Environmental Health Services has reviewed this proposal for an automotive repair
business. Water is provided by Aristocrat Ranchette Water Project, Inc. A letter from
the water provider was supplied with the application and they have no concerns with
this request. The existing septic system in the home will be utilized (F19810024). As
there are no employees, which would increase the hydraulic load, an evaluation of the
septic system will not be required.
The applicant has indicated there are no floor drains in the shop and washing of
vehicles will not occur on site. A minimal dust abatement plan will be required for on
site dust. The plan should include items such as a reduced speed limit and watering, as
necessary. A waste handling plan is required to ensure materials are disposed of
properly. In addition, all products must be stored in compliance with manufactures
recommendations.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan, for on site dust, for review and
approval, to the Environmental Health Services, Weld County Department of
Public Health & Environment.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.

3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
9. The facility shall utilize the existing public water supply. (Aristocrat Ranchettes
Water Project).
10.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).

11. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Upon review of my case files and computer, an active Zoning Violation (ZCV08-00149) was noted. This
violation was initiated due to the operation of an automotive repair business without first obtaining the
necessary Weld County Zoning Permits. This case has not yet been presented to the Board of County
Commissioners through the Violation Hearing process.
This application if approved by the Board of County Commissioners will correct the violation. If this
application is denied, please ask the Board of County Commissioners to refer this case to the County
Attorney's Office, but to delay legal action for 30 (thirty) days in order to give them adequate time to
ensure that no future commercial auto repair occurs on this site.

There are three historical building permits listed for this parcel, all have been finaled.
1. A building permit shall be obtained prior to the change of use, or construction of any new
structures. The garage will probably be classified as an S-1 occupancy.
2. A plan review is required for each building for which a building permit is required. Two
complete sets of plans are required when applying for each permit. Include a Code Analysis
Data sheet provided by the Weld County Building Department with each Building permits
Submittal plans shall include a floor plan showing the specific uses of each area for the building.
The Occupancy Classification will be determined by Chapter 3 of the 2006 International Building
Code. The plans shall also include the design for fire separation and occupancy separation
walls, when required by Chapter 5 and 7 of the 2006 International Building Code. Fire Protection
shall conform to Chapter 9 and exiting requirements by Chapter 10.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006
International Building Code; 2006 International Mechanical Code; 2006 International Plumbing
Code; 2006 International Fuel Gas Code; and the 2008 National Electrical Code and Chapter 29
of the Weld County Code.
. 4. All building plans shall be submitted to Mountain View Fire District Fire District for review
and approval prior to issue of Building Permits,

The Weld County Public Works Department has reviewed this proposal. Comments made during this phase of
the process may not be all-inclusive, as other concerns or issues may arise during the remaining application
process. This project falls primarily under the purview of the Use by Special Review Standards, Weld County
Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS AND REQUIREMENTS:
Caroline and Richard are local gravel roads and require a 60 -foot right-of-way at full build out. There is
presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of
SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way
line.
Utilize the existing access to this parcel.
Storm Water Drainage:
The historical flow patterns and runoff amounts will be maintained on site in such a manner that it will
sonably preserve the natural character of the area and prevent property damage of the type generally
ributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

I spoke with Ben Hansford this morning about his road impact fee for USR-1685. His land use is categorized as
auto service/repair which has a fee of $1,470 per 1,000 sqft. He uses he residence as his shop location. He uses
approximately 420 sqft of a garage space to run his business, this makes his road impact fee $618. If you have any
