Plat copies look good to go mylar. My only suggestion would be to add a space between each
development standard (to make it easier to read/follow) and # development standard 38 on the
plat.

I dropped off the updated Stromo plat for your review on Friday October 2, 2009, have you had
a chance to review it. I would like to record the plat this week.
In regards to Rusco, I spoke with Allen Overton at North Weld Water last week and he said he
would send you a letter regarding North Weld Water's ability to supply adequate water for the
proposed expansion. Have you received this letter? The receipt of the letter should finalize
the all of the Conditions of Approval and I would like to record the plat as soon as
possible.

This letter is in regards to your request that AGPRO provide information indicating that Big Boy
Manufacturing is no longer operating on the Stromo site, and to provide you with their new
manufacturing location prior to allowing Stromo to record their USR plat.
AGPRO visited the Stromo site on August 20, 2009 and found no indication of business activity by Big
Boy Manufacturing at that time. The site appeared to have farm equipment and farm related activity for
the Moser property.
Big Boy Manufacturing is located at 218 N 2nd Street Unit C, LaSalle, Colorado 80645, (970) 284-
6004. At this time Big Boy Manufacturing is not our client. If you need information on their business
please contact them at the phone number I have provided. AGPRO is not aware of any manufacturing
activities.
AGPRO requests that the recording of the Stromo plat be expedited. I will provide Mr. Gathman with a
revised plat, with the requested changes, for his approval.

I spoke with Alan Overton from North Weld Water re: Rusco. I was just waiting on getting
something in writing from North Weld County Water District re: your discussion/understanding
with them re: the phasing of water improvements. This is the only remaining condition for
Rusco.
Stromo:
1) We need a letter stating that Big Boy Manufacturing has been located and where Big Boy
Manufacturing has been moved to. (As discussed in our meeting with you) staff did not agree
to record the plat if Big Boy Manufacturing was still operating on the site unless a Use by
Special Review Permit has been applied for. I believe Bethany Salzman sent you an e-mail re:
this.
2) A portion of the Stromo plat (indicated as equipment storage area which no longer is
needed) is not on the same parcel as the rest of the Stromo site. Per our discussion with you
at the meeting it was our understanding that you were going to revise the boundaries of the
Stromo plat to remove this (so that you avoid having to do a partial vacation plat of the
USR).

As I indicated in my voice mail, Big Boy Manufacturing is not operating at the RF Holdings site and has never been on the
Stromo USR site. Stromo is requesting that the Final Plat be recorded and if you find the Big Boy Manufacturing site out
of compliance then a violation should be filed against Big Boy Manufacturing.
I will contact Chris Gathman, however, the final plat has been approved and a mylar submitted prior to any concerns of
Big Boy Manufacturing.

1) After talking with our County Surveyor, Leon Sievers, the access easement
language should read as follows (for both easements):
50' access and utility easement for the benefit of parcel # 0705 21 000048
and future .
2) Our County Surveyor had a concern that the area of uncertainty (due to
the fence location) would create a cloud on the title for Lot A of RE -4899.
A way to deal with this would be to:
Submit a letter agreeing to either:
* Submit an amended recorded exemption plat (after RE -4899 is recorded) to
address the area of uncertainty.
OR
* Submit a fenceline agreement with the neighboring property owner. (Leon
indicated the agreement would indicate that both parties recognize the

Dear Mr. Jiricek,
Mr. Ron Ditson received your Compliance Letter dated March 9, 2007 and forwarded a
copy for response to AGPROfessionals, LLC. AGPROfessionals, LLC has reviewed
your Compliance letter dated March 9, 2007 for Nature's Cycle Organics and the Stromo
Composting Facility. AGPROfessionals, LLC is representing Mr. Tim Smith and
Stromo, LLC in cooperation with Mr. Ron Ditson of Nature's Cycle Organics.
In response to the issues of non-compliance and violations:
1. The facility's closure and post -closure cost estimates are being reviewed and updated.
First, Mr. John Moser, owner of the facility, is investigating the Certificates of Deposit
(CD) with the bank where the Certificates of Deposit were secured. Originally, the
Certificates of Deposit were secured with American Ag Bank of Greeley, a subsidiary of
The Bank of Cherry Creek, and issued as electronic CD's. American Ag Bank went out
of business and the parent company, The Bank of Cherry Creek is tracking the
information.
Second, AGPROfessionals is reviewing the closure and post -closure requirements,
updating estimates of labor, equipment, testing and other requirements along with
verifying volumes of materials estimated since the last update.
Corrective Action and Timeline: The Closure and Post -Closure estimates will be
updated and, if necessary, additional financial assurances secured by Friday April 27`h,
2007 and forwarded to Weld County and Colorado Departments of Public Health &
Environment

2. Receipt of several wastes without the waste being reviewed and appropriately
approved in accordance with the facility's approved design and operations plan are
described in an attached letter from Mr. Ron Ditson, operator of Nature's Cycle Organics.
The Meadow Gold rinse water has been used as a wetting agent at the site since it became
a Class One composting operation in 2004. The facility has been inspected quarterly
since 2004 and the rinse water had been noted and Mr. Ditson assumed acceptable since
wetting agents are necessary for quality composting.
The bloody water from Double J Packing has been terminated and a letter sent to the
Double J Meat Packing Company. A copy of the March 12, 2007 letter from Mr. Ron
Ditson to the Double J Meat Packing Company is attached along with a copy of the
analysis conducted by Warren Analytical laboratories for the Double J Meat Packing
Company for your information.
Mr. Ditson informs me that the sheetrock or treated wood was incidental and there is not
an agreement, supplier, or arrangement with any individual or company to accept
volumes of treated wood or sheetrock. More diligence will be applied in the future to
make sure that incidental wastes are not included in deliveries of bulking agents and, if
so, are summarily rejected.
Acceptance of the BioEnergy wastewater product has been terminated. Details of the
disposition of the BioEnergy product are included in the attached March 14, 2007 letter
response to the Colorado and Weld County Departments of Public Health &
Environment.
Corrective Action and Timeline: No wastewater from BioEnergy is being accepted.
More diligence will be applied to ensure incidental wastes are not included in deliveries
of bulking agents and, if so, are rejected. A copy of an analysis of the Meadow Gold
wastewater is included for your information. A modified Design and Operations Plan,
with a request to accept the Meadow Gold wastewater, will be submitted to the Weld and
Colorado Departments of Public Health & Environment for review and approval by April
27's, 2007.
3. Storage of the BioEnergy product in the on -site stormwater retention pond does reduce
storage volume available for actual stormwater runoff. However, there were no storms
creating issues with the reduced capacity during the time period between the temporary
storage and subsequent removal of the product. As described in the attached March 14,
2007 letter to the Weld and Colorado Departments of Public Health & Environment, the
wastewater product has been removed from the ponds and the capacity for stormwater
runoff re-established.
Corrective Action and Timeline: The BioEnergy product has been removed from the
ponds and managed according to the response from the Colorado Department of Public
Health & Environment.

4. Records at the facility are being reviewed and procedures for recordkeeping modified.
Corrective Action and Timeline: Records as required in the Design and Operations Plan
will be kept as required beginning immediately. Upon review of the procedures for
recordkeeping, if deemed inadequate, a modified Design and Operations Plan will be
submitted to the Weld County and Colorado Departments of Public Health &
Environment by April 27th, 2007.
5. AGPROfessionals, LLC is reviewing the records related to recording the plat for the
Use -by -Special Review permit. We are unaware of any outstanding Conditions of
Approval or Development Standards that are unmet with exception of updating the
financial assurance.
Corrective Action and Timeline: Any unmet Conditions of Approval or Development
Standards will be clarified and met and a plat submitted for recording by April 27th, 2007.
We hope this response is adequate. However, please contact us immediately if there are

on February 28, 2007. AGPROfessionals, LLC has reviewed your Compliance Advisory letter
dated February 27, 2007 for Nature's Cycle Organics and the Stromo Composting Facility.
AGPROfessionals, LLC is representing Mr. Tim Smith and Stromo, LLC in cooperation with Mr.
Ron Ditson of Nature's Cycle Organics.
1. In response to Deficiency 1 and the Requested Action, no byproducts from BioEnergy of
Colorado are being accepted at this facility. Attached are comprehensive laboratory
profiles of the waste stream from the generator and a flow chart of the process for which
the waste stream is generated. This information was provided to AGPRO and Mr. Ron
Ditson by Mr. Tom Foley of BioEnergy of Colorado. Additionally, we have included
sample results obtained by Mr. Ron Ditson and sent to Midwest Laboratory in Tampico,
Illinois. The sample was collected from the stormwater pond on February 6, 2007 and
reported on March 5, 2007. The sample was analyzed for Compost Feedstock suitability.
Per your request, a sample of the wastewater was collected by Mr. Ron Ditson on March
12, 2007 and delivered to Stewart Environmental Consultants, Inc. in Fort Collins
Colorado. The sample was analyzed for Volatile Organic Compounds. Laboratory
reports and a chain -of -custody are included in the attachments.
2. Deficiency 2 requested action: the waste stream is being removed from the stormwater
pond. Mr. Ron Ditson is conducting the removal operations and documentation. The
wastewater is/was being transferred to Frac tanks. There are currently five (5) Frac tanks
on the property and filled. Removal began on March 6, 2007 and continues as of the date
of this letter.
3. Deficiency 3 requested action: Mr. Ditson does not have documentation, receipts or a bill
of lading for the material received. Interviews with Mr. Ditson indicate approximately
twelve (12) semi -tractor loads of approximately five thousand (5,000) gallons were
received from Tuesday January 23, 2007 through and ending on Tuesday February 6,
2007. Approximately one (1) load per week clay with the exception of typically two (2)
on Mondays were delivered.

Dear Mr. Swain
Per your letter dated October 3, 2006 please consider the following to be a request for
amendment to the design and operation plan for the Stromo composting facility.
Meadowgold rinse water is used at the Stromo facility as a wetting agent for compost
production. The feedstocks used at the facility average approximately 20%moisture.
Effective composting requires a moisture level of 40-45%, therefore a wetting agent is
critical to the operation.
The Meadowgold rinse water is delivered to the site in tankers, transferred to our tanker,
and applied over the windrows at a rate not exceeding two gallons per cubic yard per
application. This relatively low application rate prevents runoff from the windrows. The
water is thoroughly incorporated into the windrow using the compost turner.
All water is applied the day it is received. No Meadowgold rinse water is stored at the
Stromo facility.
The Meadowgold rinse water has been used as a wetting agent at the site since it became
a Class one composting facility in 2004. The methods of application and incorporation
have remained the same. To date no nuisance conditions have been reported or are
known to Nature's Cycle Organics, the current operator of the Stromo facility.
The Double J Packing bloody water is used as a wetting agent and to increase the
biological diversity of our finished product. The need for a wetting agent is discussed
earlier in this letter.
Turkey manure contains four of the six groups of bacteria and fungus necessary for
healthy plant growth. The addition of the beef product provides the other two groups
giving us a product that is, I believe, unique to composting in the front range of Colorado.
The bloody water is added to the windrow by opening a trench in the top of the windrow
using a loader. The material is then free flowed from the tanker into the trench. The
trench is then closed and the windrow turned to complete incorporation.
To date no nuisance conditions have been reported to or are known by Nature's Cycle
Organics, the current operator of the Stromo facility.
The second area addressed in your letter is the groundwater monitoring.
Groundwater monitoring has been handled by Ag Pro. Tom Haren has been notified of
the deficiency by phone and a copy of your letter. If he has not responded to you by the
time you receive this letter, please call me at 970-302-9027 and I will expedite his

AMUSR-1276 (Stromo):
At the time the USR was approved, there were two Health Department conditions
of approval (see the attached resolution on page #3).
Have these items been addressed?
FYI: The latest correspondence I have in the file is from 9/6/2007 from CDPHE
and outlined several proposed revisions to the D&O plan for the facility.
Tim Naylor - AGPRO is trying to wrap this AMUSR and wants to know what outstanding items
remain.
FYI: I will be out of the office Monday 3/23 - Thursday 3/26 next week.

Subject: Nature's Cycle organics, Inc., Issues of Non -Compliance
Dear Mr. Ditson:
The purpose of this letter is to advise you of issues of non-compliance and violations that have
occurred in the recent past at the Stromo composting facility operated by Nature's Cycle Organics,
Inc., located at 21970 WCR 30, in Weld County, Colorado.
Issues of non-compliance and violations:
• The facilities closure and post -closure cost estimates have not been updated for the 5 -year
requirement. Therefore, the valuation of the financial assurance mechanism may not
currently be in compliance with the Colorado Regulations Pertaining to Solid Waste Sites
and Facilities (Regulations). The facility has been sent a February 15, 2006, letter from the
Colorado Department of Public Health & Environment's Hazardous Materials and Waste
Management Division (CDPHE-HMWMD) advising of this issue.
• The facility has received several wastes without the waste being reviewed and appropriately
approved by this Department and the CDPHE-HMWMD in accordance with the facility's
approved design and operations plan. These wastes include sheetrock, treated wood,
Meadow Gold rinse water, bloody water from Double J Packing, and most recently
wastewater from BioEnergy of America. All of these wastes were accepted without approval
or appropriate analytical results.
• The facility stored wastewater from BioEnergy of America within its on -site stormwater
retention pond. Storage of this waste in the pond reduced the storage volume available for
actual stormwater run-off. The stormwater ponds were designed and constructed to only
hold stormwater.
• The facility has not maintained appropriate records on the facility.
All of these findings are issues of non-compliance and violations of the facility's USR and the
Regulations.

Please respond by April 5, 2007, to each issue/violation with a corrective action plan and time line
for correction. Please also provide responses to the issues/violations outlined in the CDPHE-
HMWMD Compliance Advisory dated February 27, 2007. The Department will take into
consideration your response and action plan prior to any enforcement proceedings.
As you are aware, the plat has not been recorded for the facility's Use by Special Review permit.
The Department will not entertain any modification to the facility's design and operations plan until
all issues of non-compliance have been satisfactorily addressed and the plat recorded.

An unannounced joint inspection was planned for February 6, 2007 with Roger Doke of
the CDPHE-HMWMD. The inspectors arrived at the gate of the facility at approximately
10:30 AM. Mr. Ron Ditson was contacted via telephone and asked to meet the
inspectors' on -site. Mr. Ditson drove onto the site with the inspectors. A 6500 gallon
tractor trailer tanker was unloading a warm (water vapor emitting) yellow fluid into the
north stormwater retention pond on the southeast end. There was also a yellow substance
floating on the southwest end of the pond.
Mr. Ditson said it was waste from Bio-energy of Colorado, located on E. 56`h Ave,
Denver, Colorado. Mr. Ditson said they have been taking it for a week and storing it in
their wastewater pond for later application to the compost piles. He said they have taken
about 30,000 gallons.
Mr. Ditson said he knows he is not allowed to take this material. Mr. Ditson agreed to
cease accepting this material. Mr. Ditson was requested to provide analytical information
from the waste generator and a split sample was taken with Mr. Ditson at 1120 AM.
The truck driver was Mr. William Nation, who works for Bio-Energy of Colorado LLC.
He said he has been delivering 2-3 loads per day for a week or two. The inspectors asked
Mr. Nation what other places he has been unloading in Weld County. He said 2 months
ago he took loads to A-1 Organic's Platteville facility. They dig out a pit section allow
him to unload and then cover it. Mr. Nation also said he transfers loads to tankers at ABS
Organics for Mr. Phil Becker at Weld County Roads 19 & 22. This is the location of the
Gordon #1 Turkey Farm.
No routine inspection was conducted due to the inspectors need to further investigate the
dumping of these wastes at other facilities.

I reviewed the AMUSR-1276 plat and have the following revisions:
1) Indicate the USR boundaries in darker lines.
2) Indicate 30 -foot county road right-of-way along the west and south section lines.
3) Indicate the scale on the site map.
4) Only other item, some of the items got cut off on the drawing, make sure that they are not cut off on
the mylar version.
Provided these changes are made, the mylar plat can be created.
