RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
ZCV #0900294 AGAINST THOMAS AND SHARON O'NEIL FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Thomas and Sharon O'Neil, ZCV #0900294, is allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of December 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Thomas O'Neil, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners determined a medical hardship exists;
therefore, the property is in compliance and the Board deems it advisable to dismiss said matter.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0900294 be, and hereby is, dismissed due to the determination a
medical hardship exists; therefore, the property is in compliance with Weld County Code.

REMEDY
First please accept my apologies for not being in attendance during your office visit. Wendi Inloes passed
along a copy of your lease agreement. Additionally, as I previously indicated, I am in receipt of your letter
dated September 29, 2009. The fact that this unit is not in compliance with ZPMH-2294 (as a Medical
Hardship) remains the issue of this violation. An extension of this legnth (August 2010) of time would need
to be determined by the Board of County Commissioners.
RECOMMENDATION
The Department of Planning Services staff recommends this case be forwarded to the County Attorney's
Office for immediate legal action.

with Wendi Inloes.

Tom Oneil (303-659-5786) called. He asked if he should
re -schedule another office appointment. I told him I would
be happy too, but I indicated that we should be able to
figure it out over the phone. He said he had done

a horrible job of explaining what the situation was. He
indicated that the mobile home was under contract to
purchase. He said the guy living in the mobile home was
helping him out on the property. He said the renter also
has his own horses out there that he was taking care of.
He said once the mobile home is removed, he would
probably be bringing a new one out to the property in order
to continue the medical hardship. I explained that a
complainant had been in touch with us and had indicated
that she would be in attendance to the Violation Hearing to
discuss the mobile home. He asked who it was. I indicate
I could not release that information, but he would be able to
see them at the hearing. He said he would see me at the
hearing then.

REAL ESTATE LEASE
This Lease Agreement (this "Lease") is dated August 12, 2009, by and between Colleen K O'Neil
("Landlord"), and (fain 56:Arbfa ? — ("Tenant"). The parties agree as
follows:
PREMISES. Landlord, in consideration of the lease payments provided in this Lease, leases to
Tenant This is a LEASE TO OWN agreement. The property is a mobile home located on the
south section of 14952 WCR 6, Ft Lupton, CO 80621. LEASE TO OWN price is $30,000
payable in 30 month installments of $1000.00. Property is not subject to in er ome is to
be moved within one year of contract date. Estimated move -by date i ugust 15, 2010. If lease
payments fall behind more than 60 days (2 months), renters will be as ou and
LEASE TO OWN option will be immediately terminated. (the "Premises") located at 14952 WCR
6 - Mobile Home, Ft Lupton, Colorado 80621.
TERM. The lease term will begin on August 06, 2009 and will terminate on January 31, 2012.
LEASE PAYMENTS. Tenant shall pay to Landlord lease payments of $1,000.00, payable in
advance on the 15th day of each month, for a total lease payment of $30,000.00. Lease payments
shall be made to Landlord at 4233 Falcon Drive, Ft Lupton, CO, 80621 which may be changed
from time to time by Landlord.
POSSESSION. Tenant shall be entitled to possession on the first day of the term of this Lease,
and shall yield possession to Landlord on the last day of the term of this Lease, unless otherwise
agreed by both parties in writing. At the expiration of the term, Tenant shall remove its goods
and effects and peaceably yield up the Premises to Landlord in as good a condition as when
delivered to Tenant, ordinary wear and tear excepted.
USE OF PREMISES/ABSENCES. Tenant shall occupy and use the Premises as a dwelling
unit. Tenant shall notify Landlord of any anticipated extended absence from the Premises not
later than the first day of the extended absence.
OCCUPANTS. No more than 4 person(s) may reside on the Premises unless the prior written
consent of the Landlord is obtained.
PETS. Tenant is permitted to have: Dogs or cats within the boundaries of the fenced property at
it's current location. No additional pets shall be allowed without the prior written consent of
Landlord.
FURNISHINGS. The following furnishings will be provided by Landlord: refrigerator, stove,
microwave, dishwasher, air conditioner. Tenant shall return all such items at the end of the lease
term in a condition as good as existed at the beginning of the lease term, normal wear and tear
excepted.
PARKING. Tenant shall be entitled to use 4 parking space(s) for the parking of motor
vehicle(s).
PROPERTY INSURANCE. Landlord and Tenant shall each be responsible to maintain
appropriate insurance for their respective interests in the Premises and property located on the
Premises.
UTILITIES AND SERVICES. Tenant shall be responsible for all utilities and services incurred
in connection with the Premises.
TAXES. Taxes attributable to the Premises or the use of the Premises shall be allocated as
follows:
REAL ESTATE TAXES. Landlord shall pay all real estate taxes and assessments for the
Premises.
PERSONAL TAXES. Landlord shall pay all personal taxes and any other charges which
may be levied against the Premises, along with all sales and/or use taxes (if any) that may be
due in connection with lease payments.
HABITABILITY. Tenant has inspected the Premises and fixtures (or has had the Premises
inspected on behalf of Tenant), and acknowledges that the Premises are in a reasonable and
acceptable condition of habitability for their intended use, and the agreed lease payments are fair
and reasonable. If the condition changes so that, in Tenant's opinion, the habitability and rental
value of the Premises are adversely affected, Tenant shall promptly provide reasonable notice to
Landlord.
DEFAULTS. Tenant shall be in default of this Lease if Tenant fails to fulfill any lease obligation
or term by which Tenant is bound. Subject to any governing provisions of law to the contrary, if
Tenant fails to cure any financial obligation within 30 days (or any other obligation within 10
days) after written notice of such default is provided by Landlord to Tenant, Landlord may elect
to cure such default and the cost of such action shall be added to Tenant's financial obligations
under this Lease. All sums of money or charges required to be paid by Tenant under this Lease
shall be additional rent, whether or not such sums or charges are designated as "additional rent".
The rights provided by this paragraph are cumulative in nature and are in addition to any other
rights afforded by law.
CUMULATIVE RIGHTS. The rights of the parties under this Lease are cumulative, and shall

not be construed as exclusive unless otherwise required t?y iaw.
NON -SUFFICIENT FUNDS. Tenant shall be. charged ',30,(1)0 for each check that is returned to
Landlord for lack of sufficient funds.
REMODELING OR STRUCTURAL IMPROVEMENTS. Tenant shall be allowed to
conduct construction or remodeling (at Tenant's expense) only with the prior written consent of
the Landlord which shall not be unreasonably withheld. At the end of the lease term, Tenant shall
be entitled to remove (or at the request of Landlord shall remove) any such fixtures, and shall
restore the Premises to substantially the same condition that existed at the commencement of this
Lease.
ACCESS BY LANDLORD TO PREMISES. Subject to Tenant's consent (which shall not be
unreasonably withheld), Landlord shall have the right to enter the Premises to make inspections,
provide necessary services, or show the unit to prospective buyers, mortgagees, tenants or
workers. However, Landlord does not assume any liability for the care or supervision of the
Premises. As provided by law, in the case of an emergency, Landlord may enter the Premises
without Tenant's consent. During the last three months of this Lease, or any extension of this
Lease, Landlord shall be allowed to display the usual "To Let" signs and show the Premises to
prospective tenants.
INDEMNITY REGARDING USE OF PREMISES. To the extent permitted by law, Tenant
agrees to indemnify, hold harmless, and defend Landlord from and against any and all losses,
claims, liabilities, and expenses, including reasonable attorney fees, if any, which Landlord may
suffer or incur in connection with Tenant's possession, use or misuse of the Premises, except
Landlord's act or negligence.
DANGEROUS MATERIALS. Tenant shall not keep or have on the Premises any article or
thing of a dangerous, flammable, or explosive character that might substantially increase the
danger of fire on the Premises, or that might be considered hazardous by a responsible insurance
company, unless the prior written consent of Landlord is obtained and proof of adequate
insurance protection is provided by Tenant to Landlord.
COMPLIANCE WITH REGULATIONS. Tenant shall promptly comply with all laws,
ordinances, requirements and regulations of the federal, state, county, municipal and other
authorities, and the fire insurance underwriters. However, Tenant shall not by this provision be
required to make alterations to the exterior of the building or alterations of a structural nature.
MECHANICS LIENS. Neither Tenant nor anyone claiming through the Tenant shall have the
right to file mechanics liens or any other kind of lien on the Premises and the filing of this Lease
constitutes notice that such liens are invalid. Further, Tenant agrees to (1) give actual advance
notice to any contractors, subcontractors or suppliers of goods, labor, or services that such liens

will not be valid, and (2) take whatever additional steps that are necessary in order to keep the
premises free of all liens resulting from construction done by or for the Tenant.
NOTICE. Notices under this Lease shall not be deemed valid unless given or served in writing
and forwarded by mail, postage prepaid, addressed to the party at the appropriate address set
forth below. Such addresses may be changed from time to time by either party by providing
notice as set forth below. Notices mailed in accordance with these provisions shall be deemed
received on the third day after posting.

GOVERNING LAW. This Lease shall be construed in accordance with the laws of the State of
Colorado.
ENTIRE AGREEMENT/AMENDMENT. This Lease contains the entire agreement of the
parties and there are no other promises, conditions, understandings or other agreements, whether
oral or written, relating to the subject matter of this Lease. This Lease may be modified or
amended in writing, if the writing is signed by the party obligated under the amendment.
SEVERABILITY. If any portion of this Lease shall be held to be invalid or unenforceable for
any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds
that any provision of this Lease is invalid or unenforceable, but that by limiting such provision it
would become valid and enforceable, then such provision shall be deemed to be written,
construed, and enforced as so limited.
WAIVER. The failure of either party to enforce any provisions of this Lease shall not be
construed as a waiver or limitation of that party's right to subsequently enforce and compel strict
compliance with every provision of this Lease.

BINDING EFFECT. The provisions of this Lease shall be binding upon and inure to the benefit
of both parties and their respective legal representatives, successors and assigns.

I'm writing this letter in reference to the complaint about the mobile home permit
(2PMH-2294) located at 14952 WCR 6, Ft. Lupton, CO 80621. This mobile home was
placed on the property for my daughter so she could assist me and my wife with the
general work around the farm and house.
I suffer from severe arthritis and emphysema and my wife has severe arthritis. This
spring, my daughter purchased a home and was no longer able to assist us as she had.
Knowing the zoning regulations we attempted to sell the mobile home and move it but in
light of the economy it was to no avail. Meanwhile, my neighbor is developing his
acreage with the intention of moving on to it and he needed a place until he could build a
home. With the move that my daughter made, my wife and I still needed help around the
farm and house. Our neighbor offered to lease to purchase the mobile home and help
around the place with the stipulation that the mobile home would be moved by no later
than August 1, 2010.
The date of August 1, 2010 was set to allow our neighbor time to finish his financing,
apply for and receive the necessary permits, drill a new well, and install electricity and a
septic system. The way things are progressing it does appear that he will be able to move
the home in March or the first part of April. He is as eager to get the unit moved as we
are.
