This proposal calls for the annexation of 57.73 acres essentially surrounded by the Town of
Lochbuie. The annexation is the Tagawa Greenhouse property north of Weld County Road 4
and west of Weld County Road 37. The Tagawa Greenhouse has been located on this property
since beginning operations over 40 years ago and is a developed parcel of land. The facility
includes numerous greenhouse and plant processing facilities, 3 residential units and the
company offices. The proposed annexation includes a request for zoning as C: Commercial and
the platting of the property as a single lot encompassing the entire site. Maps identifying
elements of the proposal are attached for your review.

NOTICE IS HEREBY GIVEN that public hearings and meetings .vi!! con,;ucied before and by the
Lochbuie Board of Trustees and the Lochbuie Planning Commission for the purpose of determining and finding
whether the Tagawa Greenhouses, Inc. proposed annexation meets criteria found in the Colorado Revised
Statutes and Lochbuie Municipal Code. The proposal includes the following: annexation of the approx. 57.73
acres, zoning of the subject property as C: Commercial, platting of the property as a single lot. Copies of the
applications are on file in the office of the Town Clerk of the Town of Lochbuie, Colorado located at 703 WCR
37, Lochbuie, Colorado and are available for review by the public. Proposed hearing and meeting dates are as
follows:
September 2, 2009: Introduction and Is' reading of Ordinances on Annexation and Zoning before the Town of
Lochbuie Board of Trustees.
September 8, 2009: Recommendation on annexation of the property and Public Hearing on Zoning before
Lochbuie Planning Commission.
September 22, 2009: Public Hearing on Final Plat before the Lochbuie Planning Commission.
September 23, 2009: Public Hearing and 2nd reading of Ordinances on Annexation and Zoning, action on
proposed Final Plat of the property before Town of Lochbuie Board of Trustees.
All meetings of the Lochbuie Board of Trustees and Lochbuie Planning Commission begin at 7:00 p.m. and are
held at 703 Weld County Road 37, Building "B". Interested parties may appear and be heard at any public

PETITION FOR ANNEXATION
(PROPERTY KNOWN AS TAGAWA GREENHOUSES ANNEXATION)
TO: THE BOARD OF TRUSTEES OF THE TOWN OF LOCHBUIE, COLORADO
The undersigned landowners (hereinafter referred to as "Petitioner") being more than fifty percent
(50%) of the area, excluding public streets and alleys, and being more than fifty percent (50%) of the
landowners of the area to be annexed, excluding public streets, and alleys and any land owned by the
Town of Lochbuie, and in accordance with the provisions of Chapter 306, Colorado Session Laws,
1965, and known as the Municipal Annexation Act of 1965, as amended, hereby petition the Board
of Trustees of the Town of Lochbuie for annexation to the Town of Lochbuie the following
described unincorporated territory situate and being in the County of Weld and State of Colorado, to -
wit: See attached Exhibit A.
Your Petitioner would further state to the Board of Trustees of Lochbuie, Colorado, as follows:
1. That it is desirable and necessary that such territory be annexed to the Town of Lochbuie,
Colorado.
2. That the territory sought to be annexed to the Town of Lochbuie meets the requirements of
Sections 31-12-104 and 105 as amended, of the Municipal Annexation Act of 1965, in that:
a. Not less than one -sixth (1/6) of the perimeter of the area proposed to be annexed is
contiguous with the existing boundaries of the Town of Lochbuie, Colorado; and the
contiguity is not established by use of any boundary of an area which was previously
annexed to the annexing municipality, that was not contiguous at any point with the
boundary of the Town of Lochbuie and was not located more than three (3) miles
from the nearest boundary of the Town of Lochbuie, further contiguity is not
established by use of any territory which is subsequently annexed directly to, or
which is indirectly connected through subsequent annexations to, such an area.
b. A community of interest exists between the territory proposed to be annexed and the
Town of Lochbuie, Colorado.
c. That the territory proposed to be annexed is urban or will be urbanized in the near
future and that the territory to be annexed is integrated or is capable of being
integrated with the Town of Lochbuie, Colorado.
d. That no land in the territory sought to be annexed which is held in identical
ownership whether consisting of one tract or parcel of real estate, or two or more
contiguous tracts or parcels of real estate divided into separate parts or parcels
without the written consent of the landowners thereof unless such tracts or parcels are
separated by a dedicated street, road, or other public way. To the extent that this

Petition divides any such tracts or parcels into separate parts or parcels, Petitioners
hereby consent to such division.
e. That no land in the territory sought to be annexed, which is held in identical
ownership, whether consisting of one tract or parcel of real estate or two or more
contiguous tracts or parcels of real estate, comprising twenty (20) or more acres
(which, together with the buildings and improvements situated thereon has a
valuation for assessment in excess of $200,000.00 for ad valorem purposes for the
year next proceeding the annexation) shall be included in the area to be annexed
without the written consent of the landowners, unless such tract of land is situated
entirely within the outer boundaries of the annexing municipality as they exist at the
time of annexation.
g.
No annexation proceedings have been commenced for any portion of the territory
proposed to be annexed for the annexation of such territory to another municipality.
The annexation of the territory proposed to be annexed shall not result in the
detachment of area from any school district.
h. The annexation of the territory proposed to be annexed will not require extending the
municipal boundary more than three (3) miles in any direction from any point of such
municipal boundary in one year.
i. In establishing the boundaries of the area proposed to be annexed if a portion of a
platted street or alley is annexed, the entire width of said street or alley shall be
included within the area annexed.
3. The Petitioners comprise the landowners of more than fifty percent (50%) of the territory
included in the area proposed to be annexed, exclusive of streets and alleys, and comprise
more than fifty percent (50%) of the landowners in the area proposed to be annexed,
excluding public streets, alleys, and any land owned by the Town of Lochbuie. Please refer
to Exhibit B hereof for the legal description of the land owned by the Petitioners.
4. That submitted herewith are four (4) prints of the annexation map, containing a written legal
description of the boundaries of the area proposed to be annexed, together with the location
of each ownership within said area and the contiguous boundaries of the existing city limits
and the dimensions thereof.
5. In the event that an Annexation Agreement satisfactory to the Petitioner and the Town of
Lochbuie, Colorado is not agreed to on or before the date of the second reading of the
Ordinance to effectuate the annexation contemplated in this Petition; or if annexation of the
Property is not in the best interests of the Petitioner, the Petitioner shall have the right to
withdraw this Petition.

6. Petitioner requests that the Property be zoned "Commercial" by the Town of Lochbuie
concurrently with annexation of the property, but in any event, that the Property be zoned
within ninety (90) days of the effective date of the Annexation Ordinance.
7. That upon the Annexation Ordinance becoming effective, all lands within the area sought to
be annexed shall become subject to all ordinances, resolutions, rules and regulations of the
Town of Lochbuie, except for general property taxes of the Town of Lochbuie which shall
become effective on January 1 of the next succeeding year following passage of the
Annexation Ordinance.
Therefore, your Petitioners respectfully request that the Board of Trustees of the Town of Lochbuie,
Colorado, approve the annexation of the area proposed to be annexed.

Tagawa Greenhouses Annexation Impact Report
INTRODUCTION
The following report has been prepared pursuant to Section 31-12-108.5 of the Colorado
Revised Statutes (C.R.S.) and concerns the proposed annexation by Tagawa
Greenhouses, Inc. (TGI) of certain real property known as the Tagawa Greenhouses
Annexation (Property) to the Town of Lochbuie (Town). The property is proposed to be
annexed in one parcel comprising a total of 57.73 acres more or less. The Property is
located in Section 25, of Township 1 North, Range 66 West of the 6th Principal Meridian,
Weld County, Colorado.
The Property is essentially surrounded on all sides by the Town of Lochbuie including
the Farms subdivision to the south, Altamira subdivision (undeveloped) to the west and
north, and an annexed portion of Weld County Road (WCR) 37 to the west.
A. CURRENT ZONING/USES/PROCESS
The Property is currently zoned A: Agriculture in Weld County, Colorado. The owners of
the property are Tagawa Greenhouses, Inc. (TGI) and the request for annexation is made
through Mr. Kenneth Tagawa, President of TGI. Proposed uses for the Property include
the continuation of the office and greenhouse operations that have been located on the
property for decades. The requested zoning for the Property is C: Commercial.
The land has been used as a commercial greenhouse operation for decades. That use will
continue upon annexation to the Town. This Property is the main Colorado facility and
corporate headquarters for TGI. The property totals approximately 900,000 s.f. of
building space including:
- 3,000 s.f. offices
- 76,000 s.f. docks and warehouse space
- 39,000 s.f. support buildings
- 782,000 s.f. greenhouse buildings
Upon annexation, the Owner is seeking approval to add 5 greenhouse buildings on the
Property totaling an additional 200,000 s.f. of space.
The Annexation Petition for the Property was submitted to the Town of Lochbuie on
August 11, 2009 and Town of Lochbuie Board of Trustees approved a Resolution of
Substantial Compliance (No. 2009-11) on August 19, 2009, acknowledging receipt of the
petition for annexation for the property, adopting findings regarding said Property, and
setting the date, time, and place for the Public Hearing as September 23, 2009 at 7:00
p.m., at Lochbuie Town Hall.
Advertising and notice, pursuant to the C.R.S., has been directed by the Town of
Lochbuie. Copies of the annexation petitions, the referenced resolution, and the published
notice of the hearing were mailed to the Weld County Board of County Commissioners

and the County Attorney, among others, in accordance with C.R.S. §31-12-108. This
annexation impact report has been completed by the Town of Lochbuie.
B. ANNEXATION IMPACT REPORT REQUIREMENTS
This section is divided into the six elements that correspond to section 31-12-108.50(a)
through (f), C.R.S. as follows:

Three maps are included as exhibits to this report as required by Subparagraph (a) of
C.R.S. 31-12-108.5:
Exhibit A: Annexation map
The Annexation Map reflects that approximately 6,091.20 linear feet of the boundary of
the Property is contiguous with the Town of Lochbuie. The contiguity established with
the Town is indicated on the Annexation Map with a dashed line along the contiguous
portion of the Property boundary line. The percentage of the perimeter of the Property
contiguous with the Town of Lochbuie is 94.47%.
The perimeter of the proposed annexation that is contiguous with the current boundaries
of the Town of Lochbuie meets the requirement found in the Colorado Revised Statues
§31-12-104 that property be at least 1/6 (16.6%) contiguous with the municipality that is
being petitioned for annexation.
Exhibit B: Zoning map
The zoning map identifies that the Applicants are seeking C: Commercial zoning within
the Town of Lochbuie. This map also shows the current land uses of the property. The
property features extensive greenhouse facilities generally grouped toward the southern
and eastern portions of the property. An office and a few residences are also located on
the property.
Exhibit C: Site Plan submittal and Conceptual Utility Service map
This map identifies potential connection points for the proposed Town of Lochbuie sewer
and water lines necessary to serve the Property. The Applicant is working with the Town
to develop a Plan identifying the proposed water and wastewater services for the
Property. This Plan will provide the Town with coordinated water and wastewater
systems that can be developed in logical phases to serve the Property. Town potable
water and wastewater lines are adjacent to the property to the east in the WCR 37 right-
of-way. An alternative location for Town waste water services would be south of the
Property in The Farms subdivision.

Streets:
The Property is bounded by WCR 4 on the south and WCR 37 on the east. Private service
roads access the property including parking and loading areas.
The Town of Lochbuie may require the Applicant to complete a professional Traffic
Impact Study as part of any further development on the Property. This Study would
provide the Town with information regarding traffic and road impacts to adjacent
properties including Silver Peaks, The Farms, and Bella Vista subdivisions as well as the
impacts to WCR 4 and WCR 37. The Applicants will be required to improve roadways at
their expense per the findings of any Traffic Impact Study accepted by the Town of
Lochbuie.
Major trunk water mains, sewer interceptors and outfalls:
There are no water mains, sewer interceptors or outfalls onsite. The Property is not
currently connected to the Town's water or wastewater system. Water mains and sewer
interceptors or outfalls will be provided as set forth in an annexation agreement and any
subdivision improvement agreement.
Other utility lines and ditches:
Public Service Company of Colorado has an easement across a portion of the Property
and an irrigation line easement crosses the entire parcel from east to west. Other utilities
including power, telephone, natural gas, etc. are either found south and east of the
Property in developed subdivisions or along WCR 37.
2. PREANNEXATION AGREEMENT - C.R.S. § 31-12-108.5 (1) (b)
A preannexation agreement is not required and has not been prepared. An annexation
agreement is anticipated to be part of the annexation of this Property. Work on a draft of
annexation agreement is in progress and will be forwarded to the Weld County Attorney
and other parties upon its completion.
3. EXTENSION/PROVISION OF MUNICIPAL SERVICES - C.R.S. § 31-12-
108.5 (1) (c)
For all facilities and services, the Annexor will have the obligation to develop and install
all onsite and off -site transmission and/or infrastructure facilities necessary to serve the
Property with water, wastewater, stormwater facilities and associated services.
Water:
The Annexor has agreed to convey to the Town a sufficient amount of raw water or
purchase water rights to serve the development of the Property per Town Ordinances and
the Annexation and Development Agreement. Water treatment and water services will be
provided to the Property by the Town upon dedication of such water resources and
completion of all necessary infrastructure.

There is no plan or proposal to provide the TGI facility with potable water for the plants
growing in any of the greenhouse facilities. The Applicant has 4 wells on the site that
provide water for the greenhouse operation and no Town potable system is anticipated to
be used in that capacity.
Wastewater:
It is anticipated that the wastewater services and wastewater treatment will be provided
by the Town after acceptance of all wastewater infrastructure and facilities as constructed
by the Annexor.
Stormwater:
The Property generally drains towards the north and east. The Annexor will design and
construct storm drainage facilities within the Property including, but not limited to:
channels, inlets, piping, detention ponds and water quality facilities. The Annexor shall
convey and manage the 100 year storm events in compliance with standards approved by
the Town, the appropriate storm water district and as included in the Annexation
Agreement for the Property.
Other Utilities:
• Telephone service will be provided by Qwest
• Electrical service by United Power
• Natural gas service by XCEL Energy
Service lines will be located within street or other rights of way dedicated to those
purposes within the Property.
Emergency Services:
• Police protection will be provided by the Town's Police Department.
• Fire Protection will be provided by the Hudson Fire Protection District.
Open space/parks/public land dedication:
The annexation agreement and platting process will document the public land dedications
and/or fees that will be suitable for schools, libraries, fire and police substation facilities
and other public facilities as appropriate.
Streets:
The proposed access to the Property will continue to be from WCR 4 to the south and
WCR 37 to the east. It is anticipated that the Annexor will improve both off -site (as
identified) and onsite streets to urban public standards as identified in the annexation
agreement and the Lochbuie Municipal Code.

4. FINANCING SERVICE EXTENSIONS - C.R.S. § 31-12-108.5 (1) (d)
The extension of municipal services into the property will occur through one or more of
the following mechanisms:
1. Applicant funds,
2. Metropolitan Districts, or
3. As otherwise agreed to between the Town and the owners of the property.

the boundaries of the following taxing authorities:

6. EFFECT ON SCHOOL DISTRICT - C.R.S. § 31-12-108.5 (1)(f)
No residential development is anticipated on this property. The TGI parcel already
contributes to the tax revenues of the RE -3(j) District and as annexation will not change
the land use to a substantive degree, no change in the mill levy due the school district will
take place. The annexation agreement will identify and land dedications or cash -in -lieu
payments to offset the impacts of any new development should it include residential uses.
New development on the Property will increase revenues to the RE -3(j) School District
over the amount currently generated.
