WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 9th day of April, 1979 at the hour of 9 : 00 o 'clock a.m. for the purpose of hearing the application of Tri-State Generation and Transmission Association for the granting of a Conditional Use Permit for a microwave tower and electronics shelter building on the following described real estate, to-wit: A parcel of land in the Northeast Quarter of Section 6, Township 7 North, Range 66 West, 6th P.M. , Weld County, Colorado, being more particularly described as follows: Beginning at the Northeast corner of said parcel of land, said Northeast corner being South 18O44'30" West 2470.01 feet fran the Northeast corner of said Section 6; Thence South 88°32'13" West 200 feet to a set 5/8" iron rod; Thence South 01°27'47" East 200 feet to a set 5/8" iron rod; Thence North 88°32'13" East 200 feet to a set 5/8" iron rod; Thence North 01°27'47" West 200 feet to the point of beginning; said point being a set 5/8" iron rod. The above described parcel contains 0.918 acres more or less. WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the granting of the Conditional Use Permit for a microwave tower and electronics shelter building, and WHEREAS, Section 3. 3 .D of the Weld County Zoning Resolution authorizes such a use in an Agricultural District on the granting of a Conditional Use Permit by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Conditional Use Permit for a microwave tower and electronics shelter building on the herein- above described real estate complies with all of the conditions as set out in Section 3. 3.D. (2) of the Weld County Zoning Resolu- tion. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis- sioners of Weld County, Colorado that the application of Tri-State Generation and Transmission Association for a Conditional Use Per- mit for a microwave tower and electronics shelter building on the hereinabove described tract of land be, and hereby is, granted subject to the development standards contained in the Conditional Use Permit. NF4, Section 6, T7N, R66W LOCATION: 4 miles west and 1Z mile north of the Town of Ault SUBJECT: Microwave Tower Site APPEARANCE : Frank Niesen DISCUSSION: Mr. Niesen stated that Tri-State is a non-profit corporatio owned by 25 REA' s in the states of Colorado, Wyoming and Nebraska. They generate, purchase and transmit power to local REA' s which in turn transmit and sell to the individual homeowners and businesses . As part of their long-range planning they have designed and hope to build a private microwave system consisting of 32 towers in the three-state area. This 100 ' tower is part of that system. It will receive and transmit a microwave signal between similar facilities . The application has FCC and FAA approval and will pose no danger to humans or animals and will not interfere with radio and television reception. There bein no questions at this time, Tom Honn read the staff ' s recommendation for approval and the Development Standards . Mrs . White then asked how much traffic would be generated around the site. Mr. Niesen responded that traffic would be very minimal as there would be only 6 - 8 vists to the site per year for maintenance purposes . Mrs . White indicated she saw n problem with it upon her site review of the proposal . MOTION: Be it therefore resolved to recommend approval with the Development Standards to the Board of County Commissioners based on th staff' s recommendation. Motion by Jerry Kiefer, seconded by Bette Kountz. A vote of "aye" was cast by Percy Hiatt, Jerry Kiefer, Frank Suckla, Irma White, Bette Kountz, and Chuck Carlson. Motion carried. At this time Tom Honn read the staff' s recouuuendation for continuing the application to the April 17 , 1979 meeting. The concern at this time is basically with the drainage on the property. The Little Thompson Ditch is located south of the proposed site and has a history of flooding and run-off. This is of concern to the School District and the Engineering Department. Mr. Hiatt commented that this is a problem and could possibly be solved by berming around the area. Discussion followed. MOTION: Be it therefore resolved to continue the application to the April 17 , 1979 Planning Commission meeting based on the staff' s recouuuendation. Motion by Jerry Kiefer, seconded by Percy Hiatt. Highway 34 Bypass SUBJECT: Final Plat - Peterson/Alexander Subdivision APPEARANCE: Harlan Stientjes DISCUSSION: Mr. Stientjes stated that the final plat has not changed since the preliminary plan was presented to the Planning Commission. He was aware of several conditions by the Planning Staff that must be accomplished prior to recording the final plat in their recommendation. One of the conditions was the matter of a variance. Mr. Stientjes requested that this be withdrawn. There was also the matter of the applicant paying a fee for public sites and/or open spaces . The Alexander ' s presently reside on Lot 4 and have already paid $200 for the park fee and requested that this amount be deducted from the original fee which was in the amount of $1,834. 00. There being no questions at this time, Tom Honn read the staff' s recommendation for approval . Tom indicated he was not aware of the $200 previously paid by the Alexander ' s , but that this would be resolved at the County Couuuissioners hearing. MOTION: Be it therefore resolved to recommend approval to the Board of County Couuuissioners with the condition that the original amount of $1, 834. 00 for the park fee be reduced $200 as this amount has already been paid by the owners of Lot 4. NE4 NE4, Section 15, T2N, R68W LOCATION: 1 mile south of Colorado Highway 119 on the west side of 1-25, directly south of Del Camino Mobile Home Park SUBJECT: Preliminary Plan - 1-25 Subdivision Planning Commission M4.nutes • Page 3 April 3 , 1979 DISCUSSION: This proposed commercial subdivision is on 72 . 94 acres of property with 23 lots proposed. The preliminary plan was presented and reviewed by the Weld County Utilities Advisory Committee on March 29. The application was tabled for revisions on the plat. Bill Shade, attorney representing the applicants, stated that he does not agree with the Planning Staff in delaying this request any longer because of the Utility Board tabling decision and also because these are minor problems ' that can be worked out. He also mentioned that there is a 30 ' access easement along the north side of the property running the entire length of the property which belongs to the Camenishes . Plans are to take part of the easement and overlay it iwth a public street. He said this would in no way involve the Camenishes or be of concern to them. This should be a matter for the County Attorney to advise the Board of County Commissioners in this regard. Tom Honn then responded that the Planning Staff did not have adequate time to fully consider and review the proposal which is another reason for the requested delay in making a decision. The concerns of the Highway Department and the Engineering Department must also be considered before a final decision is made by the Planning Staff. He then read the staff' s recommendation for continuing the preliminary plan to April 17 , 1979 and approval of the Unit Development plan. He stated that this is a Unit Development which was left off the AGenda. Discussion followed. The subject was then brought up by Frank Suckla regarding the water table. Virginia Jaskot, water engineer, explained that an evapotranspiration system will be used, but it is not exactly known at this time the types and what size uses will be needed. Mr. Gilbert asked if the concerns of the Longmont Fire Protection District have been addressed. Mrs . Jaskot responded that they have seen the revised plan with the fire hydrants relocated. Discussion followed regarding the access easement. Mr. Camenish, land owner to the west and also owner of the access easement, stated that he was not notified of the proposal regarding the easement until the day before the Planning Commission hearing. He also has never seen any drainage plans, etc. and not well informed regarding the proposal. Mr. Shade responded that it does not disturb their access and they have no right to interfere with this development. Mr. Camenish was also concerned with the waste water disposal . Jim Westerfelt, potential purchaser of property, stated he did not like the delay as the County has had enough time to iron things out. MOTION: Be it therefore resolved to continue the hearing to the April 17 , 1979 Planning Commission hearing based on the staff ' s recommendation for the preliminary plan. SE4 NWk, Section 30, T5N, R65W LOCATION: Adiacent to the west perimeter on the north side of 42nd Street SUBJECT: Change of Zone from "A" to "C" APPEARANCE : Sam Telep DISCUSSION: Mr. Telep stated that the Arguello ' s desire to have a commercial operation for a shop and office for their curb, gutter and sidewalk company. He briefly told the Planning Commission what is surrounding the proposal. There being no questions at this time, Tom Honn read the staff' s recommendation for approval of the request. Mr. Telep then commented that there will be 30 on each side of the property line for a road should the necessity arise in the future. There were no further comments or questions . MOTION: Be it therefore resolved to recommend approval based on the staff' s recommendation to the Board of County Commissioners . Motion by Percy Hiatt, seconded by Jerry Kiefer. APPLICANT: Platte River Power Authority CASE NUMBER: SUP-380: 79 :2 LOCATION: 16 miles long from 8 miles west of Nunn and 22 miles north of Windsor to 6 miles north of Windsor near Black Hollow Reservoir SUBJECT: Transmission Line APPEARANCE : Brian Blakely, attorney; Bill Slimak, Director of Engineering; Herb Shaw, EDAW, Inc. DISCUSSION: Mr. Blakely first stated that the four cities of Fort Collins, Estes Park, Loveland and Longmont have obtained their electrical power from the Federal government. This invovled hydroelectric power. These cities were informed by the Bureau that there would soon be no more hydrelectric projects and that the demands would run out in late 1977 . The four cities then formed Platte River Power Authority. M He then discussed the process of how they are now coming before the Planning Commission in regard to meetings, etc. they have presented' to Larimer County. Bill Slimak explained how the transmission line is to be constructed by the use of a map. Tom Keith, Environmental Planner, presented a slide presentation showing where the line would be located of both the County Line Route and the preferred route which also showed residences which expressed concern of the County Line Route. Tom Honn then read the staff' s recommendation for the County Line Route and the Development Standards. Herb Shaw then commented on three items of concern regarding the staff' s recommendation. His first comment was that of the impact on agricultural ground which the Planning Staff said would affect 607 of the agricultural ground. He felt this figure was too high when comparing the two routes. He also commented on the regional aesthetics regarding the view of the line in Weld County. He also felt there will be a great deal of impact on Black Hollow Reservoir which would be a major disadvantage. Dicussion then followed on moving the pole ' Planning Couuuissior Lnutes Page 5 April 3 , 1979 structures east 200 ' to 300 ' to where they would be behind the residences on the east rather than on the west iunuiediately adjacent to the road right-of-way and the alternative routes which could be taken for the line. The Chairman then opened the discussion to audience participation. At this time Leonard Anderson expressed his concern regarding the amount of agricultural land it crosses and how this line could create a real problem for aerial sprayers. He does not feel the line benefits Weld County; Robert Moser said that no mention had been made that the line will go through a subdivision and affect nine homes . He also commented his land is worth too much to him and would rather have it condemned. Wayne Foster stated he prefers the County Line Route. Jose Base expressed opposition to the County Line Route and does not want the transmission line at all and also would decrease the property values; Roger Vermeer was opposed to the County Route. Bob Barnes was in favor of the County Line Route. MOTION: Be it therefore resolved to recouuuend approval for the County Line Route based on the staff ' s recouiuiendation. Motion by Jerry Kiefer, seconded by Fred Otis. A vote of "aye" was cast by Percy Hiatt, Fred Otis, Jerry Kiefer, Bette Kountz, and Chuck Carlson. A vote of "no" was cast by Jim Gilbert and Frank Suckla. Motion carried. Repeal of Section VIII of the Weld County Zoning Resolution and Adoption of new Section 80 entitled "Amendments to the Zoning Resolution" This section was presented to the members of the Planning Commission on January 2, 1979, but was not adopted at that time. Ken McWilliams , Senior Planner, and Thom Rounds, Planner, again presented it this date for adoption. Thom Rounds briefly outlined and discussed the content of each proposed section. A minor change was made regarding prior notification of the hearing date from ten to fifteen days prior to the scheduled hearing by the Planning Couuuission. General discussion followed. MOTION: Be iththerefore resolved to recommend approval to the Board of County Commissioners . Motion by Jerry Kiefer, seconded by Bette Kountz. It is the opinion of the Department of Planning Services staff that this request is in agreement with the Weld County Comprehensive Plan in that the proposed use would not appear to have any adverse impacts on the agricultural interests of the county or the environment. 2. It is the opinion of the Department of Planning Services staff that this request is in compliance with the provisions of Section 3 .3 .D. (2) of the Weld County Zoning Resolution which states : "The Planning Commission and Board of County Commissioners shall consider the following in making their determination in approving or denying a Conditional Use Permit : Com- patibility with the surrounding area, harmony with the character of the neighbor- hood and existing agricultural uses, need for the proposed use, its effect upon the iuuuediate area, its effect on the future development of the area and the health, safety and welfare of the inhabitants of the area and the County. " This determination is based, in part, upon the following : A. The following referral entities have reviewed this request and have set forth no objections to it : 1. Weld County Health Department 2. Weld County Engineering Department 3 . Western Area Power Administration, Department of Energy B. The Colorado Geological Survey has reviewed the request and has no objections providing subsurface conditions Tri-State CUP-44:79 :4 PLANNING STAFF RECOMMENDATION April 3 , 1979 in excavations be evaluated by qualified personnel to determine if adverse soil conditions are present and to assure proper foundation design for all new structures . C. The West Greeley District of the Soil Conservation Service has reviewed this request and has no objections providing any disturbed portion of the site be gravelled or revegetated with an adapted grass species to reduce the high susceptibility to wind erosion characteristic of this soil type. The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems . 6. All construction, electrical work and fabrication shall be done in accordance with the Weld County Building Code. 7 . The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 8 . The Conditional Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations . Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Conditional Use Permit by the Planning Commission and Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Our construction and engineering department has built similar structures on the type of soil found at this site. It is our experience that the soil has adequate bearing capacity for the tower and building anticipated to be built and that borings need not be taken. In the event that unusual subsurface conditions are encountered during excava- tion for footers, we will have random borings taken and submit a report to your office. 4. The proposed use of the property will be for erection of a one hundred ten foot (110' ) guyed tower bearing three microwave dishes and an electronics shelter building housing radio and microwave equipment. The operation of the facility will be unmanned and automatic. The communication facility is part of a system extending through the states of Colorado, Wyoming and Nebraska and functions as the primary communication and automated switching control for the Tri-State power supply network serving twenty-five REA's in the three state area (Exhibit C) . This particular facility will receive and transmit a microwave radio signal between similar facilities at the Bald Mountain, Colorado Substation and the State Line, Colorado Substation. The microwave facilities are in turn trans- ' mitting and receiving to other microwave facilities in the network. Both power density and electro- magnetic field density are substantially less than recommended federal limits. The facility will produce no air or water pollution, odor, noise, glare fire or safety hazard or traffic congestion. FAA approval has been given for this facility (Exhibit D) . An application for FCC approval has been submitted and approval is expected. Since the facility is automatic, once construction is completed, traffic into the site will be minimal . We anticipate that our maintenance crew will visit the site about six times every year. 5. Since the facility is unmanned, and only visited for repair and maintenance, water and sanitary facilities are not required. There will be no well or septic tank. 6. Access to the facility will be by private road as shown on Exhibit E. Since traffic will be minimal , the road will not be improved except for placement of gravel as needed. 7. There is no housing, commercial or industrial development within five hundred feet of the facility, with the exception of an electrical substation operated by the Western Area Power Administration, who uses the undeveloped land for grazing of cattle. 9. It formed in mixed outwash deposits. Limm, .0 Included in this unit are some soils with dark surface layers. Also included were some soils with sandstone and shale above 60 inches. Typically the surface layer is grayish brown fine sandy loam about 8 inches thick. The subsoil is yellowish brown to very pale brown fine sandy clay loam about 12 inches thick. The substratum, to a depth of P 60 inches, is calcareous fine sandy loam. Permeability is moderate. Available water capacity is moderate. Effec- tive rooting depth is 60 inches or more. Surface runoff is medium and erosion hazard is low. Where irrigated this soil is suited to the commonly grown crops in the area. However, perennial grasses and alfalfa or close grown crops should be grown at least 50 percent of the time. Close grown crops and pasture can be irrigated with contour ditches and corrugations. Furrows , contour furrows and cross slope furrows will work on row crops. Sprinkler irrigation is also recommended. Minimum tillage and crop residue utilization will help control erosion. Fertility maintenance is important. Crops grown on these soils respond to fertilizer applications of phosphorous and nitrogen. In non-irrigated areas this soil is suited to winter wheat, barley and ,, sorghum. Most of the area is devoted to winter wheat which is alternated - • with summer fallow to allow moisture accumulation. Normally, precipi- `-'' - tation is too low to make beneficial use of fertilizers. Good cultural practices such as stubble mulch farming, strip cropping and minimum tillage are needed to combat wind and water erosion. Terracing may also be needed to control.water erosion. F . The potential native vegetation on this site is dominated by sand blue- stem, sand reedgrass and blue grama. Needle-and-thread, switchgrass , sideoats grama and western wheatgrass are also prominent. Potential v.. . • production ranges from 2200 pounds per acre in favorable years to 1800 pounds per acre in unfavorable years. When range condition deter- iorates , sand bluestem, sand reedgrass and switchgrass decrease and blue grama, sand dropseed and sand sage increase. Annual weeds and grasses � ¢ invade the site as range condition becomes poorer. t Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Seeding is advisable if range is in poor condition. Sand bluestem, sand reedgrass , switchgrass , sideoats grama, blue grams, pubescent wheatgrass and crested wheatgrass `: =` • are suitable for seeding. The grass selected should meet the seasonal requirements of livestock. For successful seeding, a clean, firm, sorg- hum stubble -- prepared the growing season prior to seeding -- or a firm, prepared seedbed and grass drill should be used. Early spring seeding has proven most successful. Windbreaks and environmental plantings are generally suited to this soil. Soil blowing is the principal hazard to establishing trees and shrubs. This hazard cna be overcome by xultivating only in the tree row and by 1 , �•- leaving a strip of vegetaion between the rows. Supplemental irrigation may be necessary at the time of planting and during dry periods. Trees that are best suited and have good survival are Rocky Mt. juniper, eastern redcedar, ponderosa pine, Siberian elm, Russian olive and hackberry. Shrubs best suited are skunkbush sumac, lilac and Siberian peashrub. Wildlife is an important secondary use , with these soils best suited for openland and rangeland wildlife. In cropland areas , habitat favorable for ring-necked pheasants , mourning doves, and many non-game species can be developed by establishing wildlife areas for nesting and escape cover. For pheasants , the inclusion of undisturbed nesting cover is vital and should be included in plans for habitat development: this is especially ham- true in areas of intensive agriculture. Rangeland wildlife, exemplified v,. by the pronghorn antelope , can be assisted and encouraged by development of livestock watering facilities , proper livestock grazing management, and range reseeding where needed. Rapid expansion of Greeley and the surrounding area has resulted in urbanization of much of this Olney soil. It has a good potential for urban and recreational development. Its only limiting feature is the moderately rapid permeability in the substratum and the hazard of con- tamination of ground water from sewage lagoons. Lawns , shrubs and trees for beautification will do well. The site is located on the soil type Olney fine sandy loam, 3 to 5 per- cent slopes. The soil exhibits very few limiting characteristics for the intended purpose. With adequate and sound engineering designs for concrete, the site should be suitable. However, this soil type is sus- ceptable to wind erosion when the surface vegetation or residue cover is destroyed. This can be overcome during construction by uncovering only the area needed for actual installation. Surface water drainage designs should be made so that erosion will not be induced.
