The following information is being forwarded to you to further justify the necessity to raise the Weld
Model Traffic Code Fine Schedule to the State's level.
The increase of the Fine Schedule by the State Legislators that became effective in July of 2008 was a
long time coming. It has been over 13 years since the State Traffic Fine Schedule had been increased;
in 2008 legislators felt the need to give enforcement behavior changing penalties, instead of just being
a nuisance to drivers.
The 2008 CRS Title 42 increases in fines targeted improper/reckless/careless violations, passing
violations, right-of-way violations, seat belt violations, speed violations, traffic control violations and
turning violations. These violations are closely associated with crash causal factors, which are the
primary errors causing crashes. Crashes investigated in Weld County have associated causal factors
assigned to them; and the three predominant crash causal factors in Weld are: impaired driving (DUI),
speed and inattentiveness to driving. The three main contributing factors relating to Weld's traffic
fatalities are: no seat belts, alcohol and speed.
As indicated in Attachment 1, the number of crashes in recent years that occur on county roads are
only slightly lower compared to those that occur on State Highways. The attached Weld County GIS
maps (Attachments 2-4) indicate that a majority of the crash hotspots in Weld occur on the major roads
that are highly travelled during morning and evening commuter hours. The maps also show all of
Weld's crash hotspots, as well as the DUI crash hotspots.
Attachments 5 are the annual Road Fatalities Maps that were published in the Greeley Tribune for the
last 5 years. These media accounts are some of the only published accounts of our traffic problems to
form public opinion. Plus, the media routinely emphasizes the fatal (body) count on Weld's roads.
A synopsis of Attachments 6 (2008 Colorado Department of Transportation Problem Analysis),
indicates that since our record breaking year of 2004, there has been a decrease in fatal traffic crashes
in Weld. However, the two year state average ranks Weld County as the deadliest. It lists the #1
factor for our fatal crashes as "unbelted," "alcohol," and "speed." It further indicates that 40% of our
crashes were alcohol related and close to 33% as speed related. This analysis also indicates that 73%
of the fatal crashes occurred in unincorporated areas.

Attachment 7 is the Weld County portion of the 2008 CDOT Problem Identification Report
which utilizes 2004 data for its report. (The entire report can be electronically forwarded to
those who would like the entire 47 page report.) This report indicates that Weld County has the
4th highest economic cost ($1,343,540) per capita of injury and fatal crashes of all counties in
Colorado. This report also indicates that progress has been made in the area of occupant
protection and lists Weld County with a 77% compliant in seat belt usage. This report also
includes Weld County's demographic traffic information.
As the attached information indicates, there is a staggering problem with all types of traffic
crashes (property damage, injury and fatal). The economic impact is also concerning since Weld
is ranked in the top five counties.
It is our recommendation that Weld County's Model Traffic Code Fine Schedule mirror the level
of the State's Fine Schedule. This would not only provide consistency for both the Weld County
Sheriffs Office and the Colorado State Patrol in enforcing the same laws on our roadways, but
would also give violators the same impact for their behavior, no matter which agency enforces
the law. The fines that are being considered to be raised all target driving behaviors that relate to
a majority of the crashes that occur in Weld County.
The only way law enforcement can make an impact in reducing traffic crashes and roadway
fatalities is to change driving behavior. This can only be accomplished by traffic violation
penalties having a strong and direct impact on the violator's driving habits. Prior to last year's
fine increase, the Colorado State Patrol surveyed surrounding states with higher fine schedules,
which indicated that higher fines reduced traffic crashes/injuries/fatalities. We are only asking
that our Model Traffic Code has the same impact on violators as that of the State of Colorado.

The geo phic distribution of Colorado fatalities are skewed towards 11 counties (Weld,
Denver, ams, El Paso, Jefferson, Arapahoe, Larimer, Douglas, Boulder, Mesa, and Pueblo).
Alcohol, speed, nighttime, and occupant protection are major factors in Colorado fatalities.
About 15% of all fatalities are to motorcycle riders.

In the period 2004-2006, the County of Weld had 173 fatalities (9.6% of all fatalities in the
state). Most fatalities (66%) were front seat occupants of passenger vehicles, and 40% of all
fatalities were unbelted front seat occupants. Alcohol -related fatalities accounted for 40% of all
fatalities and speed -related fatalities accounted for 33%. Crashes occurring in the nighttime
(between 9 p.m. and 5:59 a.m.) accounted for 29% of all fatalities. Eight child passengers age 12
and under were killed in Weld County. The data for various types of crashes and victims are
presented in the tables below:

Traffic Safety Characteristics to Consider
Overall
✓ Almost three-quarters of the 173 fatalities (73%) occurred in unincorporated areas.
o One-third of them (33%) were in speed -related crashes.
o There were 32 distracted -driver fatalities; 82% were outside of city limits.
o All but one of the county's drowsy -driver fatalities (6 of 7) occurred in
unincorporated areas.
✓ Greeley was the scene of more than one -eighth (13%) of Weld County fatalities (23).
o 43% of them were in speed -related crashes.
o In Greeley, 61% of the fatalities were on the weekend (6 p.m. Friday — 5:59
a.m. Monday; 54%), vs. 38% for the entire county.
o Greeley had fewer night fatalities (22%) than the county as a whole (30%).
o Three of the county's 10 pedestrian fatalities occurred in Greeley; the rest
were in unincorporated areas.
✓ The next concentrations of traffic fatalities were in Windsor (5; 3%) and Evans,
Fort Lupton, and Mead (4; 2% each); no other city had more than two.
✓ Fatalities in Weld County were highest in May (12%) and July (12%), with values
for other months ranging from 5% to nearly 10%. Fatalities were nearly evenly
distributed by day of week except for Saturday, with 18%.
✓ 74% of the fatalities were on rural roads, with all functional categories, from
expressways to local roads, well represented.
✓ 51% of fatalities occurred in the daylight; 40% occurred at night, and 9% at dawn
or dusk.
✓ Fatalities were widely distributed by age, with 20% between 35-44 years old, 15%
25-34, 16% 45-54, 13% 16-20, 15% 21-24, and 10% 55-64. Just 7.5% were 15 or
younger, 6% age 65+.
✓ Nearly three -fourths (72%) of the Weld County fatalities were male.

2008 Problem Identification
The Colorado Department of Transpor-
tation, Office of Transportation Safety
(OTS) contracted with the University of
Colorado to prepare the FY2008 Problem
Identification report. Dr. Jeffrey Zax was
the Principle Investigator and was assist-
ed by subcontractors Dr. Naci Mocan of
Louisiana State University, Jennifer Garner
of Garner Insight LLC and Glissen Rhode
of Glissen, LLC.
Purpose and Objective
-1'he OTS is tasked with developing be-
havioral and enforcement -based programs
that will improve traffic safety in Colorado
by reducing the number and severity of
traffic crashes. The O1S's programs target
specific high -risk driving behaviors. In or-
der to direct limited resources to the areas
of greatest need, the OTS relies on the
analysis of crash and other traffic data.
In traditional examinations of driver char-
acteristics and crash involvement, factors
such as age of driver, seat belt use and im-
pairment are often examined. In addition
to these descriptive statistics (e.g., cross -
tabulations), this report includes results
of an ordered probit model (for details,
see the Technical Appendix) using cita-
tion records to predict the likelihood that
a driver will be involved in a crash. The
ordered probit model allows individual
factors that may increase the probability
of crash involvement, such as age, citation
history, etc. to be examined while control-
ling for all other factors.
Selected Results
In Colorado in 2004, 667 people died in
traffic crashes and another 45,407 were
injured. Nearly 100,000 (97,528) crashes
were property -damage only (PDO). Using
economic cost estimates developed by the
National Safety Council, injury and fatal
crashes cost Colorado nearly $2.5 billion
in 2004. Exhibit 1 shows the distribution
of costs across the State and Exhibit 2 on
the following page presents the economic
loss per capita resulting from injury and
fatal crashes for the ten worst Colorado
counties.

Mineral County had the highest per capita
cost of injury and fatal crashes among
Colorado's 64 counties. Four of the coun-
ties with the greatest economic cost are lo-
cated on the Eastern Plains. Adams Coun-
ty is the most populous county in the top
ten, with more than 300,000 residents.
Overall Crash Odds
Exhibit 3 presents the probability that
a driver will be in a crash, based on the
driver's county of residence. (This data is
derived from the ordered probit model.)
The table shows how the risk of crash-
ing would change if the same individual
moved from one of these counties to an-
other. Drivers from Elbert County have
the highest probability of being involved
in a crash, controlling for all other factors.
Adams and Pueblo counties rank 2nd and
3rd (Exhibit 3).
The counties whose licensed drivers have
the lowest probability of crash involve-
ment include both Eastern Plains and
mountain communities.

Young Drivers
In an analysis of the odds that a young
driver (under age 21) would be involved in
a crash by zip code of residence, all but one
of the top ten most dangerous zip codes
were in either Pueblo County or Adams
County, as shown in Exhibit 4. (Zip codes
were limited to the 129 zip codes with at
least 1,000 licensed drivers under age 21.)
The zip codes where young drivers had
the lowest odds of crashing were spread
across the state and included two of the
state's largest college towns: Boulder and
Fort Collins
Impaired Drivers
After controlling for all other factors, the
combination of county of residence and
prior DUI records increases the likelihood
that a driver is involved in a crash. Exhibit
5 shows the ten worst counties, measured
by the increase in odds of a crash when
drivers have one or two -to -three DUIs on
their citation record. Not surprisingly; Pue-
blo County leads the pack. Interestingly,
Elbert County ranks second.

Occupant Protection
As shown in Exhibit 6, among large coun-
ties with scat belt use below the state average
(81.1%), Pueblo, Adams and Weld coun-
ties are obvious areas for improvement.
Recommendations
Based on the results of the ordered probit
model, the analysis of the 2004 crash data
and the 2007 Annual Seat Belt Survey; the
study team recommends that the Safety and
Traffic Engineering Branch consider devel-
oping, supporting or expanding traffic safe-
ty programs in the following communities:
• Adams County
• Pueblo County
• Elbert County
• Yuma County
Adams County. Adams County needs a
comprehensive traffic safety program that
includes components addressing impaired
driving, occupant protection and young
drivers. It is imperative that the program

not solely address young drivers, but adults
as well. The program should include com-
munity -based social marketing efforts and
education as well as law enforcement fo-
cused on seat belts and impaired driving. It
is important to note that more information
is needed to refine the target audiences for
programs in Adams County. For example,
if local seat belt surveys could be con-
ducted, the program partners would have
a better sense of the demographics of Ad-
ams County drivers who do not use seat
belts (e.g., age, race/ethnicity, vehicle type)
as well as the parts of the County where
drivers are least likely to use seat belts (e.g.,
urban vs. rural).
Elbert County. Elbert County's biggest
problem, according to the data, is that El-
bert County licensed drivers have the high-
est odds of being involved in a crash, com-
pared to all other counties. Elbert also has
a disproportionately high cost per capita
of injury and fatal crashes. The model esti-
mates that Elbert County drivers with one
DUI record are 6°/o more likely to be in -

volved in a crash — the second highest rate
among all 64 counties. Low seat belt use is
assumed because Elbert County is located
on the Eastern Plains, which traditionally
has low seat belt use. If a comprehensive
program is initiated in Elbert County, an
observational seat belt survey should be a
component to both assess overall seat belt
use and set a baseline for future reference.
Pueblo County. Pueblo County needs a
comprehensive traffic safety program that
addresses adult impaired drivers, occupant
protection and young drivers. It is impor-
tant that young driver programs include all
drivers age 21 and younger, not just those
still in high school. Community -based
programs should reach out to community
colleges and large employers of younger
workers. It is also important that adults be
included in the impaired driving and occu-
pant protection efforts and that both com-
munity outreach as well as enforcement
are components of thc program. More in-
formation is needed to refine the target au-
diences for programs. For example, what
types of Pueblo residents were not using
their seat belts when the statewide survey
was conducted?
Yuma County. Among Eastern Plains coun-
ties, Yuma County has the third highest
economic cost of injury and fatal crashes
per capita. Because Yuma County has one
of the larger driving age populations on
the Eastern Plains, Yuma County may be a
good location to pilot a community -based
occupant protection program tailored to
the values and experiences of Eastern
Plains communities. If the program is suc-
cessful, it should be expanded to the other
Eastern Plains communities. A seat belt
survey should be conducted prior to in-
vesting significantly in a seat belt program
to confirm the strong suspicion that scat
belt use is a problem in Yuma County.
Data Needed
Occupant Protection Data. The analyses
of occupant protection, in particular, are
limited by the accuracy of available data.
The Annual Seat Belt Survey conducted by
Colorado State University represents the
best and most reliable point -in -time data
on seat belt use statewide. In FY2007, the
survey was expanded to include additional
observations of seat belt use by racial and
ethnic minorities. The study team would
recommend that, if dollars are available,
the survey include a supplemental compo-
nent featuring observations in more than
25 counties, particularly on the Eastern
Plains where seat belt use traditionally lags
the Front Range. It would also be valu-
able for the data collected on children and
young adults to be reported on the county -
level, in addition to the currently available
statewide estimate.
Although occupant protection data col-
lected as part of fatal and severe crash
investigations is more accurate, thc very
small number of such crashes, particularly
in small counties, makes the scat belt data
impossible to accurately interpret. Basing
a small county's estimates of scat belt use,
for example, on the small number of severe
injury and fatal crashes would be invalid.
Original Citation File. The ordered probit
model estimated the probability of crash-
ing using a wide array of data from the Mo-
tor Vehicle Division. Chief among these
databases is the adjudicated citation file. If
possible to obtain, the original citation file
in addition to adjudicated citations would
provide a rich dataset and would allow the
study team to vastly expand its analyses.

Current Crash Data. Obviously, more cur-
rent crash data is needed for the analyses
to have improved relevance for program
development and selection.
Recommended Analytical Focus for
FY2009
The study team recommends that future
Problem Identification reports continue
to emphasize place -based analyses and
expand those analyses whenever possible.
With sufficient time for data collection,
cleaning and analysis, we believe that the
model can be expanded to include de-
mographic data on the census tract level,
as well as sub -analyses such as looking at
the impact of recent citations or address
changes by county.
