RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST HERBERT AND CATHERYN RIEHL FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Herbert and Catheryn Riehl, ZCV #0900238, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of December, 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Herbert Riehl, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until January 8, 2010, in order to allow adequate time for the property owners to
submit an application for a building permit.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0900238 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Herbert and Catheryn Riehl to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until January 8, 2010, in order to allow adequate
time for the property owners to submit an application for a building permit.

REMEDY
As we previously discussed, the presence of a second principle dwelling on a legal parcel requires a Use by

Additionally as we discussed, in order to cancel the above scheduled Violation Hearing, one of the following
applications shall be completed and submitted to this office prior to the above date:
1.) Use by Special Review (USR) appilcation.
2.) Building Permit application for the demolition of the struture.
3.) Building Permit application for the conversion of the structure from a 2nd dwelling unit to a shop or
personal storage unit of some kind.
RECOMMENDATION
The Department of Planning Services staff recommends that this case be forwarded to the County
Attorney's Office for immediate legal action.

Dennis Renley inspected this property. The property
owner had torn down the mobile home to the frame and
was starting construction on the frame of a new residence.
Dennis explained that a building permit was required.
Pre -Application Review Request meeting conducted at the
Greeley Planning Office.
Herbert Riehl came to the Greeley Planning Office to
discuss his violation case. He indicated that they had not
made any decisions one way or the other. I advised him
that my October Violation Hearings were full, so I was going
to schedule his case for December 8th Violations. That
actually meant he would need to make a decision fairly
quickly so he had time to compile and complete whichever
application he was going to proceed with (1.) USR
application (2.) Building Permit appilcation for demolition
(3.) Building Permit application to convert it to a personal
shop or storage unit.
Herbert Riehl called. He was trying to go over options on
how to bring the property into compliance. He is thinking
about making it a shop for now and then eventually if they
decide to make it a residence later on then they can apply
to make it a residence by first applying for a USR then a
building permit. He asked if I had sent him a certified
letter. I informed him that I did and scheduled it for
December. He thanked me for pushing that hearing out.
It sounds like he will either be submitting a building permit
to convert it to a shop/out building or a permit to demolish it.

Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a

Pre -application reviews are held with the Weld County Departments of Public Works and the Public Health and

The purpose for the request of a pre -application meeting is to discuss options concerning
two residential structures located on the property. The structures are served by Left Hand
water district and septic systems. Historically there have been two residential structures
located and used on this property.
We would like to discuss the possibility of establishing a non -conforming use of the lot

Neighbor left message on my voicemail — it appears they are building a 2nd dwelling on the property. Several
neighbors are upset. Evidently an old mobile home was on property in addition to the existing dwelling when this
guy bought it. They removed the mobile home and now appear to building another residence. I find no building
permits for an accessory, but some "maybes" on SLIC.
