RESOLUTION
WHEREAS, it has been determined by the Board of County Commis-
sioners, Weld County, Colorado, that a certain tract of land, being the
property of Archie M. Sprague, Route 1, Box 165E, Fort Lupton, Colorado,
and more particularly described as follows:
A tract of land, to wit, the North Half (Ni-) of
Section 9, Township 2 North (T2N), Range 67
West (R67W) of the 6th Principal Meridian, in
Weld County, Colorado, and being more parti-
cularly described as follows:
Beginning at the Northeast corner of said Section
9, from whence the North Quarter corner of
said Section 9 bears N89°01' W and with all other
bearings contained herein relative thereto, thence
S00°04'25" E along the East line of said North
Half of said Section 9, 2626. 87 feet, to the East
Quarter corner of said Section 9, thence N89°26'09"
W along the South line of the said North Half, 5218. 31
feet to the West Quarter corner of said Section 9,
thence N00°08'52" E along the West line of said
North Half, 2645. 89 feet to the Northwest corner of
said Section 9, thence 589°26'07" E along the North
line of the Northwest Quarter of said Section 9,
2599. 21 feet to the North Quarter corner of said
Section 9, thence 589°01' E along the North line of
the Northeast Quarter of said Section 9, 2609. 16
feet to the Point of Beginning, thus described tract
containing 316. 074 acres, more or less, and
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in 1973 C.R.S., 30-28-101 (10), as
amended, and
WHEREAS, the Board of County Commissioners of the County of Weld,
State of Colorado, has studied the request of the petitioner and studied the
recommendations of the Weld County Planning Commission, and having been
fully informed, now desires to exempt this particular division of land pursuant
to its authority under 1973 C.R. S. 30-28-101 (10) (d), as amended.
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove de-
scribed tract of land owned by Archie M. Sprague, Route 1, Box 165E, Fort
Lupton, Colorado, be exempted from the definition of the terms "subdivision"
and "subdivided land" as provided for in the new Weld County Subdivision Re-
gulations at Section 2-1, A. , (3) adopted August 30, 1972.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 29th day of October, A.D.,

Dear Sirs:
This letter is in reference to a request from Archie M. Sprague
for a Recorded Exemption on his property described as the North
Half of Section 9, Township 2 North, Range 67 West of the 6th
P.M. , Weld County, Colorado. The 316.074 acre farm is irrigated
and has two sets of improvements. The 12.432 acre parcel proposed
to be split off has one of the sets of improvements. A signifi-
cant portion of that parcel is part of a lake on the total pro-
perty.
The Planning Commission staff recommends approval for the following
reasons:
1 . The Intent Clause of Section 9-2 of the Weld County
Subdivision Regulations has been met in that non-
productive agricultural lands will be utilized.
2. All requirements of Section 9-3 and 9-4 of the
u ivision egulations have been met.

9-4 Review Procedures for Recorded Exemptions from Definition of
" Subdivision" or "Subdivided Land "
A. The Planner shall review the application for recorded exemption
from the definition of " subdivision " or "subdivided land " and
make his recommendations to the Board of County Commissioners .
Upon hearing the recommendations of the Planner and reviewing
the evidence presented in the application , the Board shall
make its decision . The Board shall not approve the exemption
of the proposed land division unless it finds the following :
(Rev . 4/ 17/74 )
(1 ) That the proposed lots are not part of a recorded ex-
emption from the definition of " subdivision " or " sub-
divided land" or a subdivision approved within less
than five (5 ) years previous ;
(2 ) That if the recorded exemption is approved , further
division of either tract or lot included in the re-
corded exemption into two (2 ) or more building sites ,
tracts or lots would not be allowed within a five ( 5 )
year period ; such five (5 ) year period being defined
as that period commencing upon the date of approval of
the most recent recorded exemption on the parcel of
land in question and extending five (5 ) years after
the date of such approval ; (Rev . 4/17/74 )
(3 ) That the lots resulting from the proposed land division
shall be accessible from an existing public road with
a minimum frontage in conformance with the Weld County
Zoning Resolution ;
(4 ) That the proposed lots will have access to an adequate
water supply;
(5 ) That the proposed lots will have access to an adequate
means for the disposal of sewage ;
(6 ) That the original tract or parcel of land to be divided
under this Section meets the minimum lot size require-
ments established by the Weld County Zoninn Resolution ;
variance from this requirement being allowed only upon
good cause being shown to the Board of County Commissioners
or where said tract or parcel of land lies within the
comprehensive plan area of an existing incornorated
town of Weld County. (Rev . 4/ 17/74 )
(7 ) That the minimum size of any building site , tract or
lot created by such land division shall not be less
than one ( 1 ) acre , except where smaller lot sizes are
allowed in a specific zoning district : (Rev . 4/17/74 )
(8) That the proposed land division is in compliance with
the Weld County Comprehensive Plan ;
(9 ) That said land division does not interfere with or lie
within major floodways or drainage courses ;
(101: That the method of disposition described in this Section
9 is not being adopted by the applicant for the purpose
of evading the requirements and intent of the Weld County
Subdivision Regulations . (Rev . 4/17/74 )
9-5 Violations - Further division of building sites , tracts or lot
defined by an approved recorded exemption into additional buildinn
sites , tracts or lots within five (5 ) years from the date of
approval of said recorded exemption , shall constitute a viola-
