RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST LOUIS GOLDSBY FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Louis Goldsby, ZCV #0800409, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 16th day of June, 2009, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Louis Goldsby, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until September 16, 2009, to allow adequate time for the property owner to submit a
Use by Special Review Permit, or remove the commercial business to bring the subject property
into compliance and for an inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0800409 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Louis Goldsby to remedy the violation of the Weld County Code, and
any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties, with an instruction for delay of action
upon such referral until September 16, 2009, to allow adequate time for the property owner to
submit a Use by Special Review Permit, or remove the commercial business to bring the subject
property into compliance.

REMEDY
As we discussed during your Pre -Application Meeting on March 20, 2009, a Use by Special Review
(USR) application shall be submitted for storage of operable and non -operable commercial vehicles. It
is our understanding that a fire recently swept through your property and caused damage on varying
scales with regards to many of the commercial vehicles, both construction trailers and the mobile
home.
To avoid the above referenced Violation Hearing a complete USR application shall be submitted before
June 15, 2009. In order to meet this deadline, the 4 packets for the 7 Day Completeness Review shall
be submitted before June 1, 2009. Any necessary corrections shall be completed and the remaining
paperwork shall be submitted prior to June 15, 2009. If this is completed, the above Violation Hearing
will be cancelled.

Upon a visual inspection of the property, the following
items were noted: several commercial vehicles and at
least 1 mobile home/construction trailer. No pictures
were taken during this inspection.
Upon a visual inspection of the property, the following
items noted: several commercial vehicles, a single wide
mobile home and 2 construction trailers. See pictures
dated 02/05/09.
Louis Goldsby (785-877-6060) called. He said he just
received my letter dated December 24th at his Kansas
address. I explained that another letter was also sent on
January 21, 2009, in fact, I had just inspected the
property on the 5th and was getting ready to schedule his
property for a Violation Hearing. He asked me not to
schedule anything, he said he would do whatever he
needed too to bring the property into compliance. I
asked what kind of business he had. He said it is an
excavation company. I asked how many employees he
has. He said he averages around 5. I explained that I
could arrange a telephone conference for next Monday
at 11 (my time) with a Planner. He said that would be
great.
Louis Goldsby, Jacqueline Hatch and I had a telephone
conference regarding the property. Louis indicate his
brother in law (who has Muscular Distrophy - MS) lives
on the property. He said they run an excavation and
landscaping business. He kept the mobile home from
the previous location because they see the need for a
Medical Hardship in the future. He said the other trailers
are for office space. He stated that no employees go to
the site. Then he said well occassionally they go to the
property to get a piece of equipment or vehicle, but
mostly they meet at the job site. Jacqueline explained
that a Commercial well may need to be received. He
then told Jacqueline that some of the vehicles are not
working (they are derelict), she recommended he include
a Commercial Junkyard. She explained the first step
was the Pre -Application meeting. He asked how much
time he had. I explained if he submitted the
Pre -Application Request form by this week, we would try
to get him scheduled when he is going to be back in
town. I told him to put that on the pre -application form -
towards the bottom of the first page. He said he would
get that stuff faxed in by tomorrow. I told him that would
be great.

Weld County Code are as follow:
the presence of a single -wide mobile home requires both a building and a zoning permit.
Depending on the use, it may or may not be eligible to apply.
The presence of more than 1 (one) COMMERCIAL VEHICLES also requires a specific
zoning permit called a Use by Special Review (USR) permit. The first step in this process
is a Pre -Application Request meeting. This step is completely free to the application, but

The pre -application request is the preliminary review of a land use proposal. Pre -application reviews are required
prior to beginning the application process; however, this review is not an application.
Pre -application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. Pre -Application reviews are held Thursday and Friday of any given week in the Greeley office.
To be on the pre -submittal agenda, the request and required checklist items must be received one week prior to
the review date, and shall include at a minimum, a description of the property including surrounding lands and land
uses, property owners name and contact information, a brief narrative and a map delineating the property location,
in addition to the other items listed.
