RE: EXTENSION OF DEADLINE FOR SUBMITTAL OF APPLICATIONS FOR QUINQUENNIAL
FINDINGS OF REASONABLE DILIGENCE FOR BEEBE DRAW FARMS METROPOLITAN
DISTRICTS NOS. 1 AND 2
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on April 29, 2009, the Board approved Resolution Number 2009-1028, which
required that the Boards of Directors of Beebe Draw Farms Metropolitan Districts Nos. 1 and 2
('Metro Districts") submit to the Board of County Commissioners, within sixty (60) days of receiving a
copy of said Resolution, applications for quinquennial findings of reasonable diligence for Beebe
Draw Farms Metropolitan Districts Nos. 1 and 2, including certain required information, and
WHEREAS, the Metro Districts received a copy of Resolution Number 2009-1028 on
May 7, 2009, which therefore set the due date for said submittal of applications and information at
July 6, 2009, and
WHEREAS, the Metro Districts have submitted a letter dated June 11, 2009, a copy of which
is attached hereto, asking that the due date for submittal be extended to August 6, 2009, and the
Board deems it advisable to grant such extension.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the time for submittal of applications for quinquennial findings of reasonable
diligence for Beebe Draw Farms Metropolitan Districts Nos. 1 and 2, including certain required
information be, and hereby is, extended to and until 5:00 p.m., on August 6, 2009.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 22ndA.D., 2009.

Re: Beebe Draw Metropolitan District Nos. 1 and 2, Request for Quinquennial Review
Dear Commissioners:
As you know, the Board of County Commissioners ("County") by Resolution dated April 29,
2009 required the Boards of Directors of Beebe Draw Farms Metropolitan District Nos. 1 and 2
to submit to the County applications for quinquennial findings of reasonable diligence for Beebe
Draw Farms Metropolitan District Nos. 1 and 2 ("Quinquennial Application"). It is our
understanding that the deadline to submit the written application to the County is July 6, 2009.
Our firm was retained on June 2, 2009 as special counsel to Beebe Draw Farms Metropolitan
District No. 2 ("District No. 2") to represent District No. 2 with respect to the Quinquennial
Application. Since that time, we have been communicating with Jeff Hare and have a meeting
scheduled for June 25, 2009 to discuss and review the information requested in the Quinquennial
Application. In addition, we are communicating with Don Warden in order to schedule a
meeting as soon as possible to discuss and review the District information. The purpose of these
meetings and potential several follow up meetings, is to better understand the issues which the
County and Mr. Hare desire to have addressed in the Quinquennial Application and to work
towards an outcome for the process that is responsive to the concerns while preserving the ability
of District No. 2 to finance the construction and operation and maintenance of public
improvements.
In order to have these meetings and work through the issues raised we are requesting that the
deadline for responding to the Quinquennial Application process be extended 30 days to August
6th, 2009. Thank you for your consideration of this request.
