Joel Zapien, representative for Zapien Bothers Concrete, Inc., PO Box 1370, Brighton, CO 80601 has applied
for a Special Use Permit for a property described as 1884 Grace Avenue, Wattenburg, CO 80621. Mr.
Zapien is requesting a continuance of the Board of County Commissioners hearing until June 17, 2009 as the
May 5, 2009 Planning Commission hearing was continued at his request.

In follow-up to our telephone conversation of May 5, 2009, the Department of Planning Services per your
direction requested a continuance of this land use case until June 2, 2009. Given your direction seeking the
continuance due to decisions within your control, the Department of Planning Services is invoking Chapter 5,
Appendix 5-J, subheading number 18 which addresses the Department of Planning Services Land Use Fees.
The fee associated with the requested hearing continuance is being imposed, in this instance the fee is five
hundred (500.00) and no/100s dollars.
This action was taken as the property is currently in violation (ZCV07-01039) due to the storage and
operation of a commercial business and equipment storage without first obtaining the necessary land use
permits.
Payment of this fee is required upon receipt of this letter. Failure to comply will result in additional actions
taken by County staff, including yet not limited to, the recording of the Site Specific Development Plan and a
Special Review Permit Plat.
Also, I am enclosing the five documents prepared for the Planning Commissioners hearing. From the letters
received from the adjacent neighbors, there appears to be opposition to your facility being located adjacent to
Wattenberg. This is an issue that you should be prepared to address at the public hearings.

Land Use Fee Schedule

We, the undersigned, are opposed to the proposed petitions allowing
individuals to drive large and small commercial vehicles through the streets of
Wattenberg.
The following are just a few of the reasons for our opposition of such authorizations:
1. The People of Wattenberg will be immensely affected.
a. There are many school age children that wait for the bus on the
main street corners.
b. - There are no sidewalks in Wattenberg allowing for a safe place for
them to stand or walk as a safeguard against large and small
commercial vehicles.
2. The streets of Wattenberg are not built for the heavy weight and traffic of
such type of vehicles.
3. Our water lines run under these streets and will soon be damaged as a
result of the weight of such type of vehicles.
4. On many occasions these large vehicles have had to stop and back up on
to Weld County Road 6 just to drive on to the streets of Wattenberg.
5. The noise is very disruptive seven days a week and at all hours of the day.
6. The diesel fumes are a health hazard for the residents of Wattenberg.
7. There have been damages made to personal properties by such type
vehicles.
8. It appears that the Wattenberg Community has become a storage grounds
for many commercial vehicles and equipment.
This has been an ongoing problem. Many community members have attended
meetings, wrote written concerns regarding the above mentioned problems and it appears
that their concerns continue to go unacknowledged at the present time.
Many community members have full time employment and are unable to attend
scheduled hearings during the regular business day. We have signed this petition in the
hopes that our concerns be heard and that this petition be taken into full consideration
prior to authorization of large and small commercial vehicles being allowed full access
through our small community.

To Whom It May Concern:
This is the second time we have felt the need to submit a letter regarding the commercial
vehicle problem that the community of Wattenberg is currently facing.
Our home is located right on the corner of Mary Avenue and Weld County Road 6. We
are first hand witnesses to the hazards of this type of traffic.
On many occasions, even as this letter is being written, that these type of vehicles have
problems turning onto Mary Avenue or onto Weld County Road 6. When they attempt to
turn onto Mary Avenue they have had to literally back up on to Road 6 and go forward
again to complete the turn into Wattenberg. This is very dangerous because of the traffic
on Road 6. As these vehicles exit Wattenberg on to Road 6 they take two lanes to turn
(once again a danger to oncoming traffic on Road 6). As a result of this traffic there are
huge pot holes turning onto Mary Avenue.
We have two school age children that walk to the corner of Edward Street to catch the
school bus. On that bus stop alone there are approximately twelve students that range
from elementary school to high school. These children are faced with standing on the
corner by the stop sign. There are no sidewalks for them to stand on. This poses a
danger on a daily basis. It is very dangerous for a large commercial vehicle to be
zooming down the street and not be able to make sudden stops or see if there are small
children in their path.
I have heard other residents complain about the noise and the coming and going of
vehicles during the day. We had never witnessed this until recently. I have been on
medical leave for the past five weeks and I could not believe how many large vehicles
passed by my home and woke me throughout the day during my recovery.
If these vehicles are not allowed through residential areas in the city why should they be
allowed through residential areas in our small town? We must rely on you in your
appointed position in representing the people of our small town to put an end to the
commercial vehicle traffic in Wattenberg.

WE WOULD LIKE TO VOICE OUR OPINION BY STATETING WE ARE OPPOSED TO THIS PURPOSED
PROJECT, WITH THE FACT BEING THAT THIS IS A RESIDENTIAL AREA AND NOT A COMMERCIAL
AREA. WHEN THIS COMPANY "ZAPIEN BROTHERS" MOVED INTO THIS AREA, THEY BROUGHT
SEMI -TRUCKS, INEXPERIENCE DRIVERS, EARLY AND LATE WORKING HOURS (NOT THE NORM.),
DESTRUCTION TO PROPERTY, AND POLLUTION. WE DO NOT WANT TO SEE A REPEAT OF THIS
SITUTATION. FURTHERMORE, THERE WERE INCIDENTS WHERE THERE EMPLOYEES (IN THEIR
OWN VECHILES) WOULD MAKE THE MISTAKE OF DRIVING IN AND DRIVING OUT RECKLESSLY.
THEREFORE, WE WOULD LIKE FOR OUR COMMUNITY TO STAY EXACTLY AS IT IS, A RESIDENTAL
AREA.
