extension Certificate for Guarantee Payment Bond #GP97-0504-OB from National Guaranty
Insurance Company of Vermont, effective for the period from December 9, 2009, to December 9,
2010, for $380,000.00, and

WHEREAS, after review, the Board deems it advisable to approve said Extension Certificate
as stated above, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Extension Certificate for Guarantee Payment Bond #GP97-0504-OB
for the current operator, Waste Management of Colorado, Inc., dba Buffalo Ridge Landfill, from
National Guaranty Insurance Company of Vermont, 100 Bank Street, Suite 610, Burlington,
Vermont 05401, in an amount not to exceed $380,000.00, be and hereby is, accepted.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by

Extension (#2009-0528)
I just received a phone message today (12/28/09) from Bill Hedberg/Waste Management Senior
District Manager stating that since the bond had already been extended, and even though Waste
Management will be over -bonded, to proceed with action required to have the BOCC approve the
extension. Next year when the bond extension expires, we will then be able to remove this
item from the collateral list.

Public Works has coordinated the overlay project of WCR 18 & 59 (2.5 miles) which was part of
the obligation of Waste Management as part of the above -mentioned USR and Bond.
Now is where it gets interesting:
1. Total Cost of the Project = $422,550.00 - Paid to Asphalt Specialties for paving by
Waste Management (USR-966) & A-1 Organics (USR-1285)
2. Upon passing final inspection(this week or next), a 1- year warranty period will begin.
3. A 15% warranty collateral will be required for the project during the warranty period.
($422,550.00 X 15% = $63,382.50 warranty collateral)
4. Proportional shares for the project for the two participants: (Waste Management = 40%)
(A-1 Organics = 60%)

5. Proportional costs for the warranty collateral for the two participants: (Waste
Management = $25,353.00) (A-i Organics = $38,029.50)
We should alert Waste Management that the bond (Doc.#2009-0528) for $380,000.00 needs to be
extended for one more year, but can be reduced to:
1. $63,382.50 if they want to cover A -1's proportional share of the warranty collateral
along with their own share.
2. $25,353.00 if they want to cover only Waste Management's share, in which case, A-1
Organics will have to provide their own collateral in the amount of $38,029.50
If you would like, I can attempt to contact representatives from Waste Management and see if
they have preferences.
