RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST FRED JACKSON, COUNTRY WIDE HOME LOANS, AND REMAX ALLIANCE/KENT DAVIS FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Fred Jackson, Countrywide Home Loans, and Remax Alliance/Kent Davis, ZCV #0900273, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of December, 2009, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Fred Jackson, Countrywide Home Loans, and RemaxAlliance/Kent Davis were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until February 8, 2010, in order to allow adequate time for the new property owner to bring the subject property into compliance by removing the noncommercial junkyard consisting of appliances, household trash, and miscellaneous debris, and for an inspection of the property by the Department of Planning Services staff. RECOMMENDATION The Department of Planning Services staff recommends this case be forwarded to the County Attorney's Office for immediate legal action. He said he was the listing agent on this property and was trying to conduct a short sale. He said he has already advised the new proposed purchaser about the condition and they are in agreement that they will be responsible for clean-up. I advised him that my current letter granted until October 26th for the property to be cleaned up. I would then conduct an inspection that week - if cleaned - I would close the violation - if not cleaned - the property would be scheduled for a Violation Hearing on November 10th. He said he understood and would pass this information along to the proposed new owners. They are just waiting for an answer from the bank. 10/12/2009 Phone Call Rex Jackson (307-682-7806) called. He said he wasn't living there anymore and when he left the property it was clean. He said he had heard that people had been dumping trash and making a mess. I explained that I had also sent these letters to the realtor. 11/04/2009 Property Inspected Upon a visual inspection of the property, the following items were noted: the property is still trashed out. No progress had been made. He said he received another letter regarding a hearing. I explained that the Assessor's Office still shows him as owning the property. He said he no longer owns it. I asked if the foreclosure was finished. He said yes. He said the property was clean when he moved out anyway. I explained that as long as the foreclosure process had been completed - he didn't have anything to worry about. He said good because he didn't know how he was going to make it up for the hearing and just didn't want to receive a fine or have a warrant issued for his arrest.
