The Board of Equalization found that the evidence presented at the hearing clearly supported the value placed upon your above described property by the County Assessor. Such evidence indicated the value was reasonable, equitable, and derived according to the methodologies, percentages, figures and formulas dictated to the Weld County Assessor by law. Board of Assessment Appeals: You have the right to appeal the County Board of Equalization's (CBOE's) decision to the Board of Assessment Appeals (BAA). Such hearing is the final hearing at which testimony, exhibits, or any other evidence may be introduced. If the decision of the BAA is further appealed to the Court of Appeals only the record created at the BAA hearing shall be the basis for the Court's decision. No new evidence can be introduced at the Court of Appeals. (Section 39-8-108(10), C.R.S.) New testimony, exhibits or any other evidence may be introduced at the District Court hearing. For filing requirements, please contact your attorney or the Clerk of the District Court. Further appeal of the District Court's decision is made to the Court of Appeals for a review of the record. (Section 39-8-108(1), C.R.S.) OR 3. Binding Arbitration: You have the right to submit your case to arbitration. If you choose this option the arbitrator's decision is final and your right to appeal your current valuation ends. (Section 39-8-108.5, C.R.S.) Selecting the Arbitrator: In order to pursue arbitration, you must notify the CBOE of your intent. You and the CBOE select an arbitrator from the official list of qualified people. If you cannot agree on an arbitrator, the District Court of the county in which the property is located will make the selection. Arbitration Hearing Procedure: Arbitration hearings are held within sixty days from the date the arbitrator is selected. Both you and the CBOE are entitled to participate. The hearings are informal. The arbitrator has the authority to issue subpoenas for witnesses, books, records, documents and other evidence. Looking through our subdivision's records (on the Weld County site), the valuation of most everyone's Improvements (i.e. your homes and outbuildings) have gone down since the 2007 NOV. Given the state of the housing market in the last two years, that's as it should be. However, for the most part, our Total Value has increased. How did that happen? Weld County increased the Valuation of our Land by 69.49 %! How they came up with that figure, I have no idea, especially since one of the comparable homes in Weld County I cited, only showed an increase in Land value of 19.65 % between 2007 and 2009. That's one of the issues I'm contesting. My contention is that the Land value associated with our location has decreased, not increased, since 2007's NOV. As I stated in my protest: DEPRECIATION OF LAND VALUE The 2007 N.O.V. valued the Land for the subject property at $88500. This assessment was based on market data from January 2005, through June 2006. A major factor of Land value stems from its location, coinciding with what encompasses the surrounding area. In the Fall of 2005, the Owens/Illinois bottling plant began operation in what is commonly known as the Windsor Industrial Park In the Fall of 2006, Front Range Energy began the operation of its ethanol production plant in the same Industrial Park In mid -2008, Vestas Wind Products began building its plant in Windsor Industrial Park The value of Willow Springs Estates' location has depreciated since the 2007 N.O. The assessor is required by statute to provide ouy with this information. C.R.S. 39-5-121.5. The assessor should provide you with a data sheet (referred to in some counties as an Inventory Content Sheet) that sets forth the assessor's description and condition of your property as of January 1st of the applicable tax year (See Exhibit 6-1; See Section 6.2). The assessor should also provide you with a list of the sales of comparable homes he used and the adjustments he made to those sales in determining the value of your home under the market approach (See Exhibit 9-1; See Section 9.2). 5.3 PREPARING PROTEST/USE OF FORMS The purpose of your protest is to determine the correct value of your home and to show that the assessor's value is incorrect. The following chapters provide procedures that can be followed to achieve this goal. You may use all of the arguments in the following chapters and all the forms in Appendix 6, or you may select only those that are applicable to your situation. The chapters listed below describe in detail the procedures of preparing your protest. The following is an overview. 1. Check Assessors Data (Chapter 6) In Chapter 6, you will check the data used by the assessor in determining the value of your home. You will report any errors in the assessor's description of your home and record any problems due to the condition of your home.
