RE: ACCEPTANCE OF LETTER OF CREDIT IN THE SUM OF $13 , 100. 00
TENDERED BY THE DEVELOPERS OF THE ALTHEN/BOYER SUBDIVISION,
FIRST AND SECOND FILING.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, previously accepted a $6 , 000. 00 cashier' s check as
security for compliance with an improvements agreement on the
First Filing of the Althen/Boyer Subdivision, and
WHEREAS, the improvement agreements upon the Second Filing
of said Althen/Boyer Subdivision requires the sum of $7 , 100 . 00
to be deposited with the Board of County Commissioners of Weld
County, Colorado to insure compliance with said improvements
agreement, and
WHEREAS , the developers have submitted to the Board of County
Commissioners , a letter of credit in the total sum of $13, 100 . 00
which they have requested to be submitted in lieu of the $6, 000. 00
cashier' s check deposited on the First Filing, and the $7,100. 00
which is to be deposited for security to insure performance of
the improvements agreement on said Second Filing, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado deems it in the best interest of Weld County, Colorado
to accept said letter of credit in the sum of $13,100. 00 for
both the First and Second Filings of the Althen/Boyer Subdivision,
and further deems it in the best interests of Weld County to
release the $6, 000 . 00 cashier' s check previously deposited by
the developers.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the letter of credit
herewith tendered in the sum of $13, 100 . 00 on behalf of the
developers of Althen/Boyer Subdivision, First and Second Filing,
be and hereby is accepted and the $6 , 000. 00 cashier ' s check
previously deposited by said developers regarding the improve-
ments agreement on the First Filing is directed to be returned

forthwith to said developer.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 20th day of
June, A.D. , 1977 .
The above and foregoing Resolution was read into the record
on the 6th day of July, A.D. , 1977.
