DECEMBER 28, 2009
The Board of County Commissioners of Weld County, Colorado, met in regular session in full
conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County
Centennial Center, Greeley, Colorado, December 28, 2009, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:

MINUTES: Commissioner Conway moved to approve the minutes of the Board of County
Commissioners meeting of December 23, 2009, as printed. Commissioner Long seconded the motion,
and it carried unanimously.
CERTIFICATION OF HEARINGS: Commissioner Long moved to approve the Certification of Hearings
conducted on December 23, 2009, as follows: 1) USR #1695 - A & W Water Service, Inc.
Commissioner Conway seconded the motion, which carried unanimously.
AMENDMENTS TO AGENDA: There were no amendments to the agenda.
PUBLIC INPUT: No public input was given.
CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the Consent Agenda as printed.
Commissioner Conway seconded the motion, and it carried unanimously.
PRESENTATIONS:
RECOGNITION OF SERVICES, DISTRICT ATTORNEY'S OFFICE — JANEAN BEAMAN: Chair
Pro-Tem Rademacher read the certificate into the record, recognizing Janean Beaman for 26 years of
service working for the District Attorney's Office.
COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports.

CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE - W1/2SW1/4, W1/2E1/2SW1/4, S2, T7N,
R63W: Barb Connolly, Controller, stated Hannon and Associates, Inc., is the sole bidder for all of the

oil and gas leases being considered today; therefore, there will not be an auction conducted.
Ms. Connolly stated she will read each legal description and the amount of the bid which has been
submitted for each parcel into the record. In response to Chair Pro-Tem Rademacher, Ms. Connolly
stated each lease needs to be approved with a separate motion from the Board. Ms. Connolly read the
legal description of the property into the record and stated Hannon and Associates, Inc., submitted a
bid in the amount of $55.00 per net mineral acre, for a total sum of $6,600.00, for this property.
Commissioner Kirkmeyer inquired as to whether the Board needs to provide the opportunity for
members of the public to submit bids for the oil and gas leases. Ms. Connolly stated the Board does
not need to allow the public to submit bids, since there is a deadline prior to the auction for paperwork
to be submitted by interested parties. Mr. Barker concurred, and stated the two highest bidders are
entitled to participate in the auction; however, there is only one bidder for these oil and gas leases.
Commissioner Conway moved to approve the sole bid from Hannon and Associates, Inc., in the
amount of $55.00 per net mineral acre, for a total sum of $6,600.00, and authorize the Chair to sign
said lease. Seconded by Commissioner Kirkmeyer, the motion carried unanimously.
CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE - N1/2 (CONSISTING OF LOTS 1, 2, 3, 4:
S112N112), S3, T7N, R63W: Ms. Connolly read the legal description of the property into the record and
stated Hannon and Associates, Inc., submitted a bid in the amount of $55.00 per net mineral acre, for a
total sum of $17,664.00, for this property. Commissioner Kirkmeyer moved to approve the sole bid
from Hannon and Associates, in the amount of $55.00 per net mineral acre, for a total sum of
$17,664.00, and authorize the Chair to sign said lease. Seconded by Commissioner Long, the motion
carried unanimously.
CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE - S1/2, S4, T7N, R63W: Ms. Connolly read
the legal description of the property into the record and stated Hannon and Associates, Inc., submitted
a bid in the amount of $104.00 per net mineral acre, for a total sum of $33,280.00, for this property.
Commissioner Conway moved to approve the sole bid from Hannon and Associates, Inc., in the
amount of $104.00 per net mineral acre, for a total sum of $33,280.00, and authorize the Chair to sign
said lease. Seconded by Commissioner Kirkmeyer, the motion carried unanimously.

the legal description of the property into the record and stated Hannon and Associates, Inc., submitted

Commissioner Kirkmeyer moved to approve the sole bid from Hannon and Associates, Inc., in the
amount of $104.00 per net mineral acre, for a total sum of $33,280.00, and authorize the Chair to sign
said lease. Seconded by Commissioner Long, the motion carried unanimously.

property. In response to Ted Hannon, Hannon and Associates, Inc., Ms. Connolly confirmed the
property includes all of Section 7. Commissioner Conway moved to approve the sole bid from Hannon
and Associates, Inc., in the amount of $104.00 per net mineral acre, for a total sum of $65,874.00, and
authorize the Chair to sign said lease. Seconded by Commissioner Kirkmeyer, the motion carried
unanimously.

NEW BUSINESS:
CONSIDER APPLICATION FOR VICTIM ASSISTANCE AND LAW ENFORCEMENT (VALE) GRANT
FOR VICTIM WITNESS ASSISTANCE UNIT AND AUTHORIZE CHAIR TO SIGN: JoAnn Holden,
District Attorney's Office, stated the VALE Board offered equipment grants again this year and since the
Victim Witness Assistance Unit recently moved into a new space, it would like to apply for an
equipment grant to purchase furniture for the five new waiting rooms. Ms. Holden stated there are
matching County funds required to accept the grant, and the total amount being applied for is
$1,523.00. Commissioner Conway moved to approve said application and authorize the Chair to sign.
Seconded by Commissioner Long, the motion carried unanimously.
CONSIDER MEMORANDUM OF UNDERSTANDING CONCERNING UNITED WAY 2-1-1 SERVICES
AND AUTHORIZE CHAIR TO SIGN — UNITED WAY OF WELD COUNTY: Ken Poncelow, Sheriff's
Office, stated this item is between the Weld County Sheriff's Office and United Way of Weld County,
and the cost will be paid for by a methamphetamine grant the County received several years ago.
Mr. Poncelow stated the Memorandum of Understanding will provide training on accessing information
on methamphetamine addiction. In response to Commissioner Kirkmeyer, Mr. Barker stated he

reviewed the Memorandum of Understanding. Commissioner Kirkmeyer stated the Memorandum of
Understanding has several typographical errors and there is a section which has not been numbered,
and she inquired as to whether the database is protected. Mr. Poncelow stated the database is not
protected and it is United Way's database.
Chris Dowan, United Way of Weld County, stated the database is on the internet; however, few people
are aware it is available; therefore, it is an underutilized resource.
Commissioner Kirkmeyer inquired as to whether the payments will be made up front or on a quarterly
basis. Mr. Poncelow stated the County will reimburse the cost. Commissioner Kirkmeyer stated within
the first item under Specifics Regarding Compensation in the Memorandum of Understanding, it
indicates costs will be paid upfront by the Weld County Sheriff's Office; however, further into the
Memorandum of Understanding it indicates costs will be reimbursed; therefore, the payment method is
unclear. Mr. Poncelow reiterated the Memorandum of Understanding should indicate the County will
reimburse the cost. Mr. Dowan stated the intent of the Memorandum of Understanding is for certain
items to be paid upfront, as specified within the first item under Specifics Regarding Compensation,
while other items will be reimbursed, such as materials and mileage, as specified within the second
item under Specifics Regarding Compensation. Commissioner Conway inquired as to which costs are
to be paid quarterly and which costs are to be paid upfront. Commissioner Kirkmeyer stated the first
item under Specifics Regarding Compensation indicates costs associated with outreach work, such as
gathering resources and updating and maintaining the 2-1-1 database are to be paid upfront; however,
it also indicates costs and project plans will only be paid and planned in quarterly increments. She
stated the third item under Specifics Regarding Compensation indicates the training costs are to be
paid upfront; however, the section also indicates, in one statement, that quarterly payments will be
made for costs and project plans, and then subsequently indicates that printing costs will be billed
directly to the Weld County Sheriff's Office; therefore, it is difficult to monitor whether payments are
being made correctly. Mr. Poncelow recommended all of the costs be reimbursed. Mr. Barker
suggested continuing the matter in order to allow adequate time to revise the Memorandum of
Understanding. Mr. Poncelow indicated he will not be able to attend the Board meeting on
December 30, 2009; therefore, the matter will need to be continued to January 4, 2010. In response to
Commissioner Conway, Mr. Poncelow stated it will not cause a problem to continue the matter. In
response to Commissioner Kirkmeyer, Mr. Poncelow confirmed the methamphetamine funds are from a
federal grant. In response to Commissioner Kirkmeyer, Mr. Barker stated the Summary of
Compensation portion of the Memorandum of Understanding needs to include language concerning
OMB Circular A-87, in addition to OMB Circular A-133. Commissioner Conway moved to continue the
matter to January 4, 2009, in order to allow adequate time for Mr. Barker to revise the Memorandum of
Understanding. Seconded by Commissioner Kirkmeyer, the motion carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
