WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 27th day of June, 1979 at the hour of 2:00 o 'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Ray Ehrlich, 6121 Weld County Road 74 , Windsor, Colorado 80550 , for the granting of a Special Use Permit for a trapshooting range on the following described real estate, to-wit: That Portion of the Southwest Quarter of Section 31, Township 7 North, Range 67 West of the 6th Principal Meridian, County of Weld, State of Colorado being more par- ticularly described as follows: - Beginning at the Southwest corner of said Section 31; thence along the South line of said Southwest Quarter East 535.05 feet to the TRUE POINT OF BEGINNING; thence North 430 .00 feet; thence North 25°00 '00" West 734 .49 feet; thence North 72°26 '14" East 776. 56 feet; thence South 72°26 '14" East 776. 56 feet; thence South 25°00 '00" West 734.49 feet; thence South 430 . 00 feet to the South line of said Southwest Quarter; thence along said South line West 859 .90 feet to the TRUE POINT OF BEGINNING. Ray Ehrlich SUP-389 :79 :11 PLANNING COMMISSION RECOMMENDATION May 15, 1979 A. It is the opinion of the Planning Commission that the operation and management of the trapshooting range as outlined and controlled in the Development Standards will minimize any potential adverse impacts on the surrounding land uses to the greatest extent possible and provide adequate protection of the health, safety and welfare of the inhabitants of the area and the county. B. The following referral entities have reviewed this request and have set forth no objections to it : 1. Colorado Division of Wildlife 2. Weld County Health Department 3 . West Greeley Soil Conservation District 4. Colorado Geological Survey. It has recommended that soils and foundation investigations be conducted prior to construction of the clubhouse so that proper foundation design criteria can be determined. 5. Windsor-Severance Fire Protection District 6. Larimer County Planning Department 7 . Weld County Engineering Department provided the applicant installs a 40' x 15" CMP as requested in their memo dated May 14, 1979 . The Planning Commission recommendation for approval is conditional upon the following : 1 . The attached Development Standards being recommended and approved for the Special Use Permit plat. 2. No building or electrical permits shall be issued on the Special Use Permit area until the Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been delivered to the office of Department of Planning Services . ♦ 1 Ray Ehrlich DEVELOPMENT STANDARDS 1. The permitted uses on the hereon described parcel shall be for a trapshooting range. The property shall be restricted to only trapshooting. The facilities shall be limited to those which are shown hereon. 2. The trap field layout shall meet the requirements of the American Trap Association. 3 . All shooting conducted on the Special Use Permit area shall be supervised by a range officer or instructor qualified by the National Rifle Association or military service or other similar training. 4. Hours of operation shall be between 8 : 00 a.m. and 9 : 00 p.m. 5. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, and sanitary disposal systems . 6. All phases of the operation shall conform to permissible noise levels as stated in 25-12-103 , CRS, 1973 . 7 . Lighting provided for security and night operation on the site shall be designed so that the lighting will not adversely affect surrounding property owners. 8. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 9. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust and growth of noxious weeds. The site shall be maintained in such a manner as to present a neat and well kept appearance. 10. The south perimeter of the range shall be landscaped. The remainder of the range shall be planted and maintained with grass or other suitable ground cover. 11. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services . J Comments : 1 . To date, our office has received 3 letters of opposition from surrounding property owners who were notified of the request . Copies of their letters are in the attached materials . It should be pointed out that all three of the property owners live approximately 5/8 to 3/4 mile from the trap shooting facility. 2 . The applicant has submitted a petition and/or letters in favor of the request signed by the majority of the adjacent property owners. Highway 85 APPEARANCE: Sam Telep DISCUSSION: This item was continued from the May 1, 1979 Planning Commission meeting for a field trip to be taken individually by the members to see the site and also so that someone from Fort Lupton could reply to their letter or be present at this hearing for clarification on their decision to deny the request . Tom Honn first stated that the Comprehensive Plan was adopted by -the City of Fort Lupton in February of 1969. It was revised in 1973 which the City is currently using as well as the County Planning staff . ,P"tanning Commission 1 utes ' Page 2 May 15 , 1979 Sam Telep stated that it is hard to address a comprehensive plan when it was never adopted under the law. Rose Bowles , City Administrator of the Town of Fort Lupton, confirmed the adoption of the comprehensive plan as stated by Tom Honn previously . She also stated that the Fort Lupton Planning Commission voted to deny the change of zone request . Discussion followed regarding why the Town objected to the change of zone request . Corky Calder of the Fort Lupton Planning Commission stated that the Fort Lupton comprehensive plan restricts movement to the west . Development should move west and south . Russ Anson commented on the legality of the Fort Lupton comprehensive plan stating that the Weld County Planning Commission is not bound to the decisions of Fort Lupton and can presume the plan is valid. Rose Bowles read into the record the minutes of the Fort Lupton Town Board meeting which stated that the plan was adopted on February 14 , 1969 . Discussion again followed. MOTION: Be it therefore resolved to recommend denial based on the staff ' s recommendation to the Board of County Commissioners . Motion by Fred Otis, seconded by Irma White. Kennedy DISCUSSION: This item was also continued from the May 1, 1979 Planning Commission meeting for clarification from the State Highway Department regarding their recommendation for this request . Wally Jacobson of the State Highway Department stated that in reviewing the request they would like to amend their previous recommendation in that the additional 12 ' will not be needed. The existing acceleration lane should only extend to the proposed driveway and an appropriate taper be made on the east bound lane of 392 . For service in the future and as a result of a meeting with the Town of Windsor, a 16 ' median and 4 lanes will be utilized. Jim Gilbert then brought up the subject of the traffic flow at the intersection of 392 and 257 stating that something should have been done long before Mr. Kennedy' s proposal to help the situation . Ruth Fidino, Town Planner for the Town of Windsor, stated that she agreed with the traffic problem but that Mr. Kennedy ' s proposed use will add more problems . Also that something should be worked out between Mr. Kennedy and the State Highway Department to share the cost of the improvement . Mr. Kennedy then commented that he did not feel the traffic flow would affect the traffic flow that much. Discussion followed regarding any possible impacts that could result at the intersection. MOTION: Be it therefore resolved to recommend approval to the Board of County Commissioners based on the staff ' s recommendation with the elimination of the State Highway Department ' s recommendation. Motion carried for approval. , Planning Commission sting Page 3 May 15, 1979 APPLICANT: Harper Livestock Company CASE NUMBER: SUP-388 : 79 : 10 SUBJECT: Sheep Feedlot LEGAL DESCRIPTION: Pt . SW-11 and Pt . NE4, Section 27, T7N, R65W LOCATION: z mile north and 3z miles east of Eaton APPEARANCE: Tom Hellerick and Tom Norton DISCUSSION: Mr . Hellerich, attorney representing Mr . Harper, first gave a short presentation regarding Mr. Harper ' s experience in the livestock business . He stated that he has been in the sheep business for 19 years and has been involved in the livestock industry all his life and that he will not only be the seller of the sheep , but the owner of the business as well . He will be living on the premises. Tom Norton, engineer, then explained how the operation will be operated by the use of a map presentation. He also stated that drainage will be west and picked up in a settling pond. The water from the storage pond will be utilized for irrigation . He then went into a great amount of detail in explaining the pollution control measures that will be utilized on the site and read into the record a letter in response to the Weld County Health Department as regards wastewater retention , other permits required, noise levels and fly and mosquito control . Tom Honn read the staff ' s recommendation for approval and the Development Standards . John Hall of the Weld County Health Department expressed concern regarding the sealing of the lagoon and what measures will be taken regarding this . Mr. Norton stated that a proposal for sealing the lagoon has been proposed to the State Health Department , but they have not yet received anything back from them. Mr. Hall stated if their proposal poses no problem to the State Health Department , then the County Health Department would have no problem either with it . The floor was then opened to anyone who wished to express their opinion regarding the request . At this time Cynthia Berthurum expressed concern regarding fugitive dust and odor. Gene Inloes of the Weld County Extension Service responded to her concern about fugitive dust in that there will be dome dust at certain times throughout the year depending on the management and housekeeping of the operation and the amount of rainfall . Orville Green stated he was concerned about flooding of Owl Creek and Lone Tree Creek as did Eugene Clark. Jim Davis was concerned about flooding, pollution and decrease in his property value. Mrs . Berna Scott was concerned about dust and odor as she now has three feedlots surrounding her property. Alfred Miller, owner and operator of the feedlot to the west , stated he was in favor of the proposal and feels the applicant will manage the operation very well and follow all rules and regulations as required. MOTION: Be it therefore resolved to recommend approval to the Board of County Commissioners based on the staff ' s recommendation. Motion by Percy Hiatt , seconded by Ben Nix. SW4, Section 31, T7N, R67W LOCATION: Northeast of the intersection of County Road 74 and 13 \APPEARANCE: George Hall I Planning Commission IC ites Page 4 May 15 , 1979 (1 DISCUSSION: Mr. Hall first gave a brief background of information on the sport of trapshooting. This trapshooting range is a relocation of the range in Larimer County. It is unlike hunting in that there are very strict rules and regulations to be followed as regards ammunition used, etc . and must be adhered to at all times . The range will have a 5 trap layout with a clubhouse and will eventually expand to a 9 trap layout on 36 acres of property . The property is not suitable to farming. Access will be from County Road 74 . The noise level will be low. i Discussion followed regarding the regulation of shell loads . Tom Honn then read the staff ' s recommendation for approval and the Development Standards . He then stated that the staff had raised two subjects of concern in the Development Standards . These concerns were the landscaping around the area and the four consecutive days of operation . Mr . Hall J stated they would prefer not having shrubbery on the north side of the range as it is distracting to shooters and does not really provide a good ' sound barrier . Also, most shoots only last 2-3 days at the most . The staff ' s Development Standards state no longer than four consecutive days. Discussion followed. John Hall of the Weld County Health Department stat d that a noise study was conducted on the site with a reading of slightly over the required noise level . However, off the site the reading is acceptable . Jim Gilbert stated he had site reviewed the property and fe is this would be a tremendous asset to the area and of great benefit to the County. \ MOTION: Be it therefore resolved to recommend approval to the Board of County Commissioners based on the staff ' s recommendation . NE*, Section 15, T3N, F61W LOCATION: Approximately 9 miles northeast of Roggen on the north side of I-76 APPEARANCE : Murray Brown DISCUSSION: Mr. Brown stated that Kansas-Nebraska Natural Gas Company is in the process of moving their corporate headquarters from Hastings, Nebraska to Lakewood, Colorado. In view of this , they need to extend their towers from Sterling, Colorado to Lakewood. The towers are used for supervisory control, facsimile data, intercompany telephone service which is used for alarming and remote control valving. The micowave system is used to insure gas delivery to their customers. The proposed site is leased, will be unmanned, electrically operated and will pose no pollution problem, odor or fire hazard. Tom Honn then read the staff ' s recommendation for approval and the Development Standards . No further comments or questions. Steve Theede then stated that effective immediately there will be no night loading. This has been done on a somewhat limited basis and will new be discontinued. He stated there is a concrete driveway which was installed in 1978 . There is gravel on both sides of the road. They felt they have met the intent of the stipulation in the Special Use Permit as regards paving. Trees were planted around the perimeter of the site, but since there is no water on the property most of them have not survived. They have installed some aluminum lattice work in the woven wire fence as an alternative to the visual screening. There are three meter manifolds on the site instead of one as stipulated. They feel this allows traffic to get unloaded faster and get off County Road 21 . Bob Johnson, safety coordinator and registered engineer for Continental Pipeline Company , briefly reviewed the safety precautions at the facility . He also explained the alarm system that is utilized and how the system failed when the spillage occurred. Jack Berger, Jr . and Jack Berger, Sr. both again expressed their feelings in that they cannot believe anything Continental Pipeline Company says they will do. They also expressed concern regarding safety of the condesate and because Weld County has no fire code and therefore no authority. The applicant then decided it would be best if the application were withdrawn at this time. We feel the location we have chosen for she range is centrally located to serve Greeley, Ft. Collins and the Love- land area. It will be located 150 feet east of 6121 geld Coun- ty Road 74. This club will not be new. We are only relocating the range from Ft. Collins, where it has been at its present location for 13 years. With the growth of Loveland , Ft . Collins, Greeley and Windsor, it is very difficult to find an area with all the amenities suitable for a trap range . The reason for the move from the Ft. Collins area is the present range property was annexed by the city and will now be developed . We feel there is a definite need for a trap range as the only other club in Northern Colorado is the Greeley Trap and Skeet Club located in Island Grove Park. They have 5 traps with no room for expansion and are closed during the prime trapshooting season which runs from June to September. The trapshooting range is sanctioned by the Amateur Trap- shooting Association of which we are a member. (A .T .A . was established in 1901 and has over 100, 00 active members. ) We are also members of the Colorado State Trapshooting Association, which has over 1,500 active members. These facilities will be open to the public . They can also be used by the universities for a credit course , Gun Club Igmt ; Police and Sheriff Departments for training; also teaching Hunter Safety Courses. The range can also be used for league shooting sponsered by Kodak, Woodward Govenor, C .S .U . , Hewlett-Packard and local sporting good stores. Cie will also have registered shoots which are governed by The A .T .A . The club will be open year round . Normal operation would be weekends and two evenings during the week for league shoots. Registered shoots could require as many as four consec- utive days. (Zone Qualifications, Zone Championships, State Shoot, etc . ) We would not shoot before 8 A.M. or after 9 'r.bl. Plans include an adequate clubhouse with restrooms, an ample parking area, sufficient lighting and concrete walk- ways. Water Supply - Water hauled to cistern Disposal - Septic tank and leachfield according to EFA specifications. Until clubhouse facilities are complete portable toilets will be provided . Lighting - Flans for lighting and specifications on five traps are provided in the Winchaster- Western plans that are to be used in the con- struction of the trap range . There would be an average of 10 employees. During a registered shoot a maximum of 20 employees. Most employees would be students - high school or college . One individual in each trap house who would set the target on the machine . One score keeper on each trap who also would release the target for the squad of shooters on each trap. 18 trap personnel 1 cashier 1 range manager All other assistance comes from A.T .A . volunteers. There would be a resident manager on the premises. It will be supervised at all times . No alcoholic beverages will be allowed . Safety is always stressed and enforced . There will be instruction for beginners by A .T .A . members . Professional plans drawn by Winchester-Western will be used for building the new facilities . Mr. C. A. The permitted uses on the hereon described parcel shall be for a trapshooting range . The property shall be restricted to only trapshooting. The facilities shall be limited to those which are shown hereon. 2 . The trap field layout shall meet the requirements of the American Trap Association . 3. All shooting conducted on the Special Use Permit area shall be supervised by a range officer or instructor qualified by the National Rifle Association or military service or cther similar training. 4 . Hours of operation shall be between 8 : 00 a.m. and 9 :00 p .m. Operation of the facility shall not exceed four consecutive days at any one time. 5. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, and sanitary disposal systems . 6 . All phases of the operation shall conform to permissible noise levels as stated in 25-12-103, CRS, 1973 . 7. Lighting provided for security and night operation on the site shall be designed so that the lighting will not adversely affect surrounding property owners . 8. All accesses shall have the approval of the Weld County Engineering Department . All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department . 9 . The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust and growth of noxious weeds . The site shallbe maintained in such a manner as to present a neat and well kept appearance. 10 . The perimeter of range shall be landscaped to provide natural noise barriers as shown hereon . The remainder of the range shall be planted and maintained with grass or other suitable ground cover . 11 . The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations . Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. The maximum noise level, as specified by subsection 1, 25-12-103, C.R.S. 1973, for a commercial establishment is 60 db(A) from 7:00 a.m. to 7:00 p.m. Noise from gun shots within the property should not exceed those specified limits at 25 feet from the property line. Our April 2, 1979, study found that vehicles traveling along Weld County Road 74 equaled the 60 db(A) limit to be imposed on the gun club. Shotgun testing done on the property impulsed to 65 db(A). With distance off property, noise levels will decrease below the 60 db(A) limit. However, subsection 3 of 25-12-103 states that periodic, impulsive, or shrill noises shall be considered a public nuisance when such noises are at a sound level of five db(A) less than specified in subsection. Thus, we recommend that a tree buffer be built between the shooting area and Weld County Road 74 as this is the closest point of impact to any neighboring homes. Due to the large area covered by the request, and not knowing the precise area where the trap shoot is to be located, it is difficult to make specific comments. The table on Recreational Development should provide you with the necessary information. You also indicated the need for foundation information for possible future development. The Building Site Development table should provide insite into the potential for each soil for that purpose. Four soils in this area are considered to be prime farmland soils if under irrigation. It formed in mixed outwash deposits. P Included in this unit are some soils with dark surface layers . Some leveled areas ware also included in mapping. Typically the surface layer is grayish brown fine sandy loam about 10 inches thick. The subsoil is yellowish brown to very pale brown fine sandy clay loam about 14 inches thick. The substratum, to a depth of 60 inches , is calcareous fine sandy loam. Permeability is moderate. Available water capacity is moderate. Effective rooting depth is 60 inches or more . Surface runoff is medium % and erosion hazard is low. Where irrigated this soil is suited to all crops adapted to this arca, including corn, sugar beets , beans , alfalfa, small grains , potatoes and onions . An example of a suitable cropping system is alfalfa 3 to 4 years followed by corn, corn for silage , sugar beets , small grain, beans and back to alfalfa. Some conservation practices such as land leveling, ditch lining and pipelines may ae needed for proper water application. All methods of irrigation are suitable with furrow irrigation the most common type used. Barnyard manure and commercial fertilizers are FE° needed for top yields along with maintaining good organic matter content. r �� In nonirrigated areas this soil is suited to winter wheat , barley and r sorghum. The Aquolls , which have dark colored surface layers , make up about 55 Fc. c percent of the mapping unit . The Aquepts , which have lighter colored surface layers , make up about 25 percent. About 20 percent is made up of soils which arc well drained and soils which have sandstone or shale within 48 inches of the surface . These are deep , poorly drained soils . They formed in recent alluvium. Typically they have mottled , mildly to moderately alkaline , loamy or clayey surface layers and underlying materials which extend to a depth of 60 inches or more . They may or may not have a gleyed layer in the underlying material , Must of these soils are subject to excess ive runuf .£. A waterto ble is at or near the surface in the spring and during the peak of the irri- gation season. t -- These soils are used for rangeland and wildlife habitat . Some small areas arc used for irrigated pasture. The potential native vegetation on these soils is dominated by switch grass . prairie cordgrass , saltgrass , alkali sacaton , big bluestem, Indiangrass , western wheatgrass , slender wheatgrass , sedge and rush. Cattails and bullrush occur on swampy spots associated with this site. Much of this site has an increased amount of salts due to farming and irrigation of adjacent areas . Potential production ranges from 4000 pounds per acre in favorable I years to 3000 pounds per acre in unfavorable years . When range condition deteriotates the tall and ,nidgrasscs decrease , production drops and saltgrass sedge and rush increase. Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Switchgrass , big bluestem Tndiangrass , western wheatgrass , pubescent wheatgrass , intermediate wheatgrass , tall wheatgrass and tall fescue are suitable for seeding. The plants selected should meet the seasonal requirements of livestock . For successful seeding, a firm, prepared seedbed -- several tillage operations will normally be needed to eliminate the undesirable vegetation-- and a grass drill should be used . Early spring seeding has proven most successful. Wetland wildlife , especially waterfowl , utilize these areas . The r- - - availability of moisture due to the wetness of this soil allows pro- duction of wetland plants that provide nesting and protective cover. as well as some food for waterfowl. _ The juxtaposition of this soil t. Lo irrigated cropland areas where wildlife obtain much of their food , along with the cover provided , make this soil valuable to both wetland and openland wildlife. Openland wildlife , especially pheasants . use these areas for cover and nesting, while they also provide excellent cover for deer when found in areas inhabited by deer. It formed in very gravelly calcareous alluvium throughout the survey area. Inc lu•ced in this unit are small areas of soil which are shallow or moderately deep to •sandstone and shale. Typically the surface layer is brown gravelly ::,only loam ::bout 9 inches "' I thick. The subsoil is pale brown to light yellowish brown very gravelly sandy loam about 22 inches thick. The substratum, to a depth of 60 inches , is very gravelly sand. There is a layer of strong lime accumu- lation 36 to 36 inches thick below the-surface layer. - 4 Peameability is „coderately rapid. Available water capacity is moderate. Effective routing depth is 60 inches or more . Surface runoff is slow to medium and eros ion hazard is low. The potential,native vegetation on this soil is dominated by little bluestem, sideoaIs grama , sand lecdgrass , blue grama , hairy grama , - - switchgrass and needle-and-thread. Potential production ranges from 1200 pounds per acre in favorable years to 700 pounds per acre in unfavorable years . When range condition detelioraLes , the tall and midgrasses decrease , blue grama and hairy grama increase and production drops. Management of vegetation should be based on taking half or less of the total annual production. Since this soil dces not readily lend itself t,•. to seeding or any mechanical treatment , defected grazing is a practical method of improving range condition. \ Windbreaks and environmental plantings are suited to this soil. The potential native vegetation on this site is dominated by sand blue- . stem, sand reedgrass and blue grama.
