RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
ZCV #0800104 AGAINST MILLER -TAYLOR FARM, LLC, C/O BECKY WEINKAUF;
MILLER FAMILY INVESTMENTS, LLC, C/O MINDY MILLER; AND MILLER OILFIELD
SERVICES, LLC, C/O BRADY MILLER FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Miller -Taylor Farm, LLC, do Becky Wienkauf; Miller Family Investments, LLC,
do Mindy Miller; and Miller Oilfield Services, LLC, do Brady Miller, #ZCV #0800104, are allegedly
in violation of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of September, 2008, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, at which
time this matter was continued to March 10, 2009, with the understanding that progress would be
made and this matter could be heard earlier than said date to insure the property owners are
working on getting this property into compliance.
WHEREAS, on the 13th day of January, 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Miller -Taylor Farm, LLC, representative Sherry Lockman, and Miller Oilfield
Services, LLC, representative Tom Harren, were present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to continue said
violation to April 14, 2009, to allow adequate time for the property owners to submit a Use by
Special Review application or to complete the removal and clean-up of the business on the site,
and to submit a Recorded Exemption, or an Accessory to the Farm application for the mobile
home, to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0800104 be, and hereby is, continued until April 14, 2009, to allow
adequate time for the property owners to submit all applications and to remove the business and
complete all clean-up of the site to bring the subject property into compliance.
