The property line and the USR boundary line still look like the same line weight — maybe a little heavier but hard
to tell. Please make the USR boundary line heavier. The USR boundary should also include the access roads.
Other than that change it all appears to okay.
Just make sure that it is 24x36 in size.

I have reviewed the plat drawing dated 12/9/2007 provided by J. L. Walter Consulting.
The plat now indicates the items Public Works requested under Item E numbers I, ii, and iii: tracking pad, 30 -
foot temporary and permanent access road widths, and rights -of -way and easements to the facility.
Weld County Public Works recommends and supports the recording of this plat.

7) Bottled water shall be utilized for drinking and hand washing during
drilling/construction.
8) If applicable, the applicant shall obtain a stormwater discharge permit
from the Colorado Department of Public Health and Environment, Water
Quality Control Division.
9) The operation shall comply with all applicable rules and regulations of
the State and Federal agencies and the Weld County Code.
C. The Town of Mead's recommendation to revise the location of access roads was
taken under advisement and KMG has determined that no change is necessary to
adequately accommodate all interested parties. Temporary construction access is
from an existing single track across agrarian fields directly South of CR 28 to the
drill site. Permanent access is planned on roads off of CR 9.5 at a point directly
Southwest of the drill site. The permanent access road is West of the nearby
elementary school, which would circumvent potential conflicts with school children
and school buses. Attached please find the revised site plan map which identifies
construction and permanent access locations.

Below are the items that are still remaining for the following cases.

Two sets of paper plats have been submitted and reviewed but the changes were not made to the plat
The changes were —

3. show the full access from Lake Catamount Parkway
4. show the gates for access to the facility (on the north and south side)
5. increase the scale of the map so 1 "=60' to make it easier to read

This letter serves as Kerr-McGee Oil and Gas OnShore LP's ("ICMG") official response
to the resolution approved by the Weld County Board of County Commissioners on Use -by -
Special Review #1653. Attached please find a copy of the approved resolution for your
reference.
1. Prior to recording the plat:
A. The Mountain View Fire Protection District has reviewed and approved the Fire
and Emergency Response Plan submitted to the District by KMG and has no
objection to the drilling of the wells referenced above. KMG will comply with all
applicable codes and standards mentioned in the Fire Protection District's referral
letter dated April 10, 2008. Additionally, this letter has been forwarded as a part of
Use -by -Special Review #1653. Another copy has been attached for your
convenience.
B. The plat has been amended to delineate the following items that the Weld County
Board required: Attachment of the Development Standards, that the plat shall
comply to section 23-2-260.D of the Weld County Code, and a tracking pad shall be
placed at the access location onto Piedra River Road and County Road 28.

KMG has submitted two (2) paper copies of the plat for preliminary approval.
Attached find the finalized Mylar plat Weld County has requested.
C. KMG will furnish the Department of Planning services with a digital/electronic
copy of the Use -by -Special Review in one of the acceptable formats requested by

Sorry it has taken me a bit to respond to the mylars that were dropped off last week. Prior to recording the mylars
for both cases the conditions of approval need to be completed.
In regards to USR-1666 the following items need to be completed prior to recording the mylar.
1. Prior to recording the plat:
A. The plat shall be amended to delineate the following:
1. The plat shall be prepared per Section 23-2-260.D of the Weld County Code. (Department of
Planning Services)
1. 2. All Sheets of the plat shall be labeled USR-1666. (Department of Planning
Services)
2. 3. The attached Development Standards. (Department of Planning Services)
4. The applicant shall provide a paved tracking control pad at the entrance location that
extends from County Road 7.5 a minimum of 100 feet down the access road. At the end
of the pavement, the applicant shall install two cattle guards back to back. (Department
of Public Works)
5. The access road shall be shown as a 30 foot recorded easement. (Department of Public
Works)
B. The applicant shall address the concerns of the Department of Public Works as outlined in their
referral dated July 30, 2008. Written evidence of approval by the Department of Public Works
shall be submitted in writing to the Department of Planning Services. (Department of Public

C. The applicant shall address the concerns of the State of Colorado Department of Transportation,

The Planning Department and Public Works will review the draft paper copies and provide comments back
regarding them. If no changes are recommended than most likely the existing mylars in my office can be utilized.
The mylars will need to be signed by the property owner. There is also an eleven dollar fee for recording for each
mylar that will need to be submitted.

Dear Mr. Spencer:
On October 8, 2008 for USR-1664 and USR-1664 and on July 9, 2008 for USR-1653 your applications for
a Use by Special Review for Oil and Gas Production Facilities in a PUD Zone District were approved by
the Board of County Commissioners with specific Conditions of Approval.
One of the Conditions of Approval grants applicants sixty (60) days to submit a Mylar Plat.
I am aware of the difficulty and associated delays in meeting the conditions of approval normally
associated with land use cases, and I'm willing to work with you in completing your application. Please
notify me, in writing, within 10 working days of your status.

Sorry it has taken me a bit to respond to the mylars that were dropped off last week. Prior to recording the mylars
for both cases the conditions of approval need to be completed.
In regards to USR-1666 the following items need to be completed prior to recording the mylar.
1. Prior to recording the plat:
A. The plat shall be amended to delineate the following:
1. The plat shall be prepared per Section 23-2-260.D of the Weld County Code.

2. All Sheets of the plat shall be labeled USR-1666. (Department of Planning Services)
3. The attached Development Standards. (Department of Planning Services)
4. The applicant shall provide a paved tracking control pad at the entrance location that
extends from County Road 7.5 a minimum of 100 feet down the access road. At the end
of the pavement, the applicant shall install two cattle guards back to back. (Department
of Public Works)
5. The access road shall be shown as a 30 foot recorded easement. (Department of Public
Works)
B. The applicant shall address the concerns of the Department of Public Works as outlined in their
referral dated July 30, 2008. Written evidence of approval by the Department of Public Works
shall be submitted in writing to the Department of Planning Services. (Department of Public

C. The applicant shall address the concerns of the State of Colorado Department of Transportation,
as outlined in their referral dated July 16, 2008. Written evidence of approval shall be submitted
to the Department of Planning Services. (Department of Planning Services)
D. The applicant shall address the concerns of the Department of the Army, Corps of Engineers, as
outlined in their referral dated July 17, 2008. Written evidence of approval shall be submitted to
the Department of Planning Services. (Department of Planning Services)
E. The applicant shall address the concerns of the State of Colorado Division of Wildlife, as outlined
in their referral dated August 9, 2008. Written evidence of approval shall be submitted to the
Department of Planning Services. (Department of Planning Services)
F. The applicant shall submit written evidence to the Department of Planning Services that the
access width requirements for emergency equipment have been met from the Mountain View Fire
Protection District. (Department of Planning Services)
G. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld
County Department of Planning Services. (Department of Planning Services)
2. Upon completion of 1. above the applicant shall submit a Mylar plat along with all other documentation
required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County
Clerk and Recorder by Department of Planning Services= Staff. The plat shall be prepared in accordance
with the requirements of Section 23-2-260.D of the Weld County Code. The Mylar plat and additional
requirements shall be submitted within thirty (30) days from the date of the Board of County
Commissioners resolution. The applicant shall be responsible for paying the recording fee. (Department
of Planning Services)

Works a letter from the Mountain View Fire Protection District stating that the accesses to the site
meet the width and weight capacity for emergency purposes. (Departments of Planning Services

B. The plat shall be amended to delineate the following:
1. The attached Development Standards. (Department of Planning Services)
2. The plat shall comply with Section 23-2-260.D of the Weld County Code. (Department of
Planning Services)
3. A tracking pad shall be placed at the access location onto Piedra River Road and
County Road 28. (Department of Public Services)
C. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld
County Department of Planning Services. (Department of Planning Services)
2. Prior to Construction:
A. The applicant shall contact the Weld County Public Works Department to obtain the necessary
moving permits associated with oil and gas drilling. (Department of Public Works)
3. Upon completion of 1. above the applicant shall submit a Mylar plat along with all other documentation
required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County
Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance
with the requirements of Section 23-2-260.D of the Weld County Code. The Mylar plat and additional
requirements shall be submitted within thirty (30) days from the date of the Board of County
Commissioners resolution. The applicant shall be responsible for paying the recording fee. (Department

The Planning Department and Public Works will review the draft paper copies and provide comments back
regarding them. If no changes are recommended than most likely the existing mylars in my office can be utilized.
The mylars will need to be signed by the property owner. There is also an eleven dollar fee for recording for each
mylar that will need to be submitted.
